The MUR-1 and MUR-2 zones are designed to apply to predominantly residential areas where mixed-uses are permitted when compatible with the residential use.A high-density (MUR-1) and moderate-density (MUR-2) designation is available within the MUR zone. In addition to the standards of this chapter, development within these zones are subject to the standards of Chapter 18.670,Washington Square Regional Center Plan District. LLA2018-00005 Oak Street Condominiums 1 APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.810.030 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to a condition of approval. The findings and conclusions on which the decision is based are noted in Section IV. CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED 1. The applicant shall record the lot line adjustment with Washington County, and submit copies of the recorded survey map and updated deeds to the city within 15 days of recording, to be incorporated into the land use case file. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels (WCTM 1S135AA, Tax Lots 3800 and 70000) are located on the north side of SW Oak Street,on the south side of SW Oak Way,west of SW 87th Avenue,and east of SW 90th Avenue. In December 2005, the City of Tigard Planning Division approved a Site Development Review for the subject properties (Case Nos. SDR2005-00005 and VAR2005-00073). This approval was for five multifamily buildings,with a total of 46 dwelling units. However, only two multifamily buildings (with a total of 18 dwelling units) have been constructed, both of which are located on Parcel 2. Parcel 1 is currently vacant. In 2008,a condominium plat for Parcel 2 was recorded with Washington County. The purpose of this application is to adjust the property line between Parcels 1 and 2, so it matches with the recorded condominium plat boundary.The applicant intends to construct the remaining three multifamily buildings approved under Case Nos. SDR2005-00005 and VAR2005-00073 on Parcel 1.Both parcels are zoned Mixed-Use Residential 1 (MUR-1),and are located in the Washington Square Regional Center Plan District. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.810 Lot Line Adjustments and Lot Consolidations 18.810.030 Approval Criteria A. Approval criteria. The approval authority shall approve or approve with conditions an application for a lot line adjustment or lot consolidation application when all of the following are met: 1. An additional lot is not created by the lot line adjustment or lot consolidation, and the existing lot or lots are not reduced below the minimum lot size required by the applicable base zone. LLA2018-00005 Oak Street Condominiums 2 An additional lot will not be created as a result of this application. The applicant is proposing a lot line adjustment affecting two properties: WCTM 1S135AA,Tax Lot 3800 (Parcel 1), and WCTM 1S135AA, Tax Lot 70000 (Parcel 2). As a result of this lot line adjustment, Parcel 1 will be approximately 31,749 square feet in size, and Parcel 2 will be approximately 23,818 square feet in size. There is no minimum lot size requirement for the MUR-1 Zone.This criterion is met. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the applicable base zone regulations. As a result of this lot line adjustment,Parcel 1 will be approximately 31,749 square feet in size,and Parcel 2 will be approximately 23,818 square feet in size. Parcel 1 is currently vacant, and Parcel 2 currently contains two multifamily buildings, with associated parking and landscaping. Staff reviewed the applicant's materials to confirm the resulting lots and all existing structures will not be in violation of the applicable regulations for the MUR-1 Zone.This criterion is met. 3. The resulting lots are in compliance with the dimensional standards of the applicable base zone, including: a. The minimum lot width of the applicable base zone shall be met. Lot width for flag lots shall be measured as provided in Section 18.40.090. There is no minimum lot width requirement in the MUR-1 Zone. Additionally, the applicant is not proposing to create a flag lot through this lot line adjustment. This criterion is met. b. The minimum lot size as required by the applicable base zone shall be met. In the case of a flag lot, the accessway may not be included in the lot area calculation, as provided in Section 18.40.090. There is no minimum lot size requirement in the MUR-1 Zone. Additionally, the applicant is not proposing to create a flag lot through this lot line adjustment. This criterion is met. c. The depth of all lots shall not exceed 2.5 times the average width, unless the lot is less than 1.5 times the minimum lot size of the applicable base zone. This criterion is met. d. The side lines of lots shall be at right angles to the street upon which the lots fronts, unless impractical. Parcel 1 has 137.91 feet of frontage on SW Oak Way; staff reviewed the applicant's submitted site plan to confirm the side lines of Parcel 1 are at right angles to SW Oak Way,as far as practicable. Parcel 2 has 274.51 feet of frontage on SW Oak Street; staff reviewed the applicant's submitted site plan to confirm the side lines of Parcel 1 are at right angles to SW Oak Street,as far as practicable. This criterion is met. e. Each lot shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and LLA2018-00005 Oak Street Condominiums 3 Parcel 1 has 137.91 feet of frontage on SW Oak Way, and Parcel 2 has 274.51 feet of frontage on SW Oak Street. This criterion is met. f. Setbacks shall be as required by the applicable base zone. Setbacks for Parcel 1 will be confirmed at the time of building permit submittal for any future structures. Parcel 2 currently contains two multifamily buildings,with associated parking and landscaping.As demonstrated in the table above,Parcel 2 complies with all applicable setback requirements for the MUR-1 Zone.This criterion is met. 4. With regard to flag lots: a. The applicant may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved accessway is located within 10 feet of an abutting lot in compliance with Section 18.320.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The applicant is not proposing to create any flag lots through this lot line adjustment. Therefore, these criteria do not apply. 5. Where a common drive is to be provided to serve more than one lot,a reciprocal easement that will ensure access and maintenance rights shall be recorded with the approved lot line adjustment or lot consolidation. The applicant is not proposing to create a new common drive or accessway through this lot line adjustment. Therefore, this criterion does not apply. 6. Any accessway shall comply with Chapter 18.920,Access, Egress, and Circulation. Parcel 1 has 137.91 feet of frontage on SW Oak Way, and Parcel 2 has 274.51 feet of frontage on SW Oak Street. This criterion is met. LLA2018-00005 Oak Street Condominiums 4 FINDING: Based on the analysis above, staff finds the approval criteria for lot line adjustments are either met, satisfied through conditions of approval, or do not apply. Tax Lots 3800 and 70000 (Map 1S135AA) are located within the City of Tigard boundaries and carry Mixed Use Residential, MUR-1 designation. This application includes the City application forms,written materials,and preliminary plans necessary for City staff to review and determine compliance with the applicable approval criteria.The evidence supports the City's approval of the application. II. Site Description/Setting The two lots included in this application comprise a total area of ±1.28 acres. The lots are located immediately north of SW Oak Street, south of SW Oak Way, and west of SW 87th Avenue. Phase 1 of Oak Street Condominiums has been constructed on Tax Lot 70000. III. Applicable Review Criteria CITY OF TIGARD COMMUNITY DEVELOPMENT CODE 18.800 Land Division Chapter 18.810 LOT LINE ADJUSTMENTS AND LOT CONSOLIDATIONS 18.80.030 Approval Criteria A. Approval criteria. The approval authority shall approve or approve with conditions an application for a lot line adjustment or lot consolidation application when all of the following are met: 1. An additional lot is not created by the lot line adjustment or lot consolidation,and the existing lot or lots are not reduced below the minimum lot size required by the applicable base zone. Response: No lots or parcels will be created through this lot line adjustment. The adjusted lot area for Tax Lot 3800 will be ±31,749 square feet, and the adjusted area for Tax Lot 70000 will be ±23,818 square feet. There is no minimum lot size in the MUR-1 zoning district. This criterion is met. ?. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the applicable base zone regulations. Response: As discussed below, the lot line adjustment will not result in a violation of the site development or zoning district regulations. This criterion is met. 3. The resulting lots are in compliance with the dimensional standards of the applicable base zone, including: a. The minimum lot width of the applicable base zone shall be met. Lot width for flag lots shall be measured as provided in Section 18.40.090. Response: As shown in Table 18.520.2 below, there is no minimum lot width standard in the MUR-1 4110 zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation, as provided in Section 18.40.090; Response: As shown in Table 18.520.2 below, there is no minimum lot size in the MUR-1 zoning district. This criterion is met. c. The depth of all lots shall not exceed 2.5 times the average width, unless the lot is less than 1.5 times the minimum lot size of the applicable base zone. Response: The average width of the adjusted lots is ±206.21 feet. The depth of Lot 3800 is ±157.15 feet, and the depth of Lot 70000 is ±117.00 feet, which do not exceed 2.5 times the average width.This criterion is met. d. The side lines of all lots shall be at right angles to the street upon which the lots front, unless impractical. Response: There are no new lots being created through this lot line adjustment. As shown on the preliminary layout,the side lines of the adjusted Lots 3800 and 70000 are as close to right angles as practical. This criterion is met. e. Each lot shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and 4110 Response: There are no new lots being created through this lot line adjustment. Parcels 3800 and 70000 will both continue to have the same accesses after the lot line adjustment. This criterion is met. t. Setbacks shall be as required by the applicable base zone. Response: As discussed in 18.120.040 below, the adjusted lots will meet the setback standards for the MUR-1 Zone.This criterion is met. 4. With regard to flag lots: a. The applicant may determine the location of the front yard,provided that no side yard is less than 10 feet.
