The MUE-1 and 2 zones are designed to apply to areas where employment uses such as office, research and development and light manufacturing are concentrated. Commercial and retail support uses are allowed but are limited, and residential uses are permitted that are compatible with the employment character of the area. Lincoln Center is an example of an area designated MUE-1, a high-density mixed-use employment zone. The Nimbus area is an example of an area designated MUE-2, requiring more moderate densities. In addition to the standards of this chapter, development within these zones is subject to the standards of Chapter 18.670, Washington Square Regional Center Plan District. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located at 10450 SW Nimbus Avenue;on the southeast side of SW Nimbus Avenue,west of Highway 217,and south of SW Scholls Ferry Road.The subject property is part of the Scholls Business Center, which is made up of five tax lots, and totals 27 acres in size. The development contains 16 commercial buildings, 1,027 parking spaces, and associated landscaping. In March 2000, Tigard City Council approved amendments to the city's Comprehensive Plan Map, Comprehensive Plan Transportation Map, Comprehensive Plan, and Community Development Code applicable to the Washington Square Regional Center(Ordinance No.00-18 and Case Nos. CPA 1999-00002,ZON 1999- 00001, and ZOA 1999-00004). Specifically, this approval created the "Washington Square Regional Center" chapter of the Community Development Code, and rezoned the subject properties from Industrial Park (I-P) to Mixed-Use Employment 2 (MUE-2). This approval became effective in April 2000. The subject properties are currently zoned MUE-2 and are located in the Washington Square Regional Center Plan District. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.780 Site Development Review: 18.780.050 Minor Modifications C. Approval criteria. The approval authority shall approve or approve with conditions an application for a minor modification when all of the following are met: 1. The proposed development is in compliance with all applicable requirements of this title;and Because the applicant has only proposed a change of use, which primarily affects off-street parking regulations, that is the main focus of this review. The two subject tenant spaces total 15,954 square feet in size,and will be changing from an office use to research and development. The 27-acre development is a multi-tenant site,and is therefore subject to the required minimum vehicle parking formula outlined in CDC 18.310.030.D. The attached table (Attachment 1) calculates the minimum off-street vehicle parking requirements based on this formula. Staff finds that 776 parking spaces are required for the site, taking into consideration the change of use discussed above.Based on the applicant's submitted materials,staff finds there is adequate parking at the development site,with 1,027 parking spaces provided. Upon review of the applicant's plans and narrative,staff finds this proposal is in compliance with all other applicable requirements of this title. This criterion is met. MMD2018-00036 Kruger Optical 2 2. The modification is not a major modification. The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this proposal is not a major modification. This criterion is met. CONCLUSION: The proposal is a minor modification to an existing development and is in compliance with the applicable requirements of this Title.
