APPLICATION SUMMARY FILE NAME: McDonald's CASE NO.: Minor Modification(MMD) MMD2018-00034 PROPOSAL: The applicant is proposing a minor modification to an existing fast food eating and drinking establishment(McDonald's) at 12388 SW Scholls Ferry Road. Specifically, the applicant proposes to modify the roofline of the existing building,and to update the design and materials of the exterior building facades.The applicant also proposes modifications to the on-site parking lot and on-site landscaping, in order to accommodate a new on-site pedestrian walkway,and to comply with the Americans with Disabilities Act(ADA). The C-G zone is designed to accommodate a full range of retail, office, and civic uses with a citywide and even regional trade area. Except where nonconforming, residential uses are limited to single-family residences that are located on the same site as a permitted use. A wide range of uses, including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses, utilities, heliports, medical centers, major event entertainment,and gasoline stations, are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code (CDC) Chapter 18.780.050.0 MMD2018-00034 McDonald's 1 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located at 12388 SW Scholls Ferry Road, on the south side of SW Scholls Ferry Road,east of SW North Dakota Street,and west of SW 121st Avenue.The subject property is 1.27 acres in size, and contains an existing 6,700-square-foot fast food eating and drinking establishment with a drive-through facility, an on-site parking lot, and associated landscaping. The property is zoned General Commercial (C-G). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.780 Site Development Review: 18.780.050 Minor Modifications C. Approval criteria. The approval authority shall approve or approve with conditions an application for a minor modification when all of the following are met: 1. The proposed development is in compliance with all applicable requirements of this title;and The applicant is proposing a minor modification to an existing fast food eating and drinking establishment (McDonald's) at 12388 SW Scholls Ferry Road. Specifically, the applicant proposes to modify the roofline of the existing building,and to update the design and materials of the exterior building façades. The maximum building height in the C-G Zone is 45 feet (CDC Table 18.120.3). Staff reviewed the applicant's submitted elevation drawings to confirm the modified building design complies with this standard. The applicant is not proposing any changes to the existing building footprint. Accordingly, development standards for the C-G Zone, such as minimum setbacks and maximum site coverage, do not apply to this modification. The applicant also proposes to modify the layout of the on-site parking lot,in order to comply with ADA standards. Staff reviewed the applicant's submitted site plan to confirm the modified parking lot meets all applicable parking design standards in CDC 18.310.040.Additionally,the site is currently occupied by an existing 6,700-square-foot fast food eating and drinking establishment, which has a minimum off- street parking requirement of 7.0 parking spaces for every 1,000 square feet of floor area (CDC Table 18.310.2).Accordingly,the minimum off-street parking requirement for the subject site is 47 spaces. Staff reviewed the applicant's site plan to confirm there is adequate parking on site,with 71 spaces provided. The applicant also proposes to modify on-site landscaping, in order to accommodate a new ADA- accessible pedestrian walkway that will provide a connection from the existing building to SW Scholls Ferry Road. The minimum landscape requirement for the C-G Zone is 15 percent; however, there is currently only 7,344 square feet of landscaping (or 13.4 percent) provided on site. Therefore, this MMD2018-00034 McDonald's 2 development is considered existing nonconforming. Staff reviewed the applicant's materials to determine that this proposal will result in 7,413 square feet of landscaping (or 13.5 percent) provided on site. Although this is still below the 15 percent minimum landscape requirement, staff finds this modification is approvable, as it will result in an overall increase to on-site landscaping, and will accordingly decrease the development's nonconformity (CDC 18.50.040.C.1.a). Staff also reviewed the applicant's plans for the on-site pedestrian walkway to confirm it complies with all applicable standards for walkway location, design, and pedestrian safety, as outlined in CDC 18.920.030.F. Furthermore, the Building Official will review this proposal for compliance with all applicable ADA standards at the time of building permit submittal. Upon review of the applicant's plans and narrative, staff finds that all other requirements of Title are not applicable. This criterion is met. 2. The modification is not a major modification. The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this proposal is not a major modification. This criterion is met. CONCLUSION: The proposal is a minor modification to an existing development and is in compliance with the applicable requirements of this Title. SECTION V. One option would be to remove a parking space, and replace it with landscaping. Fast food restaurants are required to have 7 parking spaces for. every 1,000 square feet, so based on your site plan, it looks like you have more than enough parking (47 required, 71 shown). Since the landscaping is currently nonconforming because it falls below the 15"'o minimum, we cannot approve a further reduction to the landscaping (this would increase the development's nonconformity). Revise your plans to show you're moving further into conformance with the 15%o requirement— so, for example, if the site currently has 7,344 square feet of landscaping, revise your plans to show you'll end up with 7,345 square feet or more of landscaping. Basically, you won't be required to bring it up to the full 15%, but there needs to be a net gain in on-site landscaping. I've copied/pasted the applicable Code section below. We believe that this small of a reduction of landscaping is warranted when we are adding a necessary accessibility feature to our site. This walkway will allow pedestrians to exit the site and access SW Scholls Ferry Road without having to travel in the shared driveway. Additionally please see attached screenshots, the site is densely vegetated with a large number of trees, bushes, grass and well-designed landscaping features. While the new north ADA walkway will add 239 SF of impervious area we were able to add 158 SF of pervious landscaped areas around the site (near the NW entrance & in the drive thru.)
