APPLICATION SUMMARY FILE NAME: Tigard Industrial, LLC CASE NO.: Minor Modification (MMD) MMD2018-00031 PROPOSAL: The applicant is proposing a minor modification to an existing development at 9826 SW Tigard Street. Specifically, the applicant proposes to: divide one existing tenant space into two tenant spaces; remove two exterior windows and one exterior door, and install a new aluminum storefront with insulated glazing; convert two standard parking spaces to one Americans with Disabilities Act (ADA) accessible parking space; and add one additional ADA accessible parking space. The I-P zone provides appropriate locations for combining light manufacturing, office and small-scale commercial uses, e.g., restaurants, personal services and fitness centers, in a campus-like setting. Only those light industrial uses with no off-site impacts, e.g., noise, glare, odor, vibration, are permitted in the I-P zone. In addition to mandatory site development review, design and development standards in the I-P zone have been adopted to ensure that developments will be well-integrated, attractively landscaped,and pedestrian-friendly. APPLICABLE REVIEW CRITERIA: Community Development Code (CDC) Chapter 18.780.050.0 MMD2018-00031 Tigard Industrial,LLC 1 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located at 9826 SW Tigard Street, on the southwest side of SW Tigard Street, northwest of SW Grant Avenue, and south of SW Katherine Street. Fanno Creek borders the property to the south and east. The subject property (WCTM 2S102AB, Tax Lot 1902) is 2.38 acres in size, and contains an existing 27,958-square-foot industrial building, 36 parking spaces, and associated landscaping. The industrial building currently contains two tenant spaces: one is currently occupied by a light industrial use (Barrier Corporation), and the other space is currently vacant, but was previously occupied by a light industrial use. The subject property is zoned Industrial Park (I-P), and is partially located in the Clean Water Services Vegetated Corridor and the Federal Emergency Management Agency Special Flood Hazard Area. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.780 Site Development Review: 18.780.050 Minor Modifications C. Approval criteria. The approval authority shall approve or approve with conditions an application for a minor modification when all of the following are met: 1. The proposed development is in compliance with all applicable requirements of this title;and The applicant is proposing a minor modification to an existing development at 9826 SW Tigard Street. Specifically, the applicant proposes to divide one existing tenant space into two tenant spaces. This tenant space was previously occupied by a light industrial use, and the applicant also proposes light industrial uses for the newly-created spaces. Therefore, there is no change of use with this application, and no change to the minimum off-street parking calculations for this property. The applicant also proposes to remove two exterior windows and one exterior door, and install a new aluminum storefront with insulated glazing. The applicant is not proposing any changes to the existing building footprint or height; accordingly, development standards for the I-P Zone such as minimum setbacks,maximum building height,and maximum site coverage do not apply to this modification. The applicant also proposes to convert two standard parking spaces to one ADA accessible parking space, and to add one additional ADA accessible parking space. Staff reviewed the applicant's site plan to confirm there is no change to the total on-site parking count,with 36 spaces provided. Additionally, the Building Official will review this proposal for compliance with all applicable ADA standards at the time of building permit submittal. MMD2018-00031 Tigard Industrial,LLC 2 Minimum landscape requirements for the I-P Zone do not apply to this modification, as the applicant is not proposing any changes to on-site landscaping. Upon review of the applicant's plans and narrative, staff finds that all other requirements of Title are not applicable.This criterion is met. 2. The modification is not a major modification. The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this proposal is not a major modification. This criterion is met. CONCLUSION: The proposal is a minor modification to an existing development and is in compliance with the applicable requirements of this Title. SECTION V. We are proposing to replace an existing hollow metal man door and two windows with storefront There is no tenant proposed for the space, however, it is anticipated that the use would be Offce/Warehouse consistent with the existing park uses. The previous use of the space was Office/Warehouse/Manufacturing. This letter is to address the criteria contained in Section 18.780.040(B). 1. An increase in dwelling unit density, or lot coverage for residential development This is a commercial development,therefore this criteria does not apply 2. A change in the ratio or number of different types of dwelling units This is a commercial development,therefore this criteria does not apply. 3. A change that requires additional on-site parking in accordance with Chapter 18.765 Mile proposed speculative tenant space would have 810 SF off office. According to Table Tr310.2, Office use is required to have 2.7/1,000 SFEIFhe remainder of this space will be bl'arehouse at.5/1,000 SF.
