The C-G zone is designed to accommodate a full range of retail, office and civic uses with a city-wide and even regional trade area. Except where non-conforming, residential uses are limited to single-family residences that are located on the same site as a permitted use. A wide range of uses, including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses, utilities, heliports, medical centers, major event entertainment, and gasoline stations, are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.780.050.0 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. MMD2018-00030 Electrify America 1 THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located at the Walmart retail center,which is approximately 18 acres in size and is made up of three tax lots (7500, 7600, and 7700 SW Dartmouth Street;WCTM 2S101BA, Tax Lots 101, 500, and 600).All three properties are owned by Walmart,and the retail center incudes the main Walmart store (approximately 138,000 square feet in size), two smaller multi-tenant commercial buildings (approximately 12,000 square feet each), 692 parking spaces, and associated landscaping. The property is zoned General Commercial (C-G), and is located in the Tigard Triangle Plan District. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.780 Site Development Review: 18.780.050 Minor Modifications C. Approval criteria. The approval authority shall approve or approve with conditions an application for a minor modification when all of the following are met: 1. The proposed development is in compliance with all applicable requirements of this title; and The applicant proposes a minor modification to on-site parking and on-site landscaping at the Walmart retail center. Specifically, the applicant proposes to remove 13 parking spaces and approximately 400 square feet of on-site landscaping,in order to accommodate eight new electric vehicle charging stations and associated equipment. In May 2009, the City of Tigard Planning Commission approved a Planned Development on the subject properties for a retail center with three commercial buildings, associated parking, and landscaping (Case No. PDR2008-00001). In this approval, it was determined that the minimum off-street parking requirement for the entire retail center was 600 spaces. No subsequent land use approvals have been issued for the retail center that would impact off-street parking requirements. Therefore, even with the proposed reduction of 13 spaces, staff finds there is still adequate parking at the retail center, with 679 spaces provided. Additionally, staff reviewed the applicant's submitted landscaping plans, and the original approved landscaping plans from Case No. PDR2008-00001. Even with the proposed reduction of 400 square feet of on-site landscaping,staff finds the retail center continues to exceed the 15 percent minimum landscape requirement for the C-G Zone (CDC Table 18.120.3). Upon review of the applicant's plans and narrative, staff finds that all other applicable requirements are met. This criterion is met. 2. The modification is not a major modification. The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this proposal is not a major modification. This criterion is met. CONCLUSION: The proposal is a minor modification an existing development and is in MMD2018-00030 Electrify America 2 compliance with the applicable requirements of this Title. SECTION V. PROPOSAL DESCRIPTION Electrify America is working to establish a comprehensive, technologically advanced, and customer-friendly charging network-- to drive EV adoption by reducing charging anxiety. In its first investment cycle, Electrify America will establish a network that includes non- proprietary electric vehicle chargers (CCS, CHAdeMO and J1772 standards) at over 650 community-based sites and nearly 300 highway sites across the country. Community-based charging station sites will be built in workplaces, retail (shopping centers, restaurants, etc.), multifamily residential locations and municipal lots and garages, as well as high-speed community depots that will feature fast EV charging at speeds of up 350kW compared with today's peak of 50kW. Highway sites will be located along high-traffic corridors between metropolitan areas, including cross-country routes, and will include between four and ten 150kW and 350kW individual DC fast chargers at each location before June 2019. These sites will be located no more than approximately 120 miles apart and on average just 70 miles apart. Many shorter range EVs will benefit from 50kW DC fast charging on the Electrify America highway network, including any CHAdeMO equipped vehicles. The proposed facility will be located in the Walmart parking lot at 7600 SW Dartmouth Street. There will be a total of eight charging stations, with nine control cabinets to operate them. The attached site plan shows the proposed layout. III. APPLICABLE CRITERIA The applicant had a pre-application conference with the City on May 23, 2017 for a Tesla EV charger located at Washington Square to determine what review procedure was appropriate since EV chargers are not specifically listed in the Tigard Code. It was determined that the Tesla project should be reviewed as a Minor Modification to the existing parking garage. The applicant is requesting that the Electrify America application also be reviewed as a Minor Modification to an existing parking lot. Chapter 18.780 SITE DEVELOPMENT REVIEW 18.780.030 Approval Process B. Minor modifications. An application for a minor modifications of an approved plan or existing developments, as defined in Page 2 July 2, 2018 Section 18.780.050, shall be processed through a Type I procedure, as provided in Section 18.710.050, using approval criteria in Section 18.780.050. The applicant is applying for a Type I review. 18.360.050 Minor Modifications A. Minor modification defined. Any modification that is not within the description of a major modification as provided in Section 18.780.040 shall be considered a minor modification. The applicant is providing three copies of the proposed site development plans and this narrative. C. Approval criteria. The approval authority shall approve or approve with conditions an application for a minor modification when all of the following are met: 1. The proposed development is in compliance with all applicable requirements of this title; and Applicable requirements of this title are addressed below. 2. The modification is not a major modification. Title 18.780.040, Major Modifications, lists the following evaluation criteria to determine if a major modification will result: Page 3 July 2, 2018 1. An increase in dwelling unit density, or lot coverage for residential development; No residential development is proposed as part of this application. 2. A change in the ratio or number of different types of dwelling units; No residential development is proposed as part of this application. 3. A change that requires additional on-site parking in compliance with Chapter 18.310, Off-Street Parking and Loading; The proposed EV chargers will be installed at existing parking stalls. As part of Case No. PDR 2008-0001 the City determined that the Walmart property (originally approved as a Target store) required a minimum of 510 parking spaces. As approved, the site has 561 spaces (see attached). The Electrify America site will occupy a total of 11 spaces, which leaves a total of 550 spaces still available for general parking, well above the required 510. 4. A change in the type of commercial or industrial structures as defined by the state building code; The proposed EV chargers will be installed at existing parking stalls in the existing Walmart parking lot. No structures will be modified. 5. An increase in the height of the building(s) by more than 20 percent; The proposed EV chargers will be installed at existing parking stalls in the existing Walmart parking lot. No structures will be modified. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected; The proposed EV chargers will be installed at existing parking stalls in the existing Walmart parking lot. No existing accessways will be modified. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day; The proposed EV chargers will be installed at existing parking stalls in the existing parking lot. No increase in traffic is expected. Page 4 July 2, 2018 8. An increase in the floor area proposed for a nonresidential use by more than 10 percent excluding expansions under 5,000 square feet; The proposed EV chargers will be installed at existing parking stalls in the existing Walmart parking lot. No existing uses will be modified. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by this title or reduces the open space area by more than 10 percent; The proposed EV chargers will be installed at existing parking stalls in the existing Walmart parking lot. No structures will be modified. No open space or common areas will be affected. 10. A reduction of project amenities below the minimum required by this title or by more than 10 percent where specified in the site plan: a. Recreational facilities; b. Screening; and/or c. Landscaping provisions The proposed EV chargers will be installed at existing parking stalls in the existing Walmart parking lot. No structures will be modified. No open space or common areas will be affected. 11. A modification to the conditions imposed at the time of site development review approval that are not the subject of paragraphs 1 through 10 of this subsection No modifications to conditions are proposed by this application. Based on the findings above it can be determined that the proposed EV chargers are a minor modification. 18.780.060 Approval Criteria The approval authority shall approve or approve with conditions a site development review application when all of the following are met: Page 5 July 2, 2018 A. Outdoor bicycle parking facilities shall be surfaced with a hard surfaced material, i.e., pavers, asphalt, concrete, other pervious paving surfaces, or similar material. This surface must be designed and maintained to remain well-drained. Response: The proposed bicycle parking spaces will be located on hard surfaced material, either concrete or asphalt. E. Minimum bicycle parking requirements. The total number of required bicycle parking spaces for each use is specified in Table 18.768.2 in Section 18.765.070.H.
