The C-G zone is designed to accommodate a full range of retail, office and civic uses with a city-wide and even regional trade area. Except where non-conforming, residential uses are limited to single-family residences that are located on the same site as a permitted use. A wide range of uses, including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses, utilities, heliports, medical centers, major event entertainment,and gasoline stations,are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code (CDC) Chapters 18.520.070 and 18.780.050.0 MMD2018-00027 and UFR2018-00007 Taco Bell 1 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The 0.73-acre site is located on the northwest side of SW Pacific Highway;north and east of SW Watkins Avenue, and south of SW Park Street. The project site is currently developed, and includes an existing 1,970-square-foot fast food eating and drinking establishment with a drive-in facility, on-site parking lot, and associated landscaping. In March 2018, the City of Tigard Planning Division approved a Site Development Review to demolish the existing restaurant, and replace it with a building of similar size, but with a modified design (Case No. SDR2017-00007).This approval included additional modifications to the site, including updating the on-site landscaping, creating a new on-site pedestrian walkway, and installing new bicycle parking. The property is zoned General Commercial (C-G). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.520 Urban Forestry: 18.520.070 Modification to the Urban Forestry Plan Component of an Approved Land Use Application A. Approval process. Except as exempted in Subsection 18.520.070.B, an application for a modification to the urban forestry plan component of an approved land use shall be processed through a Type I procedure, as provided in Section 18.710.050, using the approval criteria in Subsection 18.520.070.C. The applicant proposes to modify the Urban Forestry Plan originally approved under Case No. SDR2017-00007. Specifically,the applicant proposes to remove one tree that was originally proposed for preservation,in order to accommodate a new on-site rain garden.The removal of this tree is not exempt from the Type I Urban Forestry Plan Modification. Therefore,this application is subject to the approval criteria outlined below. C. Approval criteria. The approval authority shall approve or approve with conditions the modification to the urban forestry plan component of an approved land use application when all of the following are met: 1. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; The project landscape architect,Troy Mears of Mears Design Group,LLC,has provided a revised report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification. This criterion is met. 2. The project arborist or landscape architect has provided a report and statement MMD2018-00027 and UFR2018-00007 Taco Bell 2 certifying that there is no practicable alternative to the proposed modification; and The project landscape architect has provided a revised report and statement certifying that there is no practicable alternative to the proposed modification. This criterion is met. 3. The project arborist or landscape architect demonstrates through a revised urban forestry plan,compliance with Section 18.520.030. (Ord.17-22§2) The project landscape architect submitted a revised Urban Forestry Plan and supplemental report that demonstrate compliance with CDC 18.520.030, including tree preservation, protection, and canopy standards. Additionally, staff reviewed the applicant's materials to confirm the proposal continues to exceed the minimum tree canopy requirements for the parking lot (30 percent, as outlined in CDC 18.320.050.D.1),and for the entire site (33 percent for the C-G Zone, as outlined in the Urban Forestry Manual). This criterion is met. 18.780 Site Development Review: 18.780.050 Minor Modifications C. Approval criteria. The approval authority shall approve or approve with conditions an application for a minor modification when all of the following are met: 1. The proposed development is in compliance with all applicable requirements of this title;and The applicant is proposing a minor modification to the site plan approved under Case No. SDR2017- 00007 for Taco Bell at 13305 SW Pacific Highway. Specifically, the applicant proposes to remove two parking spaces that were shown on the original plan,in order to accommodate a new on-site rain garden (as required by Clean Water Services Design and Construction Standards). As determined in Case No. SDR2017-00007, the minimum off-street parking requirement for the new Taco Bell restaurant is 15 spaces (7.0 spaces for every 1,000 square feet for fast food eating and drinking establishments,as outlined in CDC Table 18.310.2). Even with the proposed reduction of two parking spaces, staff finds there is adequate parking on site,with 24 spaces provided. The applicant also proposes to restripe two existing Americans with Disabilities Act(ADA) accessible parking spaces with this modification.Accordingly,the Building Official will review this proposal for compliance with all applicable ADA standards at the time of building permit submittal. The applicant also proposes a minor modification to the approved landscaping plan, in order to accommodate the new rain garden. Staff reviewed the updated landscaping plan to confirm the proposal continues to exceed the minimum landscape requirement for the C-G Zone (15 percent, as outlined in CDC Table 18.120.3),with 42 percent provided. The applicant also proposes to remove a masonry wall shown on the original plans,which was initially proposed as screening for service facilities located on the south facade of the new restaurant. The applicant submitted elevation drawings and an updated landscaping plan,which demonstrate the service facilities are not visible from a public street, customer or resident parking area,any public facility,or any residential area(CDC 18.320.050.D.2).Therefore,staff finds the masonry wall is no longer required to provide screening for these service facilities. Upon review of the applicant's plans and narrative, staff finds that all other applicable requirements are met. This criterion is met. 2. The modification is not a major modification. The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this proposal is not a major modification. This criterion is met. MMD2018-00027 and UFR2018-00007 Taco Bell 3 CONCLUSION: The proposed modifications to the site plan, landscaping plan, and Urban Forestry Plan approved under Case No. SDR2017-00007 are in compliance with the applicable requirements of this Tide. Stormwater At the time of the Type II review we had proposed two LIDA swales to manage the stormwater. After becoming aware of the extent of the CWS requirements for the site, a Rain Garden has been proposed. Parking Spaces Immediately south of the Rain Garden, two parking spaces are proposed to be removed, which was not originally shown at the time of the Type II review. This will make room for the Rain Garden as required by CWS and also compliment the regrading of the existing handicap parking spaces as required by the building department. Also, this will modify the number of parking spaces from 26 to 24, which is still much greater than the required 15. Tigard, Oregon. The intent of this report is to provide the following: • Previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification (tree "4" removal/replacement); • There is no practical alternative to the proposed modification; The previously identified existing tree labeled as "4" (Sweetgum) within the urban forestry plan to remain is now labeled to be removed. This is due to the modification to the proposed site plan placing the site water quality facility within the area of the existing Sweetgum. Due to the grading and site work needed to accomplish this site plan modification, it is my opinion the existing Sweetgum will not survive. The Sweetgum tree has vigorous surface rooting, which would compromise the tree's structural integrity if removed. With the proposed removal of Sweetgum tree and loss of canopy we propose replacing the Sweetgum with a more suitable shade tree within close proximity to where the existing Sweetgum tree is located. The revised urban forestry plan reflects the placement of the proposed replacement Zelkova tree and the revised canopy calculations. The calculations are stated below under the conclusions statement. Conclusions The recommendations above are based on the condition of the trees and potential preservation values. I believe this recommendation satisfies the City of Tigard's tree canopy cover requirements as stated in the Urban Forestry Plan - which calls for a minimum of 30% total qualifying mature canopy cover (met at 33%) and a minimum of 33% total qualifying mature canopy cover (met at 47%).
