accommodate a full range of retail, office and civic uses with a city-wide and
even regional trade area. Except where nonconforming, residential uses are
limited to single-family residences which are located on the same site as a

entertainment, automotive equipment repair and storage, mini-warehouses,

Notice is hereby given that the City of Tigard Community Development Director's designee has
APPROVED the above request, subject to a conditional of approval. The findings and conclusions on
which the decision is based are noted in Section IV.
CONDITION OF APPROVAL
THE FOLLOWING CONDITION SHALL BE SATISFIED
PRIOR TO ISSUANCE OF BUILDING PERMITS:
The applicant shall prepare a cover letter and submit it, along with any supporting documents
and/or plans that address the following requirements to the PLANNING DIVISION,ATTN:
LINA SMITH (503)718-2438 or LinaCS@tigard-or.gov.The cover letter shall clearly identify
where in the submittal the required information is found:
1. At the time of building permit submittal, the applicant shall submit a revised site plan that
demonstrates the proposed structure meets the 20-foot minimum rear yard setback
requirement.
SECTION III. BACKGROUND INFORMATION
Site Information:
The project is located at 13075 SW Pacific Highway; on the northwest side of SW Pacific Highway,
southeast of Charles F. Tigard Elementary School, and northeast of SW School Street. The 0.18-acre
development site is made up of one tax lot and contains a 1,367-square-foot commercial building,with
associated parking. In February 2015, the City of Tigard Planning Division approved the subject site for
a change of use to an eating and drinking establishment. The site is located in the General Commercial
(C-G) zone.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW:
Section 18.360.060.0 states that a Minor Modification shall be approved, approved with
conditions or denied following the Director's review and as follows:
1. The proposed development is in compliance with all applicable requirements of this
title; and
FINDING: The applicant requests a minor modification to an existing development at 13075 SW
Pacific Highway. Specifically, the applicant proposes to construct a 2,520-square-foot metal canopy
structure, which will be located at the rear of the existing 1,367-square-foot eating and drinking
establishment (Mr. Hookah). Based on the applicant's submitted site plan, staff finds the proposed
structure meets the minimum front and side yard setback requirements for the C-G zone,as outlined in
TDC Table 18.520.2. However, the rear property line abuts a residential zoning district (R-12: Medium-
Density Residential District), and is therefore subject to a 20-foot minimum rear yard setback
requirement (TDC Table 18.520.2,Footnote 8). Accordingly,a condition of approval has been included
for the applicant to revise their site plan, and demonstrate compliance with this standard at the time of
building permit submittal.

The applicant states that 600 square feet of the proposed structure will be dedicated to customer
activities; the remainder of the structure will provide weather protection for the existing on-site parking
area. The area devoted for customer activities will remove five (5) on-site compact parking spaces, and
will also increase the total off-street parking requirement for this development to 18 spaces (9.0 spaces
for every 1,000 square feet, as outlined in '1'DC Table 18.765.2). The applicant submitted
documentation of a joint parking use arrangement (1'DC 18.765.030.C) with neighboring Midas Auto
Service, located at 13055 SW Pacific Highway (WTCM 2S102BD, Tax Lot 3100). Staff reviewed this
joint parking use arrangement, along with a site plan of Tax Lot 3100, and finds there is adequate off-
street parking, with a total of 18 spaces provided: five (5) spaces remaining on the subject site, and 13
additional spaces at Midas Auto Service.
Upon review of the applicant's plans and narrative, staff finds that all other applicable requirements are
met. This criterion is met.
2. The modification is not a major modification.
FINDING: Staff finds that the changes listed in 1DC 18.360.050.B.1-11 are either satisfied or do
not apply. Therefore, the proposed development is not a major modification.This criterion is met.
CONCLUSION: The proposal is a Minor Modification of existing site development and is in
compliance with the applicable requirements of this Title.

4: TERMS: The right to use will remain in effect only so long as Landlord retains ownership
of the parking facilities and the parking facilities are used in accordance of this

5: RENTAL RATE: $200.00 per month
6: ACCESS: Tenant shall have access to parking facilities between the hours of 6:00pm
until 4:30am, 7 Days a week , 365 Days a year.

8: TENANT Tenant will be responsible for returning parking facilities to Landlord

Joint parking. owners of two or more uses,structures or parcels of land may agree to utilize
jointly the same parking and loading spaces when the peak hours of operation do not overlay
subject to the following:
1. Q: the size of the joint parking facility shall be at least as large as the number of vehicle
parking spaces required by the larger (est) use per section 18.765.070;
A: Commercial site is 1376 SF ,13 parking spaces are required by City of Tigard to
meet eating and drinking classification. the joint parking facility located at 13055 SW
pacifi Hwy in Tigard has a 14 vehicle parking spaces.
2. Q: satisfactory legal evidence shall be presented to the director in the form of deeds ,
leases or contracts to establish the joint use;
A: Joint parking Agreement is attached as Exhibit 2
3. if a joint use arrangement is subsequently terminated or if the uses change, the
requirement of this title thereafter apply to each separately.
