We will be revising the ADA construction documents to incorporate the changes recommended and discussed in our September 4th meeting. These revisions will be done in the next couple of weeks and then we will bid the revised documents. During the time that we are revising the ADA documents, two requests for permits for work on the vacant former Ernst space will be submitted, one by Forum Properties to build a demising wall and one by the contractor for Marshalls to build out approximately 30,000 square feet of space. When we apply for the permit for the ADA improvements, we will permit the entire job and complete only the amount of work required for the Landlord to meet its obligations based on the value of the above reference permits requested by Forum and Marshalls. The intent of this letter is to notify the City of the Landlord's intent to apply for ADA improvement permits and ensure that the permits for Forum and Marshalls shall not be delayed due to the delay in the application for the permit for the ADA improvements. It is our understanding that, if the Landlord cannot complete the required ADA work by the time Marshalls completes their improvements, the Certificate of Occupancy for Marshals shall not be delayed provided the ADA work required of the Landlord is in progress.
