The R-7 zoning district is designed to accommodate attached single-family homes, detached single-family homes with or without accessory residential units,at a minimum lot size of 5,000 square feet, and duplexes, at a minimum lot size of 10,000 square feet. Mobile home parks and subdivisions are also permitted outright. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.410.040. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to a condition of approval. The findings and conclusions on which the decision is based are noted in Section IV. LLA2016-00009 Manka-Nahm Lot Line Adjustment 1 CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED 1. The applicant shall record the lot line adjustment with Washington County, and submit a copy of the recorded survey map to the city within 15 days of recording to be incorporated into the record. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels are located on the north side of SW Bull Mountain Road, east of SW Alpine Crest Way, and west of SW Greenfield Drive. Parcel 1 is currently 2.84 acres in size, and is occupied by a detached, single-family dwelling with attached garage, a paved driveway, and associated landscaping. Parcel 2 is currently 0.9 acres in size,and is occupied by a detached, single-family dwelling with attached garage, an accessory structure, a paved driveway, and associated landscaping. Both parcels are flag lots that connect to SW Bull Mountain Road via a 50-foot-wide shared accessway that has a variable pavement width (between 22 to 24 feet wide). The applicant intends to develop a future subdivision on Parcel 1. Accordingly, the applicant requests this lot line adjustment to increase the net development area for Parcel 1, and separate it from existing development on Parcel 2. Both parcels are zoned Medium-Density Residential (R-7), as are adjacent properties to the north, east, and west; adjacent properties to the south are zoned R-7 and Parks and Recreation (PR). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL CRITERIA: Tigard Development Code (TDC) Section 18.410.040 contains the following criteria for approval of a Lot Line Adjustment request: Section 18.410.040 A. Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No additional parcels will be created as a result of this lot line adjustment. Parcel 1 will be 3.26 acres (approximately 142,006 square feet) in size,and Parcel 2 will be 0.48 acres (approximately 20,909 square feet) in size.Accordingly,both lots exceed the minimum lot size for the R-7 zone (5,000 square feet for each detached or attached unit, and 10,000 square feet for duplexes).This criterion is met. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Staff reviewed the applicant's narrative and submitted site plan to determine that this lot line adjustment will not result in any violations of the site development or zoning district regulations for the R-7 zone.This criterion is met. • LLA2016-00009 Manka-Nahm Lot Line Adjustment 2 3. The resulting parcels are in conformity with the dimensional standards of the zoning district,including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; The average minimum lot width for the R-7 zone is 50 feet for lots with detached units or duplexes, and 40 feet for lots with attached units. Both parcels exceed this requirement because Parcel 1 has an average lot width of approximately 289 feet, and Parcel 2 has an average lot width of approximately 105 feet.This criterion is met. b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; Both parcels are flag lots that connect to SW Bull Mountain Road via a 50-foot-wide shared accessway that has a variable pavement width (between 22 to 24 feet wide). Furthermore, both parcels exceed the minimum lot size for the R-7 zone (5,000 square feet for each detached or attached unit, and 10,000 square feet for duplexes) because Parcel 1 will be 3.26 acres (approximately 142,006 square feet) in size, and Parcel 2 will be 0.48 acres (approximately 20,909 square feet) in size. These lot size calculations are exclusive of the shared flag pole area.This criterion is met. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and Both parcels are flag lots that connect to SW Bull Mountain Road via a 50-foot-wide shared accessway that is legally recorded. This criterion is met. d. Setbacks shall be as required by the applicable zoning district. Setbacks are addressed below,in Section 18.410.040.A.4.a. This criterion is met. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. Both parcels are flag lots that connect to SW Bull Mountain Road via a 50-foot-wide shared accessway. The applicant is not proposing any development on Parcel 1 at this time. However, the proposed size and configuration of Parcel 1 does not preclude a development meeting setbacks for the R-7 zone, and the standard outlined above. Parcel 2 is currently occupied by a detached, single-family dwelling with attached garage, and an accessory structure; the accessory structure does not meet the 10-foot side yard setback standard outlined above. However, Parcel 2 is an existing flag lot that was lawfully created. Therefore, staff concludes existing buildings or structures located on Parcel 2 are not subject to the minimum 10-foot side yard setback for flag lots. However, new development will be subject the setback standards outlined in'IDC 18.730.050.F. and 18.410.040.A.4.a.This criterion is met. b. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The applicant is not proposing any modifications to the existing shared accessway and paved drive. Therefore, this standard does not apply. LLA2016-00009 Manka-Nahm Lot Line Adjustment 3 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. The applicant is not proposing any modifications to the existing shared accessway. In addition, fire hydrants are already in place. This criterion is met. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. The applicant is not proposing any modifications to the existing shared accessway. In addition, there is already a legally recorded access easement in place.This criterion is met. 7. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. Both parcels are flag lots that connect to SW Bull Mountain Road via a 50-foot-wide shared accessway that has a variable pavement width (between 22 to 24 feet wide).This criterion is met. FINDING: Based on the analysis above, staff finds the approval criteria for Lot Line Adjustments are either met, satisfied through conditions of approval, or do not apply. The proposal is in compliance with the requirements of this Title. SECTION V. Approval criteria. The director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment,and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district. Following approval of the LLA,Tax Lot 2200 will be 3.26 acres and Tax Lot 2600 will be 0.48 acres. Both proposed Tax Lots will exceed the minimum lot size requirements in the City of Tigard R-7 Zoning District. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district. Following approval of the LLA,the setbacks for the existing houses will exceed the minimum front, side and rear lot lines as outlined in the R-7 Zoning District. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; The lot width requirements will exceed the minimum lot width requirements of the R-7 Zoning District. b. The lot area shall be as required by the applicable zoning district.In the case of a flag lot,the accessway may not be included in the lot area calculation; Following approval of the LLA,Tax Lot 2200 will be 3.26 acres and Tax Lot 2600 will be 0.48 acres. Both proposed Tax Lots will exceed the minimum lot size requirements in the City of Tigard R-7 Zoning District. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement;and The proposed LLA will have no impact on the existing frontages along SW Bull Mt. Following approval of the LLA,the setbacks for the existing houses will exceed the minimum front, side and rear lot lines as outlined in the R-7 Zoning District. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard,provided that no side yard is less than 10 feet.Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within 10 feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. N/A 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. He proposed LLA will have no impact on firefighting capabilities that currently exists. Future redevelopment of Tax Lot 2200 will include the addition of fire hydrants that will have a positive effect on firefighting capabilities in the immediate area. 6. Where a common drive is to be provided to serve more than one lot,a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. Any accessway shall comply with the standards set forth in Chapter 18.705,Access,Egress,and Circulation. B. Exemptions from dedications.
