APPLICATION SUMMARY FILE NAME: Bank of America CASE NO.: Minor Modification(MMD) MMD2016-00035 PROPOSAL: The applicant is proposing a minor modification to an existing development at 12160 SW Scholls Ferry Road. Specifically, the applicant proposes to install an approximately 74-square-foot automated teller machine (ATM) kiosk, and to reconfigure and expand an on-site pedestrian walkway for compliance with the Americans with Disabilities Act (ADA). As a result of this proposal, 320 square feet of on-site landscaping and two (2)parking lot trees will be removed. The C-G zoning district is designed to accommodate a full range of retail, office and civic uses with a city-wide and even regional trade area. Except where nonconforming, residential uses are limited to single-family residences which are located on the same site as a permitted use. A wide range of uses, including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses, utilities, heliports, medical centers, major event entertainment, and gasoline stations, are permitted conditionally. The site is also located within a Planned Development. APPLICABLE REVIEW CRITERIA: Tigard Community Development Code (TCDC) Section 18.360.060.0 MMD2016-00035 Bank of America ATM Kiosk 1 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request, subject to a condition of approval. The findings and conclusions on which the decision is based are noted in Section IV. CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED: 1. Prior to issuance of site and building permits,the applicant shall obtain a tree removal permit. The tree removal permit shall include a requirement to replant the two (2) parking lot trees. THIS APPROVAL SHALL BE VALID UNTIL JULY 10,2018, WHICH IS 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION SECTION III. BACKGROUND INFORMATION Site Information: The project is located at 12160 SW Scholls Ferry Road; south of SW Scholls Ferry Road, west of SW 121St Avenue and east of SW North Dakota Street. The subject property is an approximately 11-acre shopping center that is made up of three parcels and contains four commercial buildings, landscaping, and associated parking. The site is zoned General Commercial (C-G). In 1998, the City of Tigard Planning Division approved this site as a Planned Development for the construction of a 3,050-square- foot fast-food eating and drinking establishment with drive-in service (Case No. PDR1998-00012). The project was also approved for a reduction to the drive-in stacking lane requirement from 200 feet to 160 feet. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: TCDC Section 18.360.060.0 states that a Minor Modification shall be approved, approved with conditions or denied following the Director's review and as follows: 1. The proposed development is in compliance with all applicable requirements of this title; and FINDING: The applicant is proposing a minor modification to an existing development at 12160 SW Scholls Ferry Road. Specifically,the applicant proposes to: a. Install an approximately 74-square-foot ATM kiosk. Staff reviewed the applicant's elevation drawings and site plan to confirm that the proposed ATM kiosk meets the development standards for the C-G zone,including minimum setback requirements. b. Reconfigure and expand an on-site pedestrian walkway for ADA compliance. The redesigned walkway will begin at the proposed ATM kiosk, travel south and east around the existing commercial building, and then extend across a drive aisle to connect to SW 121St Avenue. The walkway will also incorporate handrails, ramps, and curbs that comply with ADA standards. Staff reviewed the applicant's construction drawings and site plan to determine that this proposal meets the on-site pedestrian walkway standards for location, design, and pedestrian MMD2016-00035 Bank of America ATM Kiosk 2 safety,as outlined in IDC 18.705.030.F. c. Remove 320 square feet of on-site landscaping, in order to accommodate the expanded on-site pedestrian walkway. Staff reviewed the applicant's narrative and site plan to confirm that the site continues to exceed the 15% minimum landscape requirement for the C-G zone, even after the proposed 320-square-foot landscaping reduction. d. Remove two (2) two-inch caliper parking lot trees, in order to accommodate the expanded on- site pedestrian walkway. In lieu of providing updated tree canopy calculations, the applicant proposes to replace the trees by planting two (2) trees of a similar size and species, in order to ensure that there is no change to the existing parking lot tree canopy coverage. In addition, staff has included a condition of approval that requires the applicant to obtain a permit for the removal and replacement of the trees,prior to issuance of site and building permits. Upon review of the applicant's plans and narrative against all relevant development standards, which are summarized above, staff finds that all applicable requirements are met. This criterion is met. 2. The modification is not a major modification. FINDING: Staff finds that the changes listed in TCDC 18.360.050.B.1-11 are either satisfied or do not apply.Therefore, the proposed development is not a major modification and shall be processed as a minor modification as defined in TCDC 18.360.060.A.This criterion is met. CONCLUSION: The proposal is a Minor Modification of existing site development and is in compliance with the applicable requirements of the TCDC,which is Title 18 of the Tigard Municipal Code.
