APPLICATION SUMMARY FILE NAME: Starbucks CASE NO.: Minor Modification (MMD) MMD2018-00017 PROPOSAL: The applicant is proposing a minor modification for an existing Starbucks at 13560 SW Pacific Highway. Specifically, the applicant proposes to: relocate the existing drive-in window,and to modify its design by adding a new bump out and new metal canopy; to remove and replace existing screening walls, located adjacent to the building's western façade;and to modify the gate on an existing trash enclosure.The applicant also proposes minor updates to the existing on-site parking lot, such as repairing damaged asphalt or concrete areas,and clearly marking interior drives and access aisles. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request, subject to a conditional of approval. The findings and conclusions on which the decision is based are noted in Section IV. CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED PRIOR TO ISSUANCE OF BUILDING PERMITS: The applicant shall prepare a cover letter and submit it, along with any supporting documents and/or plans that address the following requirements to the PLANNING DIVISION,ATTN: LINA SMITH (503)718-2438 or LinaCS@tigard-or.gov.The cover letter shall clearly identify where in the submittal the required information is found: 1. Prior to issuance of building permits,the applicant shall submit documentation of approval from the franchised hauler,Pride Disposal, for the modified trash enclosure gate. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located at 13560 SW Pacific Highway; on the southeast side of SW Pacific Highway, and north of SW McDonald Street. The subject building is occupied by an existing fast food eating and drinking establishment (Starbucks), and is part of the Tigard Marketplace shopping center. The 11.69- acre shopping center contains multiple commercial buildings, 632 parking spaces, and associated landscaping.The property is zoned General Commercial (C-G). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.780 Site Development Review: 18.780.050 Minor Modifications C. Approval criteria. The approval authority shall approve or approve with conditions an application for a minor modification when all of the following are met: 1. The proposed development is in compliance with all applicable requirements of this title;and The applicant is proposing a minor modification for an existing Starbucks at 13560 SW Pacific Highway. Specifically, the applicant proposes to: • Relocate the existing drive-in window,and modify its design by adding a new bump out and new metal canopy. Staff reviewed the applicant's submitted site plan and elevation drawing to confirm these modifications comply with all applicable development standards for the C-G zone, as outlined in CDC Table 18.120.3. • Remove and replace existing screening walls, located adjacent to the building's western facade. Currently,these walls provide screening for existing refuse containers,so they are not visible from MMD2018-00017 Starbucks 2 the adjacent public street or parking lot. Staff reviewed the applicant's submitted detail drawings to confirm the replacement walls meet the applicable screening standards in CDC 18.320.050.D. • Modify the gate on an existing trash enclosure. This property is currently served by Pride Disposal. Accordingly, staff has included a condition for the applicant to submit documentation of approval from Pride Disposal for the modified gate, prior to issuance of building permits. • Make minor updates to the existing on-site parking lot, such as repairing damaged asphalt or concrete areas,and clearly marking interior drives and access aisles. Staff reviewed the applicant's site plan to confirm these modifications comply with all applicable parking lot surfacing and striping standards in CDC 18.310.040. Upon review of the applicant's plans and narrative, staff finds that all other applicable requirements are met. This criterion is met. 2. The modification is not a major modification. The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this proposal is not a major modification.This criterion is met. CONCLUSION: The proposal is a minor modification an existing development and is in compliance with the applicable requirements of this Tide. SECTION V. After talking to our client, we will not have any work done to the trash enclosure. All reference to the replacement of the trash enclosure gate have been removed from our plans.The existing trash enclosure will remain as is. I believe the scope of work on the Minor Mod will need to be revised accordingly too (?). We would like to proceed with the building permits submittal by the end of this week.
