STATUTORY WARRANTY DEED
The CITY OF LAKE OSWEGO, an Oregon municipal corporation, Grantor, conveys and warrants to the CITY
OF TIGARD, an Oregon municipal corporation, Grantee, an undivided 18/38ths interest in the following-
described real property("Real Property"), it being the Grantor's intention to create a tenancy in common
between itself and Grantee,with Grantor retaining an undivided 20/38ths interest,and Grantee having an
undivided 18/38ths interest,free of encumbrances except as specifically set forth herein:
Certain real property situated in Clackamas County,Oregon,as more fully described in the
attached Exhibits 1 through 3,and incorporated herein by reference.
Restriction on Use and Assignment
1. The use of the property and the parties' rights therein are subject to the terms and conditions
of the Intergovernmental Agreement Regarding Water Supply Facilities, Design, Construction and
Operation entered into between the parties on August 6, 2008, as amended to date, and as may be
amended by the parties in the future(the"IGA"), as well as any future agreement between the parties
relating to the Easements.
2 Neither Grantor nor Grantee may seek or obtain a partition of the property or may sell,transfer
or assign its undivided interest, in part or whole, in the property without the other party's prior written
consent, and in compliance with the terms and provisions of the IGA, or any future agreement between
the parties.
3. These restrictions shall run with the property and inure to the benefit of and be binding upon all
parties having or acquiring any right,title, interest or estate therein.

65855 via a Final Judgment dated July 6, 1967, and recorded at Book 173, Page 900, Clackamas County
Deed Records, and described in said Judgment as follows:
A parcel of land in Section 20,Township 2 South, Range 2 East,Willamette Meridian, Clackamas County,
Oregon, being a part of that tract conveyed by deed to the City of Gladstone, Oregon, recorded in
Volume 121, page 206 and 207, Deed Records, Clackamas County, Oregon, said parcel being more
particularly described as follows:
Beginning at the intersection of the southerly projection of the easterly right of way line of Portland
Avenue and the southerly right of way line of Clackamas Boulevard;thence northeasterly along said
right of way line of Clackamas Boulevard to a point 120.0 feet from the said easterly right of way line of
Portland Avenue measured perpendicularly to said right of way line of Portland Avenue;thence
southeasterly parallel to said easterly right of way line of Portland Avenue to the low water line of the
Clackamas River;thence southwesterly along the low water line of the Clackamas River to the said
southerly projection of the easterly right of way line of Portland Avenue;thence northwesterly along
said projected right of way line of Portland Avenue to the point of beginning.
