Y3- 31 RESOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENTS CONSTRUCTED WITHIN HAMBACK PARK SUBDIVISION AND AUTHORIZING RELEASE OF THE MAINTENANCE BOND THEREFOR. WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to install streets, sidewalks, streetlights, storm sewers, sanitary sewers, underground utilities and other public facilities for the development of sub- division; and WHEREAS, the City further required the payment of fees and the execution of a Compliance Agreement which stipulates that: "Upon receipt of certification by the Department of Public Works that all requirements have been met and a One Year Maintenance Bond, the City Council agrees to accept the public improvements, subject to the requiremeots for correction of deficiencies and maintenance for a period of one year . . ;" and WHEREAS, said Certification has now been received; and WHEREAS, an acceptable Maintenance Bond has been in effect for the afor- said maintenance period; and WHEREAS, all deficiencies hav;: now been corrected, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby accel)t.s the public improvements constructed within Hamback Park Subdivision, said subdivision being recorded in Book 48 on Page 48 in Washington County, Oregon, Plat Records. The portions rernain '.ng i,nfinished are : Completion of sidewalks and driveway aprons, These improvements were either specifically referred to in the original subdivision application or compliance agreement, scheduled for completion under bond during the one-year maintenance agreement or were found by the City of Tigard to be defective in materials or workmanship during the one-year maintenance period. Please provide a written explanation on the enclosed form of the project' s status and a time line for completion of the needed improvements. The City of Tigard is willing to grant a maximum of 60 days from the date of this letter for completion, in view of the substantial delay that has already occurred in violation of the subdivision compliance agreement, one-year maintenance agreement, or both. It was approved by the City Council on June 1.2, 1972 and became effective July 13, 1972. In that construction has not begun on the project and the zoning will expire on July 13 the Plantaing Commission reviewed the district in a public hearing as required by the zoning ordinance. The applicant testified at a Planning Commission hearing on June 19, 1973 that the project has rust begun because his lender rejected the concept of a homeowners a�.sociatinn maintaining a park located in the center of the applicant's i proposed projec* , It was the lender'sjudgement that the + association would not be large enough to adequately maintain the park. Mr. Lindquist has therefore requested the City to accept the park as part of their public recreation system.
