Please be advised that the Tigard Planning Commission at tneir regular meet-
ing of May 15, 1979, approved your request for the proposed addition to the
Home Improvement Center subject to the following conditions.
1. That tree: '.long Pacific Highway be placed 3E feet on center.
2. That the landscape island on the south side of the main entrance
be enlarged, while still retaining the right turn lane as pro-
posed by the applicant.
3. That a provision for maintance of the landscape areas be made.
4. That the applicant agree to allow the installation of a bus
shelter on the eastern most corner of their property fronting
Pacific Highway
5 . That left turns from the complex at the southwest exit onto the
highway be prohibited.
6. That the applicant apply for and receive a zone change on the F-7
lots within the conplex before building permits are issued.

Howard described there zone changes as a housekeeping measure , then read
the STAFF REPORT. There was no PUBLIC TESTIMONY. Howard then read the STAFF
RE COMMEN DATI ON.
Commission Discussion : Wood MOVED and Speaker seconded approval of Zone
Changes ZC 15-79, ZC 16-79, ZC-17-79, and ZC 18-79 based on the Staff Report
and Recommendation. Speaker asked for a map identification of certain tax lots
not so labelled in the reproduced maps supplied, responded to by Staff. He
then questioned the cost, if any, to the City by reason of the development of
these parcels to County standards, which do not include sidewalks and subsurface
drainage. Staff responded that the cost of such improvements would not be borne
by the City. Smith inquired whether any of these parcels might fall within
sensitive lands. Howard replied this had been considered, but that none so
qualified. Thereupon the motion passed unanimously.
5.2 CPR 2-79 (The Robert Randall Co.) NPO #5
A request by the Robert Randall Co. to amend Neighborhood Pian-

Selby indicated on the wall map and an aerial view of the area the
location of the property, the present streets, surrounding land uses, general
topography, development now taking place, and the proposals for the intersec-
tion of the spine road with Bonita Road. He reported that Bonita is now carry-
ing ar.vroximately 200 per cent of the traffic which its present condition
warrants. He pointed out that the original NPO Plan had the spine road connect
with Bonita through property that is currently being intensely developed. With
the approval of the President he then outlined the location mandated by the City
Council, which is the Staff's recommendation, and the reasons therefor: (1)
Bonita Road is already overloaded; (2) the most efficient entrance into an arterial
is opposite another road; (3) the continuation of the spine road to Bonita as pro-
posed by the applicant is obviously several years away, since the owners of the
property over which it would pass have no intention of selling, thus enforcing
use of a temporary entrance onto Bonita for an unduly prolonged period; (4) he cal-
led attention to the mandate of the NPO #5 that development should not take place
until public facilities are adequate to handle the burden imposed by development.
Wood summarized the options discussed, to which Selby added as a possibility
the realignment of 79th in order to make it meet the spine road somewhere else.
The north end of 79th is currently vacant on both sides of its intersection with
Bonita.
• Spencer Vail, Planning Consultant, 4610 S.W. Belmont, Portland, gave the
APPLICANT'S PRESENTATION on behalf of Robert Randall Company. He reported that
on April 5 there was a meeting with NPO 5 at which no objection to the applicant's
concept was voiced. He dicuased a meeting in February with the City Engineering
staff at which it was brought out a Tee intersection is acceptable to the City if
it is at least 150 feet away from another intersection. He stepped to the wall
maps and explained various alternatives, giving developers' approach to each. He
outlined the Randall Company's request on the map.
Wood questioned the timing of the extension of the spine road to Bonita

• under the applicant's proposal. In extended discussion Vail did not give a
direct answer, but felt the Randall concept tied in with the improvement of
Bonita some years hence.
Selby responded that the two parcels over which the Randall proposal for
the sptne road would pass are not owned, as Mr. Vail ii.ferred, by developers; at
the present time they are owned, as Mr. Vail inferred, by developers; at the pre-

sent time they are owned simply by landowners. Secondly, the NPO #5 meeting to
which Mr. bail referred was attended by only one man, who lives near the south
end of the NPO, and he had little interest in the details of development along
Bonita.

Road, owner of all the property over which the various alternative of the spine
road as proposed would pass. She objected on the grounds of destruction of large
fir trees; leaving her with unbuil.dabie land in the floodplain should she desire
to develop in the future; adverse topography for an entrance onto Bon .ta. Besides,
she does not want to sell.
Lawrence Weaver, same address, described the topography, which mades the
applicant's and the City's proposal for entrance to Bonita impractical. He sug-
gested a road through the applicant's own property would give good access, with
excellent visibility.
The President called for the Staff Recommendation, even though the Staff
Report had not been formally presented; it had, he felt, been adequately covered
in the preceding discussion. Howard read the STAFF RECOMMENDATION for denial of
the applicant's request.
In REBUTTAL Mr. Vail characterized his proposal as the most realis`_ice
approach to the problem.
COMMISSION DISCUSSION: Speaker asked why the spine road should not go
through the east side of the applicant's property. Mr. Vail stated that would
result in an intersection less than 100 feet away from 79th, which would be un-
acceptable from the City's standpoint, and would make the radius of the spine road
too tight. There followed extensive discussion among Wood, Vail, Selby and Smith
on turning radius• and entrance to Bonita, including the possibility of realigning
the 79th Street entrance to meet the spine road. Smith suggested a ale off the
spine road to serve areas to the east.
Kolleas MOVED for denial, based on the Staff Findings and Staff Recommenda-
tions. Speaker seconded. Wood summarized reasons for denial of the proposal as
submitted by the applicant--the only proposal on which the Commission properly
could act. The motion for denial passed unanimously.
I 7, 3 and 5.4 were withdrawn and removed from the agenda.
5.5 NC ' 1-79 Fred Meyers Home Improvement Center NPO 44

The APPLICANT'S PRESENTATION was given by Norman Krause of Jensen, Krause
and Schoenleber, Architects and Planners, of Portland. H'>_ approached directly
the Staff Recommendations :
1. He advocated trees be placed 35 feet on center instead of 25 feet as
recommended.
2. He agreed the landscape island on the south side of the main entrance
might well be enlarged, but he urged retention of the more southerly
right turn route through the island, stating this scheme works well
in other complexes of the company.
3. Maintenance cf the landscaping would be accomplished through a land-
scape maintenance company.
4. He saw no problem with the bus shelter at 71st Avenue and Pacific High-
way.
5. He stated the ingress-egress at the southwest corner is shared with
a filling station. He felt prohibition of left turns from the parking
area would be logical, but that left turns into the complex were rela-
tively nonhazardous because of the platoon effect of the light at the
main entrance. He felt to prevent lefthand turns into the complex would
be very hard to control, and could work a hardship on the service station.
PUBLIC TESTIMONY in opposition was presented by Helen Schubert, 7303 S.W.
• Spruce Street, who raised the question of why a parcel zoned R-7 should be used
for parking and commercial uses; there is no screening, as called for by Code, for
residential areas; the intersection at 72nd and Spruce Street is the site of numer-
•
ous near-accidents; employees in the complex park on residential streets rather
than on-site, and block access to mailboxes, contrary to postal regulations.
The STAFF RECOMMENDATION was read by Howard. At the President's request
he addrssed the objections raised by Mrs. Schubert: the screening will be handl-
1 ed in site design review; the parking in R-7 zone can be corrected through a zone
change; one stop sign may be placed at th.a intersection of 72nd and Spruce, but
the property to the north is in the County, and the City has experienced difficul-
ty in working with them on such situations, but the City will try; employee park-
,
� ing spaces be designated for employees only; and the postal people and possibly
• the police will check on the obstruction of access to mailboxes.
COMMISSION DISCUSSION; Smith raised the R-7 zcning issue : that Fred
Meyer is essentially using residential land for parking purposes. He also
objected to the 7 per cent landscaping versus 15 per cent called for by present
ordinances, stating that if parking in accordance with present code would reduce

parking to an inadequate level, the property is overdeveloped. Bonn proposed
prohibiting left turns from the complex at the southwest exit, and suggested more
landscaping to relieve somewhat "the sea of asphalt". Funk believed the right-
hand turn at the main entrance should be permitted, contrary to Staff Recommenda-
tion 2. Speaker favored this being permitted, but suggested the landscape island
he enlarged in a rectangle rather than a triangle. He expressed dismay that 60.2%
of the site is covered with asphalt for parking, but recognized at times all of
it is needed.
On being asked by the President, Smith declined to make a motion, since the
only one he would make would be for denial, which he felt would not be seriously
considered. Bonn then MOVED for approval of NC 1-79 based on Staff Findings and
Recommendations, but with changes in the Recommendations as follows :

1. That trees along Pacific Highway be placed 35 feet on center.

be enlarged, while still retaining the right turn lane as proposed
by the applicant.

A request by the Summerfield Homeowners Association for a vacation NPO #6
of common area to divide equally between the adjacent property
owners of tax lots 7600 (Lrot 581) , 10101 (Lot 556) , 10200 (Lot 555)
and 9400 (Lot 582).. The to common areas are 10 ft wide each and
are 52.42 and 69. 10 feet long (Wash. Co. Tax Map 2S1 11DC, tract 2) .
Howard read the STAFF REPORT. John Adams of Tualatin Development Company
made the APPLICANT'S PRESENTATION. He explained that the original layout did
not show these ten-foot accesses to the golf course fairway; that through a
mistake they were included in the layout on the ground; that Tualatin Develop-
ment Company currently holds title to them, never having deeded them with other
property to the Summerfield Civic Association; and that it war: now their desire

to give deeds for these two parcels to the four adjoining property owners.
There was no PUBLIC TESTIMONY. Howard stated the STAFF RECOMMENDS approval.
COMMISSION DISCUSSION AND ACTION: Wood MOVED for approval based on Staff
Findings and Recommendation. seconded by Kolleas. Several clarifications were
made on questioning by Speaker: that the applicant is property Tualatin Develop-
ment Company rather than the Summerfield Civic Association (listed in Staff Re-
port
e-port as Summerfield Conference Association) ; that the request is not to divide
these parcels equally between the adjacent property owners, as stated; and that
it was the Board of Directors of Summerfield Civic Association rather than the
"Homeowners Association in Summerfield" which voted to vacate these parcels.
Speaker also asked if it would be practical for TDC to restore corner stakes, which
apparently were destoryed in the construction process. It was agreed this would
require a survey, which is not inexpensive, and would be of no benefit to TDC. Mr.
Adams pointed out that the description of the deeded parcels would he by metes and
bounds, which should be adequate for practical purpuses, now that the property is
fully developed. After some further clarification of various points the motion
passed unanimously.
5.7 ZONE CHANGE ZC 14-79 (Dr. Alva Roberts & Lee Cunningham) NPO #7
A request by Dr. Alva Roberts and Mr. Lee Cunningham for a zone
map amendment from Wash. Co. RS-1 to City of Tigard C-P "Com-
mercial-Professional" on a 1.38 acre parcel, located at 12530
S.W. Scholls Ferry Road. (Wash. Co. Tax Map lSl 33AD, Tax Lot 2400) .
Howard read the STAFF REPORT. Alva L. Roberts, Jr. , D.V.M. , in his
APPLICANT'S PRESENTATION gave the background of the request (this action is in
the nature of unfinished business) . Howard read the STAFF RECOMMENDATIONS.
COMMISSION DISCUSSION: The only question raised concerned the sewer
situation, which was answered by Staff. Thereupon Wood MOVED for approval of
ZC 14-79 based on Staff Findings and Recommendations. The motion was seconded
by Kolleas and passed unanimously.
Under OLD BUSINESS the President stated he had written a letter to individ-
uals and agencies concerning the authority for Unified Sewerage Agency to construct
sewers, pump stations, etc. , in the floodplain. He believes even public agencies
should come before the Commission for permission. He called attention to a sewer
pipe on the Fowler School grounds across Summer Creek, laid in such ,a manner that
the pipe is about a foot above the bottom of the creek and at right angle to the
creek bed. Examples of poor workmanship on the part of USA were cited. Legal
aspects were explored without resolution, the question being whether USA is sub-
ject to the Tigard Municipal Code. The President urged an opinion on this be
secured from the City Attorney. Howard agreed one would be requested by Staff.

Howard reported that a suit has been filed against the City and the
developer or, the decision of the Site Design Review Board not to allow the move-
ment of the recreation building from the interior to the perimeter of the
project. He reported on the action at the City Council on the We.y Lee-Hi Hat
Restaurant access-parking situation and the possibility of a suit against the
City on that matter.
The draft Sensitive Lands Ordinance was discussed. Howard explained
corrections of typographical errors to be made and relocations he had made,
and additions required because of inadvertently omitted material.
Wood and Howard worked out a slight modification of the density provisions
of the draft Planned Development ordinance. It was agreed the draft Sensitive
Lands and Planned Development ordinances as discussed should be sent to the City
Council as the recommendation of the Planning Commission to the Council.
Smith inquired what happened to the smaller-lot ordinance at the city
Council, responded to by Howard and discussed in some depth among the Commissioners.
NEW BUSINESS: The matter of the timing of the reading by Staff of the
Staff. Recommendations was brought up by Wood. It was the consensus ,that unless
there where circumstances which wuld make the procedure appear unwise in a par-
ticular situation, Staff would read the Recommendations immediately following
the Staff Findings and before the applicant made his presentation.
The President declared the meeting adjourned at 10:20 p.m.

Request: For planning Commission authorization for a proposed addition to
the Home Improvement Center.
Previous Action: The subject site was annexed to the City in three parcels.
The first parcel was annexed by the City Council on January
10, 1966, and consisted of lots 101, 100, 200, 300, 400, on
Tax Map 1S1 36DB and lot 3401 on Tax Map 1S1 36AC. The
second parcel was annexed on Dec. 16, 1966, consisting of
lot 3401 on tax map 1S1 36AC. The third parcel was approved
annexated on July 21, 1970 consisting of tax lots 3500 and
3600 tax map 1S1 36AC. On March 16, 1966, Council approved
a zone change to C-2 general commercial for tax lots 100,
101, 200, 300, 400 tax map 1S1 36DB on February 13, 1967
Council approved on zone change to C-2 general Commercial
for tax lot 3400 tax map lSl 36AC.
The 1966 zone change was prior to the development of the
shopping complex and was approved in order to facilitate
that development. The 1967 zone change provided for the
development of a garden shop. (note ord. .70-32 repealed
sections of Ord. G7-21 changing C-2 areas to C-3)
According to our records the Fred Meyer Complex was develop-
ed under City of Tigard ordinances in effect at that time.
The complex currently exists as a non-conforming use as it
does not conform to the requirements of the zone in which
it is located. (Sec. 19.03.410) The shopping Center is
located in an C�3 Zone with some of the parking located in
an R-7 zone (tax lot 3500 & 3600 tax map1 6AC)
8.28.060 Additional requirements: Additional requirements applicable to the
C-3 zone include but they are not limited to the following:
1. Off street parking and loading, see chapter 18.60;
2. Access and egress, see chapter 18.64.

3. Landscaping. A minimum of fifteen percent of the total lot area
shall be landscaped; in addition, see chapters 18.59 , site develop-
ment plan, architectural design review;
4. Enclosure and screening required, see section 18.12.080;
The Fred Meyer complex specifically does not conform to the following
requirements: (see Section 18.59.060)
(A) . . .provide a minimum onsite landscape area of ten percent in
accordance with the following formula:
Commercial zones front ten (10) feet
(i) All areas not occupied by paved roadways or walkways shall be
landscaped and maintained.
(ii) Tyree and shrub plantings a minimum of eight in width within park-
ing areas shall be provided and maintained at approximately seventy
feet on center each way or an aggregate amount.
(iii) A minimum five foot landscape strip along any lot boundary upon
which a yard is required.
(iv) All off street parking and loading areas shall he effectively
screened from view upon the public right-of-way.
18.60.100 Landscapinc, screening requirements:
Required off street parking shall be allowed in any yard setback, not
required by Chapter 18,59 or any other landscaping requirement of this code;
provided, that the first two feet in from the property line are maintained in
landscaping; and provided, that any common boundary along which this parking
is allowed between a residential zone and any other zone is screened by a
fence obscuring the sight of normal adjacent pedestrian and vehicular traffic,
the erection of which shall be the responsibility of the ownership in the non-
residential zone.
The applicant is proposing two additions to the existing Home Improve-
ment Center. One on the south building face will consist of 4500 sq ft of cover-
ed area and other 4000 sqft of open court area enclosed but no covered plus a
loading dock on the eastern end of the building face. On the west face of the
Horne Improvement Center the applicant is proposing to cover and extents the exist-
ing outside storage area. The new roof line would extend 20' beyond the exist-
ing wall and the proposed wall would be 12' beyond the existing enclosure.

The existing landscaping covers 36 ,790 square feet of the total site area
with and additional 3290 square feet of landscaping proposed. The per centage
of landscaping on the site is approximately 7% including the proposed addition.
To bring the landscaping up to 15% of the total site area an additional
44,505 square feet of landscaping would be necessary.
Considering the extent of the proposed additions staff feels it is un-
reasonable to require full comfor:mance with the zoning ordinance at this time.
However, we do feel that the applicant could provide additional landscaping
on the site. Beyond the proposed landscaping around the HIC the applicant has
allowed for the addition of street trees placed 50' on center frontinPacific
Highway and two additional landscape islands near present site entrances. No
provision for maintainance as been mentioned.
Staff Receommendations: Staff recommends approval of the applicants request

Proposed Expansion of the Fred Meyer Home Improvement Center
The following is a brief description of the proposed project and its
anticipated affect on the community:
The proposal is to expand the Home Improvement Center at the Fred Meyer
Retail Storc Complex, located at 11565 S.W. Pacific Highway.
The proposed change would r'on,;ist of four (4) areas of work; interior
remodeling, construction of a new Outdoor Garden Retail Sales Area,
enclosing and enlarging the existing outside screepeki area, and providing
additional landscaping at various impact points throughout the Complex.
The interior work would consist of moving non-structural walls, upgrading
finishes and adjusting department functions .
The Outdoor Garden Retail rpace would consist of adding a depressed,
well screened and landscaped Retail Area of approximately 10, 000 gq. ft. ,
partially covered, on the upper front end of the building (Southeast
corner. ) In conjunction with this and uLrectly behind would be a
depressed, screened, truck service dock.
The existing Outdoor Storage Area on the lower end (West end) would be
increased by only about 800 sq. ft. and s,.ould be entirely enclosed,
relating to the existing structure in appea•zance .
The landscaping is directed at the area of new construction and at the
fron ..d main entrance of the Complex off Pacific Highway. This would
consist of a major additional planting island at the main entry drive
to define the traffic pattern and to enhance the area by adding trees
along the total highway frontage to soften and screen the Complex.
This Addition and Alteration is badly needed to make available, in a
more pleasant atmosphere, for the Shopper, the merchandise in demand.
As you may know, at certain seasons, especially during the growing season,
the oresent Garden Sales Area is inadequate in space and thus display
spills over into the Outside Parking Area. It also congests the Food
Parcel Pick-up function. Relocating the Garden Sales : n a new, controlled
area will solve this problem. Also, enclosing the existing screened
Outdoor Storage Area will allow better control for this area which often
times is in need of policing. At the suggestion of the Planning Staff,

approval is granted to locate a Tri-Met Bus Shelter at the corner of
S.W. 71st Avenue and Pacific Highway by Tri-Mat.
We feel these changes will meet the public need, not only by being
more convenient, but also as a continual effort to up-grade the facility
and to make it more compatible with the community.
Because of the nature of the proposal, there is no major impact on
public services . This change will be served by existing facilities.
• In summary, this change in relation to the overall. Complex is minor.
• It will have no adverse effect on the surrounding area; in fact, by
upgrading the existing building and services and providing additional
landscaping at the Pacific Highway frontage, we feel it will be an
asset to the community; we hope you will, too, and request Planning
Commission approval.
