APPLICATION SUMMARY FILE NAME: Din Tai Fung CASE NO.: Minor Modification(MMD) MMD2018-00020 PROPOSAL: The applicant is proposing a change of use to a tenant space at 9724 SW Washington Square Road, Suite F07. The 9,232-square-foot tenant space will be changing from a sales-oriented retail use to an eating and drinking establishment,Din Tai Fung. The MUC zone includes land around the Washington Square Mall and land immediately west of Highway 217.Primary uses permitted include office buildings, retail, and service uses. Also permitted are mixed-use developments and housing at densities of 50 units per acre. Larger buildings are encouraged in this area with parking under, behind or to the sides of buildings. In addition to the standards of this chapter,development within this zone is subject to the standards of Chapter 18.670. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.780.050.0 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. MMD2018-00020 Din Tai Fung 1 THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located inside Washington Square Mall;south of SW Hall Boulevard,east of Highway 217, and west of SW Greenburg Road. The property is located on a 46.24-acre tax lot (WCTM 1S126, Tax Lot 300), and is part of the larger Washington Square shopping center. The property is located in the Mixed Use Commercial (MUC) Zone, and the Washington Square Regional Center Plan District. In November 2017, the City of Tigard Planning Division approved a lot line adjustment (Case No. LLA2017-00010) between two properties that are currently part of the Washington Square shopping center: WCTM 1S135BA, Tax Lots 100 and 101. At the time of this application, Case No. LLA2017- 00010 has not yet been recorded with Washington County.Additionally,in April 2018,the City of Tigard Planning Division approved an approximately 64,000-square-foot automobile dealership with accessory uses on Tax Lot 101 (Case No. SDR2017-00005). At the time of this application, building permits have been submitted but not issued for this project. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.780 Site Development Review: 18.780.050 Minor Modifications C. Approval criteria. The approval authority shall approve or approve with conditions an application for a minor modification when all of the following are met: 1. The proposed development is in compliance with all applicable requirements of this title; and Because the applicant has only proposed a change of use, which primarily affects off-street parking regulations, that is the main focus of this review. The 9,232-square-foot tenant space will be changing from a sales-oriented retail use to an eating and drinking establishment. Based on off-street vehicle parking calculations (CDC Table 18.310.2), the existing use requires 28 parking spaces (3.0/1,000 square feet for sales-oriented retail), whereas the proposed use requires 83 parking spaces (9.0/1,000 square feet for an eating and drinking establishment). Accordingly, the proposed change of use will increase the minimum off-street vehicle parking requirement for the subject property. In addition, the project's parking requirement is calculated into the overall parking requirement for the Washington Square shopping center. In April 2018, the City of Tigard Planning Division (Case No. MMD2018-00015) determined the minimum off-street parking requirement for all existing uses in the Washington Square shopping center was 3,536 spaces, and concluded there was adequate off-street parking,with 6,787 spaces provided. Therefore, staff concludes the new minimum off-street parking requirement for Washington Square shopping center is 3,591 spaces (factoring in the change of use described above).Accordingly, staff finds there is adequate off-street parking in Washington Square shopping center to serve this proposal,with a surplus of 3,196 spaces. Upon review of the applicant's plans and narrative,staff finds this proposal is in compliance with all other MMD2018-00020 Din Tai Fung 2 applicable requirements of this title. This criterion is met. 2. The modification is not a major modification. The applicant is not proposing any of the changes outlined in CDC 18.780.040.B. Therefore, this proposal is not a major modification. This criterion is met. CONCLUSION: The proposal is a minor modification to an existing development and is in compliance with the applicable requirements of this Title. SECTION V.
