AN ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT TO THE LANDS OF
Anton Schulz and Martha Schulz in Sec. 2, T2S, R1W, W.M.
TIGAR.D, WASHINGTON COUNTY, OREGON i1
WHEREAS, the hereinafter described lands, by action of the
City Council of the City of Tigard, Oregon, pursuant to the Zoning
Code of said City, have heretofore been limited in the use to those uses
permitted by said Code, under, and have been classified and zoned
for, R-7 (Residential) and
WHEREAS, pursuant to prescribed procedures, the owners of
said lands have applied to the City of Tigard for reclassification of
said property and change of zone thereof to permit the use thereof
for (A-2) (Multiple Dwelling) purposes, and said application has
been duly publicized and public hearinq held by the City Planning
Commission on januqly_211969 after due and legal notice; and
WHEREAS, the Planning Commission has recommended disapproval
of said zone change to the City Council, and due and legit- otice of
City Council hearing having been given by publication in the Tigard
Times, and the City Council having heard same at its regular meeting
of February 10, 1969 , and the Council finding that no public
detriment will result From granting of said petition, and that it is
in the public interest that said zone change be approved, and the lands
re-zoned from n-7 (Residential) to A-2 (Multiple Dwelling)
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the following described lands be, and the same are
hereby, zoned as A-2 for use in accordance with the
A-2 (Multiple Dwelling) cTssif;.cation of the Zoning Code of
the City of Tigard, which Zoning Code with respect to the A-2 _ 1
classification is by reference herein made a part hereof:
see attached Description marked "Exhibit A"
Section 2: This ordinance shall be effective on the 31st day after
its enactment by the City Council of Tigard, Oregon.

being read three times by number and title only,

PROPERTY INVOLVED: NW corner Hillview and the platted location of
104th Avenue (Map #2S1 2CC Tax Lot 1300)
SIZE OF PROPERTY: 0.78 acre
STAFF RECOMMENDATION:
The City Staff recommends denial of this application. The
property is not sufficiently served by streets for apartment use.
Southwest 104th Avenue is a platted, but not at all improved
street. The only access to this property now is indirect and on
residential streets which were planned for single family develop-
ment and are not sufficient for added density. Perhaps when SW 104th
Avenue is improved to City standards the zone change should be re-
considered. Allowing a zone change at this time without improvement
of the street would only burden the existing neighborhood.
A-2 zoning would allow for 14 apartment units
PUBLIC HEARING:
No one was present in the audience when this hearing was
opened. The applicant was not present either.
COMMISSION DISCUSSION AND ACTION:
The Commission felt that the surrounding single family
neighborhood should not have to bear the burden of the traffic
from an A-2 development, and, until such time as 104th Avenue is
an improved City street, that the zone change should be denied.
The Commission voted unanimously to deny the zone change.

It is agreed that the undersigned, being the owner of
certain lands abutting 104th S.W. between S.W. McDonald
Street and S.W. Hillview Stivet, shall post a bond in an
amount estimated to be the cost of construction of 104th
S.W. from C.W. McDonald to S.W. Hillview Street, as
determined by the City Engineer, before the issuance of a
building permit for any structure to be located on said
lands.
It is further agreed that construction of the above portion
of 104th S.W. shall be completed within one year from the
date of issuance of any building permits for structures on
said lands.
It is also agreed that thse requirements shall be stated
as deet'. restrictions in the event title to said lands,
presently owned by the undersigned are transferred to
another party or parties.

Dear Mr. Schulz :
The Tigard Planning and Zoning Commission at their regular
meeting on April 18, 1967, approved the Zone Change for
the property located at S.W. Hillview and S.W. 104 , Tax
Lot 1300, Map 231 2CC with the condition that the building
permit not be issued until proper access is provided on
S.W. 104 .
The zone change has been recommended to the City Council
and a public hearing will be held on May 8, 1967.
