I/ 6. The proposed privately-operated and maintained parking lot plan-profile and cross section details shall be provided as part of the public improvement plans. The parking plan shall be amended to include no more than a one way drive adjacent to and cl.ong the west side of the southern most block of parking, with the balance of the area between the drive and the fence along the west property line landscaped from the southern boundary of the site to the southwest edge of the proposed build- ing. Two parking spaces shall be eliminated from the northern block of parking which is adjacent to the building on the south side; those two spaces shall be the western-most spaces adjacent to the fence along the west property line. The space shall be landscaped at least to the southwest edge of the proposed build- ing and no parking shall be allowed on the west side of the proposed building, north of the remaining block of parking which is adjacent to the building on the south side. The remain!.ng parking (71 spaces) shall be as set forth on the revised site plan. 7. The applicant shall not allow the parking area to be used for non-religious asembly uses. It is the responsibility of the applicant to provide security to prevent such unauthorized use of the parking are, . Failure to prevent such unauthorized uses could resul' in an additional requirement to gate or chain the access to the lot, or to provide a more formal plan for security for the area. 3 • • • • 8. Five (5) sets of plan and profile public storm drainage • construction plans and one (1) itemized construction cost estimate, stamped by a Registered Professional Civil Engineer, detailing all proposed public improvements shall be submitted to the Engineering Division for approval . Two (2) sets of plan and profile plans shall be submitted for preliminary review prior to submittal of final plans. 9. Construction of the proposed storm drainage improvements shall no. commence until after the Engineering Division has approved public improvement plans. The section will require a 100% performance assurance or letter of commitment, a developer- engineer agreement, and the payment of a permit fee. Also, the execution of a street opening permit or construction compliance agreement shall occur prior to, or concurrently with the issuance • of approved public improvement plans. 10. The applicant shall provide connuction of proposed buildings to the public sanitary sewerage system. A connection permit is required to connect to the existing public sanitary sewer system. 11. A tree removal permit will be required for removal of trees as shown on the submitted landscaping plan. A detailed tree protection plan shall be submitted which provides methods of • protecting trees to be retained during construction of the church and other site improvements. The applicant shall retain all possible perimeter trees, even if smaller than 6" diameter where they do not interfere with the traveled portion of the 4 I 11 t internal roadways. The applicant shall also submit a landscaping plan for ground cover and shrubs, including designation of. spe- cies. 12. All light poles on the site shall be wooden. Background Information No land use applications regarding the site have been reviewed by the City. However, a lot line adjustment was approved for tax lots 12000 and 11800 to the east (Filke M 13-85) which resulted in the City Council approving vacation of a 30 foot wide roadway easement from SW 93rd Avenue to the site (City Ordinance 86-44). The result of this easement vacation is that the subject parcel has access to only Durham Road. Washington County, which then had j:irisdiction of Durham Road, agreed to this parcel having direct access to Durham Road. 3 . Vicinity Information The subject parcel is surrounded by single family residences. The area north of the site is within the Summerfield planned community and is ronec R-•-7 (PD) (Residential, 7 units/acre, Planned Development. overlay) . The area to the south and east is in Kneeland Estates subdivision and is zoned R- 4.5 (Residential, 4.5 units/acre) . A paved path not attached to the roadway exists on the north side of Durham Road. Widening and other improvements to Durham Road between Hall Boulevard and Pacifi Highway is among the proposed street improvement pr•oiects that will be the subject of a road levy to be voted on by the citizens of Tigard in November 1989. • • 4 . Site lnforma_tion- and Pruposal._Descrintion The site is relatively flat, vacant, and covered with a variety of • grasses, shrubs, and a number of maple, pine, and fir trees. Conditional Use approval is requested to allow construction of a church • on the site. Religious assemblies are a conditional use in the R-4.5 /one. The applicants propose to construct a 4,400 square foot church • building on the 1 .26 acre site. The church would include a 200 seat auditorium, a classroom, a conference room, and a library . The building would have a maximum height of 20 feet. The main entrance to • the building would be on the east side under a covered drive-through. • • • Associated site improvements would include a 52 space parking lot; a sign; site landscaping; and a six-foot tall wooden fence on the east, south, and west sides . Thirty-one existing trees on the site would be • retained. The site plan proposes access to the site throuyr 3L foot wide access driveway with pavement tapering to the Durham Road roadway. 5. Agency and NPU Comments The Engineering Division reviewed the proposal and offered the following comments : 1 . The proposed building will have direct access to Durham Road, a major collector street. A major collector street is defined as having a minimum paved width of 44 feet with curbs, sidewalks, streetlights, and underground utilities. Durham Road is currently a 2-lane paved street with ditches on both sides. The existing vertical profile of Durham Road is relatively flat • adjacent to this site. The ultimate design profile may be lowered when full improvements are made in order to increase safety and drainage and to decrease the noise level onto adjacent properties. Therefore, half street improvements would not be logical at this time but should be delayed until the ultimate profile of Durham Road can be resolved. One access is proposed to Durham Road. 'the %.Access would be 36 feet wide with 28 foot and 30 foot long tapers at Durham Road on both sides of the driveway . A taper on the west side of the driveway will allow vehicles to turn into the site without having to decelerate substantially on Durham Road. To provide a lafer entrance, the proposed tape. at Durham Road should begin a,. least 50 feet from the west edge of the driveway and taper to meet the proposed taper with a 15 foot minimum radius curve. 2 . Sanitary sewer service to the proposed building is shown from an existing lino along the north side of SW Durham Road. 3 Sturm drainage sewers are proposed to connect to an existing 36 inch culvert: crossing SW Durham Road about 120 feet west of the west property line of the site. However, this culvert appears to be several feet higher than any portion of the site. The site currently drains in the opposite direction to the southeast. 4. Site grading is proposed that would not alter existing elevations. This will result in a depressed area at the southern-most portion of the site. No elevations are shown on the submitted site map. Washington County Fire District #1 commented that fire hydrants must be provided so that no portion of the proposed structure is greater than 250 feet from a fire hydrant. Tigard Water District commented that the proposed use can be served by a 12-inch main located along the south side of Durham Road. The Water District commented that a fire hydrant would need to be installed by the applicant in front of the site. Other technical comments will be forwarded to the applicants. The Building Division and PGE reviewed the proposal and offered no comments or objections. No other comments were received. H. ANALYSIS The Community Development Code conditionally allows religious assemblies (churches) in the R-4.5 zone upon demonstration that certain approval criteria are satisfied. General approval standards include: (1) the site size and dimensions are adequate for the proposed use and will allow adequate buffering from adjacent uses; (2) site characteristics are appropriate for the use; (3) adequate public facilities serve the site; (4) all applicable requirements of the zoning district and the Code aro satisfied; and, (5) the use complies with applicable comprehensive plan policies (CDC Chapter 18. 130.040) . Specific approval criteria for religious assemblies include (1) the site size is at. least 20,000 square feet; and (2) the following setback regulations are satisfied: a. The front yard setback shall be a minimum of 25 feet. b. The parcel provides adequate space for the church, landscaped areas, screening and buffering, and parking; (2) no characteristics of the site impede the use; (3) adequate public facilities presently serve the site or will be extended to the site in the development process; (4) setback requirements and other requirements of the Code are satisfied; (5) plan policies which apply to the use proposed are satisfied as follows: - Policy 2. 1 . 1 is satisfied because the NPO and surrounding property owners were given notice of the hearing and an opportunity to comment on the applicant's proposal . -- Policy 6. 1 . 1 is satisfied because adequate landscaping and fencing will be utilized to screen the church from adjace:1t residential uses . - Policy 7. 1 .2 is satisfied because adequate water and sewer • facilities are available to serve the proposed church. Adequate access width and location have been provided. It is strongly recommended that the 4pplicants provide additional parking spaces for the church. The size of the church building and associated classrooms provide the potential for parking demand quickly exceeding the parking area provided. Overflow parking off -sit:e on adjacent streets would be inappropriate. Parking on Durham Road is prohibited . The site plan provides for internal acce:ss drives far in excess of the necessary safe width. This additional paved area would be better utilized for parking. It is recommended that the applicants prepare a revised site plan which provides for additional parking spaces or possibly additional landscape area that could be converted to parking as the need arises. The revised plan may be submitted to the Planning Division for administrative review as a minor modification of a Conditional Use plan. C. FINDINGS AND CONCLUSIONS The relevant criteria in this case are Tigard Comprehensive Plan Policies 2. 1. 1, 6. 1. 1, 7. 1 .2, 8. 1 . 1, and 8. 1 .3, and Community Development Code Chapters 18 .50, 18. 100, 18. 102, 18. 106, 18. 108, 18 . 130, and 18. 164. The Planning staff has determined that the proposal as submitted, or with minor modifications, is consistent with the Comprehensive Plan based upon the findings noted below. a. Policy 2 . 1 . 1 is satisfied because NPO #6 and surrounding property owners were given notice of the hearing and an opportunity to comment on the applicants' proposal . b. Policy 6 . 1 . 1 is satisfied because adequate landscaping and fencing will be utilized to screen the church from adjacent residential uses. c . Policy 7. 1 .2 is satisfied because quate water, storm drainage, and sewer facilities are available to serve the development. d . Policy 8 . 1 . 1 is satisfied because traffic impacts of the \ proposed usc upon Durham Road are expected to occur at times different than the peak traffic times for Durham Road. the Additional traffic generated by the proposed use are therefore not anticipated to greatly impact traffic safety and efficiency on Durham koad. e. Policy 8 . 1 .3 will be satisfied when the conditions of approval relating to temporary street improvements, right-of -way dedication, and execution of a non-remonstrance agreement are completed.
