PERMANENT STORM DRAINAGE EASEMENT
KNOW ALL MEN BY THESE PRESENTS THAT Spieker-Hosford-Eddy-Souther #198,
Limited Partnership
hereinafter called the Grantors, in consideration for the sum of

hereinafter called Grantee, grant and convey unto the City of Tigard a perpetual
easement for constructing, reconstructing, operating, maintaining, inspecting and
repairing of an underground storm drainage line and appurtenances, together with the
right to enter upon the grantor's property for the above mentioned purposes, and the
right to remove, as necessary, vegetation, foliage, trees and other obstructions on the
following described parcel of land, situated in the City of'Tigard, Washington County,
State of Oregon: a
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right, title or
interest except those expressly stated in this easement, nor otherwise prevent Grantors
from the full use and dominion thereover; provided, however, that such use shall not
interfere with the uses and purposes'of the intent of the easement.
IN CONSIDERATION of the premises, grantee agrees that if said Grantee, its
successors or assigns should cause said easement to be vacated, the rights of the
Grantee in the above described easement will be forfeited and. shall immediately revert
-o the Grantors, their successors and assigns in the case of such event.
To HAVE AND TO HOLD the above-described and granted premises unto said Grantee, its
successors and assigns forever.

An easement for storm sewer over and across a portion of that property recorded as FEE
81-035898 and over a portion of TRACT "A," TECH CENTER BUSINESS PARK situated in
the southwest one-quarter of Section 1, Township 2 South, Range 1 West of the Willamette
Meridian, in the County of Washington and the State of Oregon, more particularly described
as follows:
COMMENCING at the south one-quarter corner of Section 1, Township 2 South,
Range 1 West; thence North 89° 45 1 11" West, along the South line of said
section, a distance of 135.17 feet; thence North 41 ° 39 1 21" West, a distance of
519.19 feet to the TRUE POINT OF BEGINNING; thence North 66° 44, 36 East
a distance of 91.15 feet to the south right of way line of S.W. Tech Center Drive;
then following said right of way line North 86° 19 , 37" West a distance of 46.48
feet; thence following said right of way line along a 75-foot radius circular curve left
an arc distance of 50.59 feet; thence following said right of way South 89° 03 , 00"
West, a distance of 11.52 feet; thence South 41 ° 39 1 21 " West a distance of 34.00
