The R-4.5 zone is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes are permitted conditionally. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. UFR2018-00004 Greensward South—Urban Forestry Plan Modification 1 THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject site is Lot 15 of the Greensward South Subdivision (Case No. SUB2014-00010),which was approved by the City of Tigard Planning Division in May 2015.This approval was for a 15-lot subdivision, located north of SW Sattler Street, south of SW Greensward Lane, east of SW 97th Avenue, and west of SW Hall Boulevard. The site is zoned R-4.5 (Low-Density Residential), as are adjacent properties. In November 2017, the City of Tigard Planning Division approved a modification to the original Urban Forestry Plan from Case No.SUB2014-00010,in order to remove one(1) tree on Lot 1 that was originally proposed for preservation (Case No. UFR2017-00004). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.520.070 Modification to the Urban Forestry Plan Component of an Approved Land Use Application A. Approval process. Except as exempted in Subsection 18.520.070.B, an application for a modification to the urban forestry plan component of an approved land use shall be processed through a Type I procedure, as provided in Section 18.710.050,using the approval criteria in Subsection 18.520.070.C. The applicant proposes to modify the Urban Forestry Plan originally approved under Case No.SUB2014- 00010. Specifically, the applicant proposes to remove three (3) trees that were originally proposed for preservation, in order to accommodate a new sports court. The removal of these trees is not exempt from the Type I Urban Forestry Plan Modification. Therefore, this application subject to the approval criteria outlined below. Additionally, the applicant proposes to modify the location of tree protection fencing shown on the original Urban Forestry Plan,and to plant two (2) new Oregon White Oaks. C. Approval criteria. The approval authority shall approve or approve with conditions the modification to the urban forestry plan component of an approved land use application when all of the following are met: 1. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; The project arborist has provided a revised report and statement certifying that the previously approved Urban Forestry Plan did not account for the circumstances that led to the proposed modification. Although a new detached, single-family home was proposed on Lot 15 during land use review, the applicant did not anticipate the construction of a sports court on the north side of lot,where the existing on-site trees are located.Accordingly,the applicant proposes to remove three(3) trees that were originally proposed for preservation, in order to accommodate this new sports court. Additionally, the applicant proposes to modify the location of tree protection fencing shown on the original Urban Forestry Plan, and to plant two (2) new Oregon White Oaks. This criterion is met. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and The applicant has provided a revised report and statement certifying that there is no practicable alternative UFR2018-00004 Greensward South—Urban Forestry Plan Modification 2 to the proposed modification. This criterion is met. 3. The project arborist or landscape architect demonstrates through a revised urban forestry plan, compliance with Section 18.520.030. (Ord. 17-22 §2) The applicant submitted a revised Urban Forestry Plan and supplemental report that demonstrate compliance with 'IDC 18.520.030, including tree preservation, protection, and canopy standards. This criterion is met. CONCLUSION: As demonstrated in the analysis above, the proposed modification to the Urban Forestry Plan Component of the approved Greensward South Subdivision meets all applicable approval criteria. Please note that MHA did not prepare the original approved Urban Forestry Plan for this project. Background.This is the third modification to the Greensward South Urban Forestry Plan.The first modification, dated May 24, 2017, proposed removal of existing tree#5836 in the rear of lot 11 because of hazardous condition and planting of one native Oregon white oak(Quercus garryana) in the back yard of lot 11 and one glorybower tree (Clerodendrum trichotomum) in the front yard of lot 11.The second modification,dated November 10, 2017, proposed removal of existing tree#5218 in the rear of lot 1, planting three small statured non-native trees on lot 1, planting one native Oregon white oak in each of the back yards of lots 9 and 10,and not planting one native cascara (Rhamnus purshiana)originally proposed in the backyard of lot 10. Proposed Modification.The current modification proposes removal of trees#6099,#6100,and#6101 from the stand in the rear of lot 15, adjusting the location of tree protection fencing to protect the remaining stand of Douglas-firs(Pseudotsuga menziesii) during homebuilding and proposed construction of a sports court, and planting two native Oregon white oaks. Code Criteria. Section 18.520.070.0 provides the approval criteria for modifications to the Urban Forestry Plan components of an approved land use permit. Each of the pertinent criteria are addressed below. 1. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; The previously approved urban forestry plan did not account for the circumstances that led to the proposed modifications because a sports court was not originally proposed. H&H Homes has been contracted to build a home on lot 15 and the buyers would like a sports court which necessitates removal of three trees and adjustments to the location of tree protection fencing.The three trees proposed for removal include: • Tree#6099, a 12-inch diameter bigleaf maple(Acer macrophyllum) in poor condition with a small live crown, dead and broken branches,crown decay,and very poor structure;this tree originally received condition and preservation ratings of 1 which are still applicable. Greensward South–Lot 15 Urban Forestry Plan Modifications April 23, 2018 Page 2 of 3 • Tree#6100, a declining red alder(Alnus rubra)with 8-inch and 11-inch codominant stems, one of which is leaning excessively towards the building lot. Generally, red alders have inherent species limitations because they are fast growing and short-lived.This tree originally received condition and preservation ratings of 2, but the preservation rating has been modified to 1 because it is declining. • Tree#6101, a 27-inch diameter bigleaf maple with codominant stems, a few dead and broken branches,and crown and trunk decay;this tree originally received condition and preservation ratings of 2,which are still applicable. Trees#6099 and#6101 are in conflict with the location of the sports court and adequate protection is not possible.Tree#6100 is not in direct conflict with the sports court, but this tree is no longer suitable for preservation at the edge of the stand because of declining condition. Numerous other trees, primarily mature stand grown Douglas-firs,will continue to be retained in the rear of lot 15. During homebuilding, protection fencing should continue to be located at the dripline of retained trees at a minimum. Prior to commencing sports court construction,the location of protection fencing may be adjusted to the limits of sports court construction provided that the sports court will be built up from native grade with no excavation as we discussed during the on-site meeting.The recommended location for tree protection fencing is provided on the enclosed plot plan. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification;and The property owners desire a 44-foot x 60-foot sports court and there is no practicable alternative to the proposed modification to allow construction of a sports court of this size. However,the proposed sports court has been situated to have the least impact to existing trees—two of the three trees proposed for removal have preservation ratings of 1 and only one tree with condition and preservation ratings of 2 is proposed to be removed. Moreover,the location of the sports court does not necessitate removal of the more dominant intact stand of Douglas-firs which will continue to be provided with sufficient protection. 3. The project arborist or landscape architect demonstrates through a revised urban forestry plan,compliance with Section 18.520.030. This memorandum,the enclosed lot 15 plot plan and modified Tree Preservation and Removal Site Plan, Tree Table,and Tree Canopy Site Plan demonstrate compliance with Section 18.520.030.A summary of the proposed canopy cover modifications are provided below. I did not catch this mistake in either of the previous modifications which did not directly pertain to lot 15.Now that the mistake has been identified,the canopy cover has been corrected and is based on 7,817 SF,the actual measured canopy area of the stand.^Based on removal of trees#6099,#6100,and#6101,the size of the stand is 6,194 SF. In addition,two Oregon white oaks are now proposed on lot 15,which provide 1,963 x 1.25 canopy credit each. The proposed modifications result in a greater amount of future tree canopy on lot 15 and the overall development site,even after the canopy cover of the retained stand on lot 15 is corrected to account for double credit per Section 10, Part 3.M(2)(b)of the Tigard Urban Forestry Manual, and accounting for the removal of three trees from the stand and the planting of two native Oregon white oaks with 1.25 times canopy credit per Section 10, Part 3.M(2)(d).The enclosed plans and this report reflect the proposed changes to the previously approved Urban Forestry Plan,demonstrating that the effective tree canopy cover requirements will continue to be satisfied. No payment of a tree canopy fee in lieu of planting or preservation is proposed. However,the proposed modifications are not exempt from the Type 1 process and a $711 application fee is required because one of the three trees proposed for removal on lot 15 continues to have condition and preservation ratings greater than 1.
