The R-4.5 zone is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes are permitted conditionally. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.740.020.0 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. CUP2018-00002 Templeton Elementary School 1 SECTION III. BACKGROUND INFORMATION Site Information: The project is located at 9500 SW Murdock Street; north of SW Sattler Street, south of SW Inez Street, and east of the intersection of SW 96th Avenue and SW Murdock Street. The property is currently occupied by Templeton Elementary School, and includes multiple school buildings, an on-site parking lot,recreational facilities,and associated landscaping. In January 2004, the City of Tigard Hearings Officer approved a Conditional Use Permit for an 8,300- square-foot addition to Templeton Elementary School (Case Nos. CUP2003-00011 and VAR2003- 00100). In December 2017, the City of Tigard Planning Commission approved a Planned Development and Conditional Use Permit on the subject site, and adjacent Twality Middle School (Case Nos. PDR2017-00002, CUP2017-00003, and ADJ2017-00014). This approval was for a 160,000-square-foot education building on the Twality property, and a 75,000-square-foot education building on the Templeton property.The site is zoned Low-Density Residential (R-4.5). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.740 Conditional Use: 18.740.020.0 Minor modification of approved or existing conditional use. 2. An application for a minor modification shall be processed through a Type I procedure, as provided in Section 18.710.050The approval authority shall approve or approve with conditions the minor modification application when all of the following are met: a. The proposed development is in compliance with all applicable requirements of this title; and The applicant requests a minor modification to an approved conditional use for Templeton Elementary School,located at 9500 SW Murdock Street. Specifically,the applicant proposes to install two (2) above- ground condensing units. Screening of these condensing units is subject to the following standard: "Screening of service facilities. Except for single-family and duplex dwellings, service facilities such as gas meters and air conditioners that would otherwise be visible from a public street, customer or resident parking area,any public facility or any residential area shall be screened from view by placement of a solid wood fence or masonry wall between 5 and 8 feet in height," (1'DC 18.320.050.D.2). The applicant proposes to install the new condensing units inside an existing fenced enclosure, located adjacent to the north facade of the main school building. This enclosure was originally approved under Case No. CUP2003-00011, and is screened by an existing chain link fence with sight obscuring slats. Based on the applicant's submitted site plan, and aerial images of the property, staff finds this enclosure is only visible from the north side of the on-site parking lot, and the adjacent Twality Middle School recreational facilities;it is not visible from a public street or surrounding residential properties.Although the enclosure area does not include a solid wood fence or masonry wall (as outlined in 1'DC 18.320.050.D.2), staff finds the previously approved fencing provides adequate screening for the new condensing units. Furthermore, staff finds this project is in compliance with all other applicable requirements of this Title. This criterion is met. b. The modification is not a major modification as defined in subsection A of this section. CUP2018-00002 Templeton Elementary School _ 2 The applicant is not proposing any of the changes outlined in 'l'DC 18.740.040.B.2. Therefore, this proposal is not a major modification. This criterion is met. CONCLUSION: The proposal is a minor modification of an approved conditional use and is in compliance with the applicable requirements of this Title. SECTION V. The Templeton Elementary School will undergo seismic upgrades this summer as part of a Seismic Rehabilitation Grant. Part of the upgrades include replacing a very large mechanical unit serving the cafeteria. This mechanical unit is original to the building built in 1965. Removal and replacement is required to access structural walls needing bracing. The new higher efficiency mechanical unit has condensing units that require placement on the exterior of the building. We propose locating the units in the building service yard next to the existing generator and transformer. The existing chain link fence enclosing the generator will be extended to wrap around the new condensers and sight obscuring slats will be added to the fence. The location of these new condensing units will not impede future drive aisle or fire lane access as shown in the approved land use proposal for the Templeton/Twality Site (PDF2017-00002). This proposed modification does not meet any of the criteria for major modification as described in 18.740.020 Section B. Therefore, a minor modification application has been submitted.
