The C-G zoning district is designed to accommodate a full range of retail, office and civic uses with a city-wide and even regional trade area. Except where non-conforming, residential uses are limited to single-family residences which are located on the same site as a permitted use. A wide range of uses,including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses, utilities,heliports, medical centers, major event entertainment, and gasoline stations, are permitted conditionally. LLA2016-00001 DDHK,LLC 1 APPLICABLE REVIEW CRITERIA: Tigard Community Development Code Chapter 18.410.040. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to a condition of approval. The findings and conclusions on which the decision is based are noted in Section IV. CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED: 1. The applicant shall record the lot line adjustment with Washington County, and submit a copy of the recorded survey map to the city within 15 days of recording to be incorporated into the record. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels are located on the north side of SW Pacific I lighway, northeast of Watkins Avenue, and south of Park Street. Currently, Parcel 2 has direct frontage along SW Pacific Highway, and Parcel 1 has access by a 45 foot access easement through Parcel 2 onto SW Pacific Highway. The access easement per document no. 2003-147203 is shared with a total of 3 commercial lots. The proposed lot line adjustment will give Parcel 1, 25 feet of direct frontage on SW Pacific Highway; as a result both Parcels 1 and 2 will have direct frontage along SW Pacific Highway. Parcel 2 is currently developed with a commercial building, landscaping, and associated parking. Parcel 1 is currently undeveloped. Both parcels are zoned General Commercial (C-G), as are adjacent properties to the north, south and east; adjacent properties to the west are zoned Low-Density Residential (R-3.5). Proposal Description: The applicant is proposing a lot line adjustment affecting two properties: 13553SW Pacific I lighway, WCTM 2S102CCO, Tax Lot 9100 (Parcel 1); and 13599 SW Pacific Highway, WCTM 2S102CCO Tax Lot 0700 (Parcel 2). As a result of this lot line adjustment, Parcel 1 will be 14,751 square feet in size, and Parcel 2 will be 35,804 square feet in size. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS LOT LINE ADJUSTMENT - APPROVAL CRITERIA: Tigard Development Code (TDC) Section 18.410.040 contains the following criteria for approval of a Lot Line Adjustment request: Section 18.410.040 A. Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; LL1�2016-00001 DDHK,LLC No additional parcels will be created as a result of this lot line adjustment. Furthermore, there is no minimum lot size for the C-G zone. This criterion is met. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Staff reviewed the applicant's narrative and submitted site plan to determine that this lot line adjustment will not result in any violations of the site development or zoning district regulations for the C-G zone. This criterion is met. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; Staff reviewed the applicant's site plan to confirm the average lot widths for both Parcels 1 and 2 exceed the average minimum lot width for the C-G zone (50 feet). This criterion is met. b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; There is no minimum lot size for the C-G zone. This criterion is met. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and As illustrated on the applicant's site plan, both Parcels 1 and 2 have more than 15 feet of direct frontage along SW Pacific Highway. This criterion is met. d. Setbacks shall be as required by the applicable zoning district. TABLE 18.520.2 COMMERCIAL DEVELOPMENT STANDARDS STANDARD C-G Parcell Parcel 2 Minimum Setbacks -Front yard 0 ft. 0 ft. 0 ft. -Side yard 0 ft. 0 ft. 0 ft. -Rear yard 0/20 ft.* 20 ft.* 0 ft. *No setback shall be required except 20 feet shall be required where the zone abuts a residential zoning district. This standard only applies to Parcel 1,which abuts the R-3.5 zones along its rear property line. As illustrated in the table above, Parcel 1 and 2 meet all setback requirements for the C-G zone. Parcel 1 abuts the R-3.5 along its rear property line; therefore, the 20-foot-minimum rear setback requirements apply. Lot 1 is currently undeveloped, however new development will be subject the setback standards outlined in TDC Table 18.520.2. This criterion is met. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The applicant is proposing to create a flag lot for Parcel 1 as a result of this lot line adjustment. There is currently a 45 foot access and utility easement per Document No. 2003-147203, improved to LLA2016-00001 DDHK,LLC 3 approximately 48 feet where the proposed flag will be located. No screening is proposed as this is an existing driveway serving three commercial parcels. This criterion is met. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. The applicant is not proposing to create a new accessway with this lot line adjustment. In addition, fire hydrants are already in place. This criterion is met. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. There is currently a 45 foot access and utility easement per Document No. 2003-147203. This access easement currently serves 3 lots, the 2 lots subject to this lot line adjustment and the adjacent lot to the north 13545 SW Pacific Highway. This criterion is met. 7. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. The applicant is not proposing to create a new accessway with this lot line adjustment. Parcel 1 and 2 have one access off of SW Pacific Highway. This criterion is met. FINDING: Based on the analysis above, staff finds the approval criteria for Lot Line Adjustments are either met, satisfied through conditions of approval, or do not apply. The proposal is in compliance with the requirements of this Title. SECTION V. The site has existing access to/from SW Pacific Highway via an existing approach shared with the two adjacent properties. No new approaches or driveways are necessary or proposed for this application. No modifications are proposed to the currently- existing approach. The subject property is identified by the Washington County Assessor as Tax Lot 9100, on Tax Map 2S 1-02CC. The abutting properties to the south and east are in the C-G zoning district. The property to the north of the site is residential. There is an existing six-foot tall masonry fence along the northerly property-line that willbeincorporated into-a---proposed--1-5-foot wide landscape screen buffer as part of this application. Onsite vehicular parking is being provided as well as two bicycle parking spaces. Tree canopy coverage over the parking area is being provided in excess of the 30% minimum requirement. All necessary utilities (i.e., power, sanitary sewer, water, etc.) are presently available to the site, as illustrated on the Existing Conditions Map and the Site Development Plan, which are contained in the plan set included as part of this submittal. Storm water will flow in a northeasterly direction to a water quality treatment facility and then discharge to an existing catch basin. A service provider letter from Clean Water Services (Exhibit 5) shows that the proposed activity does not meet the definition of development and no site assessment or service provider letter from Clean Water Services is required. Bus line #94 provides bus services along SW Pacific Highway. TIGARD MUNICIPAL CODE (Code) Title 18 - COMMUNITY DEVELOPMENT CODE CHAPTER 18.360 SITE DEVELOPMENT REVIEW Section 18.360.020 Applicability of Provisions Type II Site Design Development Review 13553 SW Pacific Highway O A. Applicability and exemptions. Site development review shall be applicable to all new developments and major modification of existing developments, as provided in Section 18.360.050, except it shall not apply to:... Response: This application represents a request for new development in the form of an approximate 2,997-square foot new commercial retail building. Chapter 18.360 of the Code is therefore applicable. Section 18.360.030 Approval Process A. New developments and major modifications. B. Minor modifications. C. Approval period. D. Extension. - -- E. Phased developmcnt: - -- - - - ----- -Response: As stated previously, this is a request for approval of new construction of a commercial retail building approximately 2,997 square feet in size. As such, the application is being processed as a Type II procedure pursuant to Section 18.360.030 of the Code. The request is not for a major or minor modification, but new development. At this time, the applicant intends to begin construction of the new building immediately following plan approval and does not intend to seek any extensions. The project shall be completed in one phase. Section 18.360.070 Submission Requirements Response: A Type II application, obtained from the City of Tigard, has been submitted as part of this request. The required information is contained On the application, including the name of the property owner and applicant. The application contains the original signature of both the property owner and the applicant. A copy of the property deed is, included as an attachment with this application, along with the narrative, and a plan set which-includes an Existing Conditions Map, Site Development Plan, Utilities and Preliminary Storm Drainage Plan, Grading and Erosion Control Plan, Landscaping and Proposed Tree Canopy Plan, Urban Forestry and Tree Preservation Plan and Proposed Floor Plans and Elevations. A pre-application conference was held on October 27, 2015 with the City of Tigard staff and the notes from that meeting have also been included as part of this submittal package as Exhibit 1 . Type II Site Design Development Review 13553 SW Pacific Highway Section 18.360.080 - Exceptions to Standards Response: This application is not requesting any exceptions to setback requirements, parking requirements, private or shared outdoor area requirements or landscaping requirements. Section 18.360.090 Approval Criteria A. Compliance with all of the applicable requirements of this title, including Chapter 18.810, Street and Utility Standards. Response: The responses throughout this narrative address how the request complies with each of the applicable sections of the Code, including Chapter 18.810. B. Relationship to the natural and physical environment-Nonresidential development. Response: The site has a number ofkexisting trees along its northerly boundary. Of the 20 existing trees, 16 will remain and four will be removed due to non-viability. The four dead/dying trees to be removed will be replaced. The proposed building will be sited such that all viable existing trees will remain, as will the natural drainage of the site. The subject property is relatively flat and is not subject to ground slumping or sliding. Grading and fill will be limited to only that necessary to establish a suitable surface for the foundation of the proposed building and required grade slope for ADA accessibility and parking. The proposed building will be located approximately 70 feet from the existing building to the southeast and approximately 59 feet from the existing building to the southwest. The Utilities and Preliminary Storm Drainage Plan submitted as part of this package shows a proposed water quality facility on the site to treat and detain storm water and then discharge to an existing catch basin. The existing storm water system is the subject of a recorded easement Document No. 85005074 which is included in this packet as Exhibit 6. The site does not contain any hydrologic features or fish and wildlife habitat. Existing tree canopy cover along the site's northerly boundary will be preserved, as can be seen in the Urban Forestry and Tree Preservation Plan, which is Sheet L1 .1 of the plan set. C. Exterior elevations. Response: This proposal is for a commercial retail building - not single-family attached or multiple-family structures; therefore, this section does not apply. Type I1 Site Design Development Review 13553 SW Pacific Highway 1V8._ F; RI U D. Buffering, screening and compatibility between adjoining uses-Nonresidential development. Response: The subject property is in a commercial zone and is adjacent to residential use to its north. A 15-foot wide buffer and screen along the subject site's northerly boundary is being provided as part of this project. A six-foot tall masonry fence exists on the northerly property line. In addition to the existing masonry fence, there are 20 existing trees adjacent to the fence. Four of these will be removed, as they are dead/dying, and will be replaced with four Weeping Alaska Cedar. A total of 68 tall Oregon grapes and 17 carefree delight rose bushes will be planted within the proposed landscape buffer to provide a four-foot tall screen within two years of planting. The existing masonry fence and trees, along with the proposed shrubs and replacement trees, will provide the ni required screen g and theexistingresidential useand the proposed commercial retail building. Sheet L1 .0 and Sheet L1 .1 of the plan set show the existing and proposed plantings that have been noted in this narrative. The trash and recycling bins are contained within a screened area shown ori,the Site Development Plan, proposed to be located at the far side of the building. There is a minimum requirement of 30% tree canopy over the parking area. Sheet L1 .0 illustrates that the proposed project has a proposed tree canopy coverage of 1 ,458 square feet which is 48% of the 3,031-square foot parking area. This requirement, then, has been exceeded. The trees to be planted to provide the canopy coverage are red maple trees, as shown on Sheet L1 .0. The project does not have any exterior storage areas. E. Private outdoor area-Multifamily use. Response: This project is not for multifamily use, so this section is not applicable. F. Shared outdoor recreation areas-Multifamily use. Response: This project is not for multifamily use, so this section is not applicable. G. Where landfill and/or development for a nonresidential use is allowed within and adjacent to the 100-year floodplain, the city shall require consideration of the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway within the floodplain in accordance with the adopted pedestrian/bicycle plan. Type H Site Design Development Review 13553 SW Pacific Highway 1- ;1\A_ H; ZZ I C Response: The subject property is not located within a 100-year floodplain, so this section is not applicable. H. Demarcation of public, semi-public and private spaces for crime prevention- Nonresidential development. Response: The subject property is located in a commercial zone and adjacent uses are also commercial. The abutting parking areas and drive aisles are used and maintained in common by the subject property as well as the adjacent commercial properties. Tree canopy coverage over the parking area has been provided at 48% of the parking area. Curbing has been provided between the parking spaces and the walkways. A 15-foot wide landscaped buffer with a fence has been provided along the northerly boundary. Sheet 1 .1 shows the curbing and walkways. Sheets L1 .0 and_L1 1_show the landscaping_and_tree __.__ canopy. I. Crime prevention and safety-Nonresidential development. Response: The front façade of the proposed building has a number of windows, all of which face SW Pacific Highway. The main entrance also faces SW Pacific Highway. The main interior retail area is in the very front of the building immediately accessible from the main entrance. Exterior light fixtures will be affixed to the building and are noted on Sheet 2.0 and Sheet 2.1 . J. Public transit. Response: The subject site is along a well-established bus route with existing transit facilities. Construction of additional transit facilities will not be necessary for this 2,997-square foot commercial retail building. K. Landscaping. Response: A Landscaping and Proposed Tree Canopy Plan, Sheet L1 .0, has been provided with the plan set submitted as part of this application that complies with Chapters 18.745 and 18.790. This narrative gives a detailed description of the Plan and its compliance with the necessary requirements in this narrative document under the sections titled Chapter 18.745 Landscaping and Screening Standards and Chapter 18.790 Urban Forestry Plan. Type 11 Site Design Development Review 13553 SW Pacific Highway �;1\A_ h E(I C ) L. Drainage. Response: A Utilities and Preliminary Storm Drainage Plan, Sheet 1 .2, has been included with the plan set submitted as part of this application. The drainage plans submitted have been designed in accordance with the criteria in the adopted 1981 master drainage plan. A detailed description of the application's compliance with Chapter 18.810 is given later in this narrative. M. Provision for disabled. Response: An ADA-accessible parking space with a van loading/unloading area has been provided and is shown on the Site Development Plan. This space is immediately adjacent to an ADA-accessible walkway leading directly to the building's main entrance. ADA-accessible bathrooms are being provided inside the building. All building code requirements pertaining to ADA accessibility will be shown on the full building plans and will be reviewed for compliance at the time of the building permit. N. Response: The underlying zone of the subject property is C-G General Commercial. All of the provisions and regulations of the C-G zone have been met and are addressed in detail later in this narrative in comments for Chapter 18.520 Commercial Zoning Districts. CHAPTER 18.390 DECISION-MAKING PROCEDURES 4 4 Section 18.390.020 Description of Decision-Making Procedures Response: This application represents a request for new development in the form of an approximate 2,997-square foot new commercial retail building Table 18.390.1 lists New Construction Site Development Review as a Type II procedure. This request has, therefore, been submitted as a Type II application. Section 18.390.040 Type II Procedure A. Preapplication conference. Response: A pre-application conference was held on October 27, 2015 with the City of Tigard staff. The notes from the pre-application conference are included in this application package as Exhibit 1 . Type II Site Design Development Review 13553 SW Pacific Highway B. Application requirements. Response: The required application form has been obtained from the City of Tigard and is included with this submittal. All information on the application form has been completed, and the required fee has been submitted with the application materials. This narrative addresses all the relevant criteria of the Code and demonstrates that approval may be granted after a complete review of its contents. Two sets of envelopes will be submitted once the submitted application has been deemed "complete" by Staff. The required impact study is attached as Exhibit 2. CHAPTER 18.410 LOT LINE ADJUSTMENTS Section 18.410.030 Application Submission Requirements A. General submission requirements. All applications shall be made on forms provided by the director and shall include information required for a Type I application, as governed by Chapter 18.390. B. Specific submission requirements. All applications shall include the preliminary lot line map and necessary data or narrative, detailed information for which shall be obtained from the director. Section 18.410.040 Approval Criteria A. Approval criteria. The director shall approve or deny a request for a lot line adjustment... Response: The lot line adjustment is between two parcels. The first parcel is the subject property and is identified as Tax Lot 9100 and the second parcel is identified as Tax Lot 700. A portion of Tax Lot 700 will become part of Tax Lot 9100 resulting in an increase to Tax Lot 9100 and a decrease in size to Tax Lot 700. No additional lots are being created. Exhibit 8 is included in'this application which depicts both tax lots, the proposed legal descriptions and the before- and-after dimensions for both parcels. The existing building on Tax Lot 700 is located on the westerly boundary of said Tax Lot 700. The adjustment is taking place along the easterly boundary and thus will not have any effect on the building. A 2,999-square foot strip that is approximately 25 feet wide by 119.96 feet long is proposed to be transferred from Tax Lot 700 to Tax Lot 9100. The purpose of the lot line adjustment is to provide the subject property with at least 25 feet of frontage on SW Pacific Highway. Type II Site Design Development Review 13553 SW Pacific Highway 1-;Z«_14, IZ I U Tax Lot 9100 will increase to 14,751 square feet and Tax Lot 700 will decrease to 35,804 square feet as a result of the lot line adjustment, once approved and recorded. Both of the tax lots are zoned C-G General Commercial. The C-G zone designation does not have any minimum lot size requirements, so the resulting sizes after the adjustment don't matter in this case. Both parcels remain wider than 50 feet. The maximum building coverage in the C-G zone is 85%. With a size of 14,751 square feet, Tax Lot 9100 is allowed up to 12,538 square feet of building. The proposed building is approximately 2,997 square feet which meets this requirement. Tax lot 700 is allowed up to 30,433 square feet of building on its site, after the adjustment. The existing building is far smaller than that as most of the site is made up of parking lot. Neither of thetaxlots are flag lots. The driveway-approach-currently-exists-as-a shared easement between the two tax lots. This driveway approach will become part of Tax Lot 9100 instead of Tax Lot 700 after the adjustment; however no changes will be made to the shared access easement agreement and no changes will be made to the existing driveway approach. Document No. 2008-065469 is an existing maintenance agreement for an access easement that runs along the north boundary of the subject property. This easement is shown on the Existing Conditions Map and the Site Development Plan and a copy has been included with this application as Exhibit 4. There have been three different easements recorded for the shared driveway approach - No. 8800187; No. 94030602; No. 2003-147203. The most recent recorded Document No. 2003- 147203 includes an agreement for maintenance of the driveway and utilities and has been included with this package as Exhibit 3. B. Exemptions from dedications. A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. Response: No greenway or right-of-way dedication is proposed as part of this application, and none is required for a lot line adjustment. C. Variances to development standards. An application for a variance to the standards prescribed in this chapter shall be made... Response: No variances are proposed. The applicant shall submit the copy of the recorded lot line adjustment survey map to the city within 15 days of recording and shall be completed prior to the issuance of any building permits on the re-configured lots. C. Applicability and exemptions. Site development review shall be applicable to all new developments and major modification of existing developments, as provided in Section 18.360.050, except it shall not apply to:... Response: The applicant acknowledges that the lot line adjustment will be recorded with Washington County once approval has been received from City of Tigard. A copy of the recorded survey map will be submitted to the City within —15 days of recording and priof-to issuance-of any building permits for either of the tax lots. Site development review for Tax Lot 9100 is included as part of this application. No new construction or major or minor modifications to the existing building/uses are taking place on Tax Lot 700, so site development review is not necessary for that parcel at this time. CHAPTER 18.520 COMMERCIAL ZONING DISTRICTS Section 18.520.020 Uses Response: The subject property is located in the C-G General Commercial zoning district which is designed to accommodate a full range of retail, office and civic uses with a city-wide and even regional trade area. A list of permitted, restricted, conditional and prohibited uses in the C-G zond, is presented in Table 18.520.1 . This application represents a request for new development in the form of an approximate 2,997-square foot new building to be used for commercial retail sales. Commercial Sales-Oriented uses are a permitted use in the C-G zone as per Table 18.520.1 . Section 18.520.040 Development Standards Response: Table 18.520.2 lists the development standards for a parcel in the C-G zone. The C-G zone does not have a minimum lot size. However, it does have a minimum lot width of 50 feet. The subject parcel is 119 feet wide and thus exceeds the minimum lot width requirement. There isn't a front setback requirement in the C-G zone. The side or rear yard minimum setback, when abutting a more restrictive zoning district, is 20 feet. The northerly boundary of the subject property abuts residential use. Accordingly, the proposed new Type II Site Design Development Review 13553 SW Pacific Highway H;_AA_ buildingis 20 feet from the northerlyproperty line as depicted on the Site p p Y p Development Plan. The proposal does not include any garages, and the distance from the building to SW Pacific Highway will be approximately 129 feet. The proposed building will be approximately 24 feet tall and approximately 2,997 square feet in size. The maximum building height is 45 feet, so at 24 feet the proposed structure will meet this requirement. The maximum site coverage is 85%. The size of the subject parcel is currently 11,750 square feet. With a 2,997- square foot. building, only 25% of the site will be covered with building which meets the maximum site coverage requirement. There is a requirement for 33% of the site to be landscaped which equates to 3,878 square feet. The proposed project will be providing 4,393 square feet of landscaped area, which exceeds minimum requirement. Sheet L1 .0 of the plan set illustrates the proposed - -- landscaping and notes the figures-cited--above. -- -- -- CHAPTER 18.705 ACCESS, EGRESS, AND CIRCULATION Section 18.705.030 General Provisions A. Continuing obligation of property owner. Response: A common access exists on the subject property. Access is shared with the adjacent commercial sites. The access easement has been recorded as Document No. 2003-147203 and is included with this application as Exhibit 3. B. Access plan requirements. Response: The Site Development Plan, which is Sheet 1 .1 of the submitted plan set, shows the access to and from SW Pacific Highway with a drive aisle extending to almost the rear of the subject property and accessing the front parking area for the new building. There is also a drive aisle that runs along the subject site's easterly boundary to provide access to the side parking area and the ADA parking space for the new development. All the drive aisles allow for two-way traffic. C. Joint access. Response: The drive aisles and approaches for the subject property are shared with the adjacent commercial sites. An existing maintenance agreement is included in Document No. 2003-147203 which is attached to this application as Exhibit 3. Type II Site Design Development Review 13553 SW Pacific Highway E1VX_ N; 1ZI0 D. Public street access. Response: The existing driveway approach takes direct access from SW Pacific Highway, which is a public street. E. Curb cuts. Response: The width curb cut for the existing driveway approach is 51 .7 feet as depicted on Sheet 1 .0 included in the plan set as part of this submittal. No new curb cuts are proposed for this development. F. Required walkway location. Response: The proposed new building is a single-story building. The main entrance is in the front of the building, with a secondary entrance also in the front of the building to a separate suite. There is a side entrance to a storage area. A five-foot wide paved concrete walkway extends in the front of the building and around both sides of the building where it ends at the rear of the building. The five-foot wide walkway is immediately adjacent to both parking areas, thus providing pedestrian access from vehicles to the building. A six-inch curbed vertical separation is shown on the Site Development Plan between the parking area and the pedestrian walkway. G. Inadequate or hazardous access. • Response: Access to the new building already exists in the form of an improved and approved driveway approach. No changes are being made to this approved approach. All pedestrian access to the new building is immediately adjacent to the building and the parking area without requiring pedestrian crossings of any drive aisles. All drive aisles are at least 24 feet in width and provide adequate access for two-way traffic and emergency vehicles. Thus, this application does not present any issues with inadequate or hazardous access. H. Access management. Response: This application does not request any new driveways, accesses or approaches. The new development will be utilizing existing improved accesses and approaches. No modifications are proposed. 1. Minimum access requirements for residential use. Type II Site Design Development Review 13553 SW Pacific Highway 1VsE1�IO i Response: This requirement is not applicable as the proposed use is a commercial use. • i J. Minimum access requirements for commercial and industrial use. Response: The minimum access requirement for fewer than 100 parking spaces is one 30-wide access with 24-foot wide curbs required. The new development shares its access with two other properties. The total number of existing and proposed parking spaces for all three properties is 45 which is fewer than 100, thus the one existing access is sufficient for this development. The distance between the curbs is 51 .7 feet and the width of the access is 30 feet. This requirement has been met. This is illustrated on the Existing Conditions Map. K. One-way vehicular access points. Response: The existing access point is for two-way traffic. CHAPTER 18.725 ENVIRONMENTAL PERFORMANCE STANDARDS Section 18.725.030 Performance Standards Response: The proposed building is for general commercial retail use. Any noise associated with retail use is contained within the building when the customers enter. The applicant will abide by the provisions of Sections 6.02.410 through 6.02.470 of the Tigard Municipal Code in the operation of the business. The proposed general commercial retail use will not produce any visible emissions, vibration, odors, or glare and heat as no manufacturing or industry is part commercial retail sales. All waste materials shall be disposed of in trash and recycling bins stored in an outdoor screened container area. The bins will be emptied on a weekly basis to prevent any infestation of insects and rodents. CHAPTER 18.745 LANDSCAPING AND SCREENING Section 18.745.020 Applicability A. Applicability. B. When urban forestry plan requirements concurrently apply. C. Site plan requirements. Response: This application is a Type II land use review application, therefore the provisions of Chapter 18.745 are applicable. The plan set submitted with this Type II Site Design Development Review 13553 SW Pacific Highway HME1-ZIO application includes a Landscaping and Proposed Tree Canopy Plan and an Urban Forestry and Tress Preservation Plan that show the requirements of Chapter 18.745 and Chapter 18.790. A Site Development Plan has also been included in the plan set submitted with this application. Section 18.745.030 General Provisions A. Maintenance responsibility. B. installation requirements. C. Certificate of occupancy. D. Protection of existing plants. E. Ongoing tree-related rules and regulations. Response: The property owner shall be responsible for maintenance of the pro -o-s-e-d landscaping and screening. This responsibility may beincluded lease _-- agreement, depending upon the proposed tenant and the terms of the lease agreement. The proposed site landscaping and screening, depicted on the submitted plans for this project, will be installed according to accepted planting procedures and the provisions of the Code. Planting materials will meet the standards of the American Standards for Nursery Stock. Applicable notes have been made on Sheets L1 .0 and Ll .l , included in this submittal. Existing trees that will remain will be fagged as remaining and are identified as remaining on the Urban Forestry and Tree Preservation Plan included in this submittal. The remaining trees will have a construction fence installed along the edge of the 15-foot wide landscape buffer for protection during the construction process. This is depicted on Sheet L1 .1 . Both existing trees and proposed trees will be maintained subject to the tree-related rules and regulations of the Tigard Municipal 'code and Tigard Development Code as noted on Sheet L1 .0. Section 18.745.040 Street Tree Standards Response: The subject property only has 25 feet of frontage on SW Pacific Highway, which equates to one street tree. However, the entire area of frontage is a driveway access approach. Planting a street tree in the driveway access approach area is not possible as it would present a traffic hazard and would impede vehicular access to the site. The applicant will remit payment into the urban forestry fund for tree planting and early establishment in an amount Type II Site Design Development Review 13553 SW Pacific Highway �r ME xI C� equivalent to the City's cost to plant and maintain a street tree for three years for the one street tree required for this project. Section 18.745.050 Buffering and Screening Response: The surrounding properties to the northeast and south are zoned C-G and are utilized for commercial purposes. Buffering and screening is therefore not required along the northeast and south boundaries. The property to the northwest of the site is utilized for residential purposes and does require a landscaped screening buffer. Table 18.745.1 shows a "D" buffer requirement for the proposed commercial use adjacent to the existing residential use. Table 18.745.2 gives the "D" buffer width of 20-feet-with-a--six-foot-tall-hedge-or-a 15-foot width with-a-six-foot tall fence. An existing six-foot tall masonry fence exists on the subject site, along with 20 existing trees. The fence will remain to provide part of the required screening in a 15-foot wide screening buffer. Of the existing trees, 16 will remain. The four trees being removed are dead/dying and will be replaced with four Weeping Alaska Cedar. Shrubs will also be planted in this 15-foot wide area. Sheet L1 .0 illustrates the 15-foot wide buffer along with the types of trees in existence and shrubs and trees to be planted. Section 18.745.060 Re-vegetation Response: The only natural vegetation to be removed will be in areas to be occupied by the structure and the parking lot, therefore this section is not applicable to this development. • CHAPTER 18.755 MIXED SOLID WASTE/RECYCLING STORAGE Section 18.725.030 --- Performance Standards Response: The required screened trash enclosure has been proposed along the far side of the building. It's noted on both the Site Development Plan and the Landscaping and Proposed Tree Canopy Plan. CHAPTER 18.765 OFF-STREET PARKING AND LOADING REQUIREMENTS Section 18.765.030 General Provisions Response: The submitted Site Development Plan shows the parking area and drive aisles for the proposed new construction. The proposed building is Type II Site Design Development Review 13553 SW Pacific Highway FY,1VA_ KIn approximately 2,997 square feet in size with a proposed use of retail sales. All the parking for the proposed use is provided on the subject property. Utilization of the adjacent parking spaces on the adjoining properties is not part of this project, so any requirements for joint parking are not applicable. The Site Development Plan shows eight standard spaces on one side of the building and two compact spaces and one ADA space on the other side of the building. The access drives are 24 feet in width to accommodate two-way traffic. The parking spaces shall be striped in accordance with the regulations of this section. Wheel stops in front of the parking spaces are shown on the Site Development Plan. No signage is proposed for any of the parking area on the site. Drainage has been accounted for in the Utilities and Preliminary Storm Water Drainage Plan. The standard parking spaces provided are 8.5' x 18.5' and the compact spacesare7.5'- by,16.5' as per the-regulations-in-this section:-- Section 18.765.050 Bicycle ParkingDesign Standards Y g Response: Two bicycle parking racks/spaces have been provided on the side of the building. They are shown on the submitted Site Development Plan and are approximately 27 feet from the main entrance. The racks are visible from SW Pacific Highway and are not contained within a parking aisle, landscape area or required pedestrian ways. The bicycle parking area is on paved concrete and the spaces are a standard 2.5 feet by 6 feet long. The bicycle space requirement is no fewer than two spaces, if the ratio is less than two. The ratio of 0.3/1 ,000 listed in Table 18.765.2 equates to 0.9 space, so the minimum default requirement of two is the standard which has been met. Section 18.765.070 Minimum and Maximum Off-Street Parking Requirements Response: The proposed project is for a 2,997-square foot commercial retail building. Table 18.765.2 lists a minimum requirement of 3 per 1 ,000 square feet of floor area and a maximum requirement of 5.1 per 1 ,000 square feet of floor area. These requirements calculate as follows: Minimum = 3 x 3 for a total of 9 minimum spaces Maximum = 3 x 5.1 for a total of 15 maximum spaces Referring to the Site Development Plan, the project is providing a total of 11 parking spaces. There are eight standard spaces on one side of the building and two compact and one ADA space on the other side of the building. Type II Site Design Development Review 13553 SW Pacific Highway i CHAPTER 18.790 URBAN FORESTRY PLAN Section 18.790.020 Applicability Response: This application is a Type II Site Development Review, therefore the requirements of the Urban Forestry Plan are applicable to the project. Section 18.790.030 Urban Forestry Plan Requirements Response: An Urban Forestry and Tree Preservation Plan has been included in the plan set that has been submitted with this application. A certified arborist has certified the applicable plans and reports. The project requires 30% tree canopy coverage over the parking area and 33% landscaping area. Referring to the Landscaping and Proposed Tree Canopy Plan,note 3,031 square feet of the site is parking area. Tree canopy in the amount of 48% is being provided over the parking area with red maples, which are on the City of Tigard's approved tree list. The tree canopy coverage requirement has been met, so a tree canopy fee is not.part of this application. The Urban Forestry and Tree Preservation Plan shows the required items as per the Urban Forestry Manual. The supplemental report standards in the Urban Forestry Manual are shown on the Urban Forestry and Tree Preservation Plan, the Landscaping and Proposed Tree Canopy Plan and the arborist's report. CHAPTER 18.795 VISUAL CLEARANCE AREAS 4 Section 18.795.040 Computations Response: The subject property has an existing access approach y off of SW Pacific Highway. Within 35 feet of each side of that existing approach, the Existing Conditions Map submitted with this application shows no hedges, plantings, fences or obstructions over three feet in height. CHAPTER 18.810 STREET AND UTILITY IMPROVEMENT STANDARDS Section 18.810.030 Streets Response: This application is not for a subdivision or land division. It is for construction of one new building on an existing lot. No streets are being installed. Once the proposed lot line adjustment is approved and recorded, the Type II Site Design Development Review ` 13553 SW Pacific Highway -Fr_ZVX_X_ I L 1, 1v\I ( site will have 25 feet of frontage on SW Pacific Highway, which is improved as an existing access approach. There will be no curb cuts or alleys as part of this project. All streets are existing and improved. The proposed 2,997-square foot commercial retail building will not generate enough average daily trips to require a traffic study. Section 18.810.040 Blocks Response: This project is not a subdivision or land division, therefore this section isn't applicable. Section 18.810.050 Easements Response: The Existing Conditions Plan and the Site Development Plan show existing access, sewer and storm easements on the subject property. Copies of these recorded documents are included with this submittal as Exhibits 3, 4, 6 and 7. Section 18.810.060 Lots Response: This project is not a subdivision or land division, therefore this section isn't applicable. Section 18.810.070 Sidewalks Response: This project does not include any new streets or alleys. The subject site in its present state does not have any public street frontage. Once the lot line adjustment is approved and recorded, it will have only 25 feet of frontage on SW Pacific Highway and that frontage exists as an improved access approach. Nothing in this project, then, generates the requirement for installation of -- - sidewalks. Section 18.810.080 Public Use Areas Response: This application does not propose any public use areas. Section 18.810.090 Sanitary Sewers Response: Sewer is available to the site from an existing eight-inch sewer line contained in a 15-foot wide sanitary easement per Document No. 83000975. Section 18.810. 100 Storm Drainage Response: Storm drainage facilities exist on site in the form of a catch basin which is shown on the Existing Conditions Map. The Utilities and Preliminary Storm Water Drainage Plan depicts a proposed 246-square foot flow through punter area to detain and treat storm water from the building and proposed impervious areas prior to discharge to the existing catch basin. Section 18.810. 1 10 Bikeways and Pedestrian Pathways Response: Currently, the site does not have street frontage. After the proposed lot line adjustment is approved and recorded, the only street frontage on the subject property will be a 25-foot wide strip along SW Pacific Highway that is developed as an existing access approach. No new streets are proposed. No improvements or modifications to the existing approach are proposed. Section 18.810. 120 Utilities Response: As noted on the Site Development Plan, all utilities shall be placed underground, except for surface-mounted transformers, surface-mounted connection boxes and meter cabinets. Required , maintenance shall include the removal of snow, ice and debris as • t is practicable after their occurrence. Each party to this agreement shall bear one-half of the cost of the above maintenance anti repair. 3.2 Subject to paragraph 3.3 below, if a Wahls fail to � perform any such necessary maintenance and repairs as required, Bishop upon fifteen (15) days prior written notice to the Wahls •• may cause such work to be done with a right of reimbursement for one-half of all suns necessarily and properly expended to remedy . such failure. • 3.3 If the roadway becomes impassable or ingress or egress is unreasonably impended ar curtailed because of the party's • failure to maintain the roadway as required herein. Bishop may demand by written notice that remedial work be performed immediately. If such work is not so performed, Bishop shall have '', the rights and remedies as set forth In paragraph 3.2. i 3.4 Any necessary maintenance or repair due to repair or installation of underground utilities shall be the sole responsibility of Bishop. Such maintenance and repair shall be iperformed in a prompt and diligent basis and paid far solely by Bishop. • SECTION 4. INDEMNI'T'Y If Wahls property is damaged or destroyed Inconsistent with normal wear and teer for ingress and agreeby Bishop's use of the easement, Bishop shall indemnify and pay any such damages. r SECTION 5. PURPOSE OF AGREEMENT. The purpose of this Agreement is to provide for the construction and perpetual maintenance of the access easement and improvements within the casement arca by the owners of the Parcels of property described in Section 2 of this Agreement. 2. LEGAL DESCRIPTION. The access easement is as follows: An Access Easement located along the north property line of Parcel 2,Partition Plat No. 2008- 658 as recorded in Document No. 2008-065V4 7,Washington County Plat Records. 3. DURATION AND NATURE OF AGREEMENT. This Agreement shall continue in perpetuity. This Agreement is intended to and does attach and run with the land affected herein. This Agreement is binding on the undersigned landowners,("Declarant")and all persons claiming under it. it is the intent of Declarant to create a continuing obligation and right on the part of it and subsequent owners of the subject land. 1 1,1 • 4. OWNERSHIP. S. MAINTENANCE. The owners of Parcels 1 and 2 shall be jointly and equally responsible for the maintenance of the easement area and•improvements. lf,•however, the_act or omission of any owner of_ ___ Parcels I or 2, or guest, invitee, licensee, contractor, or agent of that owner causes damage to the improvements,the owner of Parcel l or 2 shall be responsible for the entire cost of the repair,as applicable. The owners of Parcel I and 2 shall he responsible for maintaining the driveway including the pavement in a continuously safe condition. Maintenance shall include, but not be limited to: I. The removal of debris, leaves, ice and snow from the common driveway,and maintenance of the clearspace above and adjoinine.it; 2. The removal o r trash or other unsightly or dangerous materials; 4. The trimming of trees and vegetation along the common driveway areas; 6. The maintenance of the driveway in a useable condition and in good repair. No improvements, plantings.or other materials,which would interfere with the maintenance or operation of the driveway,shall be placed near the driveway. Landscaping having a root system, which will not damage the driveway,may be placed near the driveway easement and the replacement oflandscaping shall not be included in the cost of any maintenance work. 6. INDEMNIFICATION. The owners of the common driveway area shall hold harmless,defend and indemnify the City of Tigard and the City's officers,agents,and employees against all claims,demands, actions and suits, including attorneysfees and costs brought against any ofthem arising out of the failure to properly design, locale,construct or maintain the improvements or common driveway which is subject to this Agreement or for damage to any property resulting from the failure to maintain the common driveway or improvements in a safe condition. All workers undertaking maintenance work on the common driveway shall have standard liability insurance in a reasonable amount from a reputable insurance 2 • company which protects each owner, • Each of the owners of the common driveway area shall release and indemnify the others against all liability for injury to an owner, member of the owner's family, or resident of any owner's home for injury or for property damage when it results from any undertaking pursuant to this Agreement. 7. MAINTENANCE OBLIGATIONS AND ARBITRATION. The owners of the common driveway shall confer tiom time-to-time regarding performance ofrequired maintenance under this Agreement. Each Parcel shall have one vote. Where there is more than one(I)owner of a Parcel, each owner shall have a proportional share of one(I)vote. In the event of a disagreement concerning maintenance obligations and payment, the owners shall agree upon an arbitrator who shall resolve such disagreement, if the owners cannot agree on an arbitrator,the presiding judge of the Circuit Court of the State of Oregon for the County of Washington shall appoint an arbitrator. The decision of the arbitrator shall be binding on the owners and the fee of the arbitrator shall be borne by the owners. 8. NOTICE. PURPOSE OF AGREEMENT. The purpose of this Agreement is to provide for the construction and perpetual maintenance of the access easement and improvements within the casement arca by the owners of the Parcels of property described in Section 2 of this Agreement. 2. LEGAL DESCRIPTION. The access easement is as follows: An Access Easement located along the north property line of Parcel 2,Partition Plat No. 2008- 63-8 ,as recorded in Document No. 2008-065'S/6 7,Washington County Plat Records. 3. DURATION AND NATURE OF AGREEMENT. This Agreement shall continue in perpetuity. This Agreement is intended to and does attach and run with the land affected herein. This Agreement is binding on the undersigned landowners,("Declarantf')and all persons claiming under it. It is the intent of Declarant to create a continuing obligation and right on the part of it and subsequent owners of the subject land. Li 4. OWNERSHIP._ Declarant is the owner of Parcels I and 2,Partition Plat No. 2008- 0 ' . As Declarant transfers each of the Parcels to subsequent purchasers,each such purchaser shall acquire the right to use the common driveway pursuant to this Agreement. When Declarant has conveyed both Parcels of this Agreement to others,the Declarants interest shall terminate. S. MA INTI NA.NCE. The owners cif Parcels 1 and 2 shall be jointly and equally responsible for the maintenance of the.easement area and improti ements._i f,_however,_the_act_or-.omission.of anv owner.of Parcels I or 2, or guest, invitee, licensee, contractor, or agent of that owner causes damage to the improvements,the owner of Parcel 1 or 2 shall be responsible for the entire cost of the repair,as applicable_ The owners of Parcel 1 and 2 shall be responsible for maintaining the driveway including the pavement in a continuously safe condition. Maintenance shall include, but not be limited to: 1. The removal of debris, leaves. ice and snow from the common driveway,and maintenance of the clearspace above and adjoining it; '. The removal of trash or other unsightly or dangerous materials; 4. The trimming of trees and vegetation along the common driveway areas; 6. The maintenance of the driveway in a useable condition and in good repair. No improvements, plantings,or other materials,which would interfere with the maintenance or operation of the driveway,shall be placed near the driveway. Landscaping having a root system, which will not damage the driveway, may be placed near the driveway easement and the replacement oflandscaping shall not be included in the cost of any maintenance work. 6. INDEMNIFICATION. The owners of the common driveway area shall hold harmless,defend and indemnify the City ofTig.ard and the City's officers,agents,and employees against all claims,demands, actions and suits, including attorneys' fres and costs brought against any of them arising out of the failure to properly design, locale, construct or maintain the improvements or common driveway which is subject to this Agreement or for damage to any property resulting from the failure to maintain the common driveway or improvements in a safe condition. All workers undertaking maintenance work on the common driveway shall have standard liability insurance in a reasonable amount from a reputable insurance 2 company which protects each owner. Each of the owners of the common driveway area shall release and indemnify the others against ail liability for injury to an owner,member of the owner's family,or resident of any owner's home for injury or for property damage when it results from any undertaking pursuant to this Agreement. 7. MAINTENANCE OBLIGATIONS AND ARBITRATION. The owners at'the common driveway shall cooler from time-to-time regarding performance ol'required maintenance under this Agreement. Each Parcel shall have one vote. Where there is more than one(I)owner of a Parcel, each owner shall have a ---_ -- proportional share of one(I)vote. In the event of a disagreement concerning maintenance obligations and payment,the owners shall agree upon an arbitrator who shall resolve such disagreement. If the owners cannot agree on an arbitrator,the presiding judge of the Circuit Court of the State of Oregon for the County of Washington shall appoint an arbitrator. The decision o f the arbitrator shall be binding on the owners and the fee a f the arbitrator shall be borne by the owners. 8. NOTICE.
