UFR2O17 - 00003 ESTATES AT ASPEN RIDGE NOTICE OF TYPE I DECISION URBAN FORESTRY REVIEW UFR2017-00003 , 'I MODIFICATION OF URBAN FORESTRY PLAN FOR ESTATES AT ASPEN RIDGE TIGARD 120 DAYS = December 12, 2017 SECTION I. APPLICATION SUMMARY FILE NAME: Estates at Aspen Ridge—Urban Forestry Modification CASE NO.: Urban Forestry Review(UFR) UFR2017-00003 PROPOSAL: The applicant proposes to modify the Urban Forestry Plan approved under the Estates at Aspen Ridge a subdivision (SUB2015-00010). This modification request is to remove two sequoias in the northwest corner,which were originally planned for preservation. Removal is now needed due to the amount of damage that would occur with the proximity to grading. The modification also includes planting only 12 trees, the original plan included planting 48 trees, creating a dense monoculture in the backyards of each lot. The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.790 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to conditions. The findings and conclusions on which the decision is based are noted in Section IV. UFR2017-00003 Estates at Aspen Ridge Urban Forestry Plan Modification 1 SECTION III. BACKGROUND INFORMATION Site and Vicinity Information The applicant previously received approval for a six-lot subdivision of a 1.55 acre site located on the west end of SW Viewcrest Court. Three of the proposed lots will take direct access off of Aspen Ridge Drive and the other three lots will take access off of a private street extended from the terminus of SW Viewcrest Court. The site is relatively steep sloping down from the southern boundary to SW Aspen Ridge Drive. The site is zoned. R-4.5. Properties to the north, east, and south are all zoned R-4.5 with the property to the west within Washington County zoned R-6. The area is primarily single family neighborhoods with minimum lot sizes ranging from 5,000 square feet to 7,500 square feet. Proposal Description The applicant proposes to modify the Urban Forestry Plan approved under the Estates at Aspen Ridge subdivision review (SUB2015-00010). This modification request is to remove two sequoias in the northwest corner, which were originally planned for preservation. Removal is now needed due to lack of adequate protection. The trees are located within the building pad for Lot 1 and protection fencing was only proposed at 50 percent of the dripline radius resulting in insufficient protection for the tree roots. The applicant has stated that moving the building pad for Lot 1 in order to save the sequoias is not feasible. The modification also includes planting only 12 street trees, the original plan included planting 48 trees creating a dense monoculture in the backyards of each lot, which is not sustainable due to constrained growing space, and occupies any usable backyard space for each lot. The revision retains the 40 percent overall canopy coverage requirement for the site. The proposed revisions are not exempt from the Type I modification review outlined in the Tigard Community Development Code section 18.790.090 (Modification to the Urban Forestry Plan Component of an Approved Land Use Permit). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.790 Urban Forestry Plan: 18.790.030 Urban Forestry Plan Requirements A. Urban forestry plan requirements.An urban forestry plan shall: 1. Be coordinated and approved by a landscape architect(the project landscape architect) or a person that is both a certified arborist and tree risk assessor(the project arborist),except for minor land partitions that can demonstrate compliance with effective tree canopy cover and soil volume requirements by planting street trees in open soil volumes only; A revised Urban Forestry Plan that was coordinated and approved by certified arborist/tree risk assessor, Morgan Holen (the project arborist) has been submitted.This standard is met. 2. Meet the tree preservation and removal site plan standards in the Urban Forestry Manual (UFM); A revised tree preservation and removal site plan that meets the standards set forth in the Urban Forestry Manual has been submitted.This standard is met. 3. Meet the tree canopy site plan standards in the Urban Forestry Manual;and A revised tree canopy site plan that meets the standards set forth in the Urban Forestry Manual has been submitted. In addition, the project arborist has included a signature of approval and statement attesting that the revised tree canopy site plan meets all of the requirements in Section 10, Part 2 of the Urban Forestry Manual.This standard is met. 4. Meet the supplemental report standards in the Urban Forestry Manual. UFR2017-00003 Estates at Aspen Ridge Urban Forestry Plan Modification 2 The site is zoned R4.5; accordingly, the minimum required effective tree canopy for the entire site is 40 percent (Section 10, Part 3, Subsection M of the Urban Forestry Manual). The revised supplemental report (dated August 7,2017) showed a site effective canopy of 41.8%. As conditioned this standard is met. 18.790.070 Modification to the Urban Forestry Plan Component of an Approved Land Use Permit C. Application procedures. Modifications to the urban forestry plan component of an approved land use permit that are not exempted by subsection B of this section shall be processed as a Type I procedure, using approval criteria contained in subsection D of this section. The proposed modification to the Urban Forestry Plan Component of the approved Estates at Aspen Ridge Subdivision does not meet the exemptions listed under subsection B; therefore, this modification shall be processed as a Type I procedure using the following approval criteria: D. Approval criteria. The director shall approve the modification to the urban forestry plan component of an approved land use permit upon determining: 1. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; The project arborist provided a report and statement certifying that the previously approved Urban Forestry Plan did not account for the circumstances that led to the proposed modification. The original plan assumed that adequate protection would be possible for the trees in the northwest corner. The original plan proposed protection fencing at 50 percent of the dripline. In the opinion of Morgan Holen, current project arborist, protection fencing is needed at the dripline if not more in order to provide adequate protection to the trees roots. Due to the lack of adequate protection the Arborist has recommended the trees be removed. This criterion is met. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and The previous plans did not account for the grading and impacts associated with Lot 1. Therefore, the Arborist has stated there is no practicable alternative to the proposed modification. This criterion is met. 3. The project arborist or landscape architect demonstrates through a revised urban forestry plan, compliance with Section 18.790.030. The project arborist submitted revised effective tree canopy cover data and tree removal plan to demonstrate compliance with Section 18.790.030. The revised conditions below reflect the proposed Urban Forestry Modifications.As conditioned this criterion is met. FINDING: As demonstrated in the analysis above, and revised conditions below the proposed modification to the Urban Forestry Plan Component of the approved Estates at Aspen Ridge meets all applicable approval criteria, and can be approved as conditioned.. CONDITION: 1. Prior to any site work, the applicant shall provide a fee in the amount of$464 for the city's cost of collecting and processing the inventory data for the entire urban forestry plan 12 planted trees($156 first tree + $308 ($28 x 11)= $464). Fees subject to change every July. 2. Prior to any site work, the applicant shall provide a tree establishment bond in the amount of$6,192 (12 planted trees x$516/tree). The proposed modifications to the previously approved Urban Forestry Plan provided in this report shall be processed as a Type I procedure which requires a$711 fee to the City. Scope of Work and Limitations Morgan Nolen &Associates (MHA)was contracted by Westwood Homes to review and modify the previously approved Urban Forestry Plan for the project,which MHA did not prepare. Westwood Homes provided MHA with copies of the City's Notice of Type II Decision,tree inventory data prepared by arborist David Hunter, a preliminary grading plan depicting tree protection, and a landscape and tree plan showing proposed tree planting and canopy cover calculations.This report is written per the Urban Forestry Plan—Supplemental Report Requirements provided in Section 10, Part 3 of the City's Urban Forestry Manual. MHA reviewed the existing information provided to us and is recommending modifications to the approved plan for two reasons: 1)trees 20 and 21,which were originally planned for retention, cannot be adequately protected with proposed building on lot 1 and should be removed for construction; and, 2)the approved planting plan includes a dense monoculture of 30 hedge maples (Acer Campestre) in rear yards,which is not sustainable due to constrained growing space, and occupies any useable yard space for residents. The modified planting plan does not include any rear yard planting;the effective canopy cover requirements are satisfied by changing the proposed species of the 12 other trees planted along streets and adjacent to a proposed wood chip trail at lot 1. This report describes the existing trees located on the project site based on David Hunter's tree inventory, provides arborist recommendations for tree removal,describes the effective tree canopy cover needed to meet City requirements, and addresses the criteria for modifications to the Urban Forestry Plan component of an approved Land Use Permit contained in Section 18.790.070 of the City's Community Development Code and the City's Conditions of Approval items 1-5. General Description The existing tree inventory data describes 25 existing trees and recommends retention of trees 20 and 21,two giant sequoias (Sequoiadendron giganteum) located on proposed lot 1,with protection fencing located no less than 50%of the 25-foot radius dripline.Trees 20 and 21 are located within the allowable building footprint of lot 1 where grading and building are proposed, and adequate protection is not possible. In our opinion, protection is needed at the dripline of these trees at a minimum; even if the protection fencing could be installed at 50%of the dripline area,this distance would be insufficient to provide adequate protection.Therefore, all 25 inventoried trees are recommended for removal. A description of individual trees as inventoried by David Hunter is included in the enclosed existing tree inventory data (attachment A). Urban Forest Plan—Supplemental Report Estates at Aspen Ridge Subdivision,Tigard,Oregon Page 2 Effective Tree Canopy Cover A summary of the effective tree canopy cover by lot and across the overall development site is included as attachment B. Attachment C,the planted tree inventory, describes 12 individual trees proposed for planting. The required number of street trees is based on the lineal right-of-way frontage divided by 40.The total frontage is 316.51-lineal feet (not 270 lineal feet as described in the City's Decision which failed to account for the new access to lots 1-3 from SW Viewcrest Court).Therefore, eight street trees are required (as opposed to six described in the City's Decision). Of the 12 individual trees proposed for planting, nine are street trees located within 6-feet of rights of way,two are located adjacent to the proposed wood chip trail on the north side of lot 1, and one is located in the front yard of proposed lot 2. In roughly the same locations,the original planting plan proposed 12 Sunset maples (Acer truncatum x Acer platanoides), but the modified planting plan proposes four katsuras (Cercidiphyllum japonicum) and eight Oregon white oaks (Quercus garryana).The proposed street trees provide the closest and best spacing possible, and comply with the street tree planting standards in Section 2 of the Urban Forestry Manual and with the soil volume standards in Section 12. The 30 hedge maples proposed in rear yards in the original planting plan have been omitted from the modified planting plan.The effective tree canopy cover requirements are satisfied without these trees based on changes to the species mix for the 12 trees to be planted. The four katsuras provide a total of 5,024-square feet of effective tree canopy cover area. Note that 125%canopy credit is provided for the eight native Oregon white oaks,for a total of 19,630-square feet of effective tree canopy cover area.The table below provides a summary of the effective tree canopy cover by lot/tract and demonstrates that the 15% minimum effective tree canopy cover per lot/tract requirement is satisfied. The Tree Preservation and Removal Site Plan and Tree Canopy Site Plan are enclosed as attachments D and E as required by Section 10 of the Urban Forestry Manual, which illustrate how the Urban Forestry Plan requirements are met. Specifications A. Tree Protection Specifications None of the existing trees are proposed for retention,therefore tree protection specifications are not provided. Soil Characteristics and Specifications for Improvement Native soils at the project site are moderately well drained Cornelius and Kinton silt loams. Prior to the installation of new trees,the landscape contractor should excavate to a depth of 36-inches and replace the planting substrate with amended topsoil.Topsoil amendments should be determined by the landscape contractor. If soil compaction occurs during construction,the project arborist should provide additional recommendations as needed. C. Tree Planting Specifications New trees that are planted to meet the effective canopy requirements shall conform to the applicable standards in the Tigard Urban Forestry Manual.They shall be planted in accordance with the American National Standards Institute (ANSI)standards for tree planting(A300, Part 6) and additional standards adopted by the Oregon Landscape Contractors Board. Nursery stock shall meet the requirements of the American Association of Nurserymen for nursery stock (ANSI Z60.1)for Grade No.1 or better. Double stake trees if needed for stability. Criteria for Urban Forestry Plan Modifications Tigard Municipal Code Section 18.790.070 requires that any modification to the urban forestry plan component of an approved land use permit shall be processed as a Type I land use decision. There are exemptions to the Type I procedure,which are not applicable in this case.Therefore,the approval criteria in subsection D of this section are applicable: 1. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; The previously approved urban forestry plan did not provide adequate protection for two existing trees originally planned for retention. Removal of trees 20 and 21 is necessary for construction. Furthermore,the original planting plan overplanted the site with a monoculture of hedge maples that would not be sustainable and render back yards unusable. The proposed modifications recommend removal of trees 20 and 21, omit 30 hedge maples from the planting plan, and change the species and adjust the locations of 12 trees to be planted. The City's canopy cover requirements continue to be satisfied. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification;and There is no practicable alternative to the proposed modifications.Justifications for the proposed modifications have been described throughout this report. These changes provide the most practicable Urban Forestry Plan for the project and satisfy the City's requirements. 3. The project arborist or landscape architect demonstrates through a revised urban forestry plan,compliance with Section 18.790.030. This revised Urban Forestry Plan is provided in compliance with Section 18.790.030. Note that no tree canopy fee is required. Conditions of Approval The City's Conditions of Approval items 1-5 are related to tree protection and planting and require some discussion herein. Items 1 and 2 require tree protection site inspections and monitoring reports by the project arborist prior to any ground disturbance work to verify the installation of protection measures, and twice monthly thereafter during period of active site development and construction to document compliance with the Urban Forestry Plan. Since none of the existing trees are planned for retention,tree protection measures and monitoring by the arborist are not applicable. Urban Forest Plan—Supplemental Report Estates at Aspen Ridge Subdivision,Tigard,Oregon Page 4 Item 3 requires the applicant to submit a soil volume plan prior to site work to demonstrate that the soil volume standard is met.The proposed trees provide the closest and best spacing possible, and comply with the street tree planting standards in Section 2 of the Urban Forestry Manual and with the soil volume standards in Section 12. The proposed trees are not located in landscape islands, but in open areas between the street and homes, behind sidewalks, and adjacent to a wood chip trail that will not restrain tree roots.The available growing space is well in excess of 500-cubic feet for each of the 12 proposed trees. Item 4 describes the required Urban Forest Inventory fee. Based on the proposed Urban Forestry Plan modifications,the applicant shall provide a fee in the amount of$464 prior to any site work for the City's cost of collecting and processing inventory data for the entire Urban Forestry Plan for 12 planted trees ($156 first tree+$308 ($28 x 11) =$464). Item 5 describes the required Tree Establishment Bond. Based on the proposed Urban Forestry Plan modifications,the applicant shall provide a tree establishment bond in the amount of$6,192 prior to any site work(12 planted trees x$516/tree).
