Not integral to the roof structure of the dwelling 2. Is exempt work included in the valuation? 3. Does construction "timing" affect work that is exempt from permit? Answers: 1. See (a) and (b) below: a. No. If the roof structure of the patio cover(s) in question is integral to the roof structure of the regulated dwelling, it is subject to plan review and inspection accordingly, to the extent that it affects the regulated elements of the structure. If the customer does not wish for any part of the exempt portion of construction be reviewed or inspected, they would need to demonstrate that it is not integral to any element of the regulated construction. b. Yes 2. No, a jurisdiction cannot collect fees for work that is exempt. The exemption from permit exempts associated valuation and fees. 1 3. So,while the porch might be exempt as a stand-alone project,the fact that it is part of a new dwelling makes it a part of the SFR and it should be regulated. Does that porch also serve as the required landing? Likely yes, and so that is reason enough to regulate it. If, however, the permit for the new dwelling were completed and finaled and the porch were built after-the-fact, I would not require the permit. The initial submittal included a covered front porch. The applicant made the decision to eliminate the front porch and submitted a revision to that effect. Now the applicant has decided to put the covered porch back on. The porch is 180 square feet, and the surface of the walking surface is less than 30 inches above grade. In the exempt work a covered porch less than 200 square feet is clearly listed. So, the question is 1) When determining the valuation for a new home do you remove or not consider the valuation of the covered porch when it is less than 200 square feet? 2) Does the fact that it is a new single family residence and the porch is being constructed as a part of a larger and thereby permitted structure change things?
