The applicant shall plant a replacement tree for each tree removed in accordance
with the Street Tree Planting Standards in Section 2, part 1 of the Urban Forestry
Manual. Existing trees may be considered as replacement trees if they meet all
applicable species, size, condition and location requirements in Section 2, part 1
and were not already required to be planted or preserved by the Tigard Municipal
Code.
This decision is final and valid for a period of up to one year after issuance unless
otherwise specified. Nothing prevents you from submitting another tree permit
application if the conditions and circumstances surrounding this removal have
changed.

To Whom It May Concern
On February 12, 2018, Marble Tree Service performed work at 10205 SW Murdock St in
Tigard. We removed a Scots pine tree in the front yard of the home. The tree was between
the fence and an adjacent Western redcedar.
It was my understanding that the tree we were contracted to remove was not within the
public right of way and did not fall into any other category of tree that would require a
permit. It was not a street tree by the traditional definition (one being planted between a
sidewalk and the street) and it was also roughly 10' from the street.
The tree was leaning considerably and a large portion of the root plate had been buried by a
previous property owner. There were signs of decay around the trunk that were evident
when the soil was removed from around the trunk. The customer claimed that the tree had
increased in lean since they had first moved in. There were considerable amounts of
deadwood in the tree. The tree also had a noticeably weak foliar density. The tree's
placement between a healthy Western redcedar and a large Douglas fir was also a
consideration in the decision to remove the tree. Removing the tree would allow for the
Western redcedar to thrive and not be damaged by the pine in the event of failure of the
tree.
Both myself and the customer acted in the understanding that to remove the tree,no
municipal statutes would be broken and that this course of action was justified within the
law. Allowing that the tree somehow falls into a regulated category,it still was never the
intent of either party to circumvent the law or to avoid filing the necessary paperwork.
