Mr. Porter, I'm sorry I missed speaking with you yesterday when you discussed your Fido's project and related permits
with some of my associates here at the city. I understand that you are scheduled to open for business this weekend and
I know that my colleagues are doing everything they can to get your change of use building permit, BUP2018-00008,
completed and approved this week.
One of the items that is involved in issuing any permit is identifying and receiving payment for any fees associated with
the permit and that brings the process over to my desk. I am the city's Permit Coordinator and one of my duties is
calculating any transportation or parks System Development Charges (SDCs)that apply to a permit. Your permit is for a
"change of use" and any change in use calls for a comparison of the transportation and parks SDCs that were assessed
against the prior use with those that are assessed against the proposed use.
In this case the prior use was "General Retail," and SDC charges for a general retail use were assessed against the space
when Walmart constructed it. The governing transportation SDC is Washington County's Transportation Development
Tax(TDT) and your proposed use of the space falls into the TDT category of"Drinking Place/Bar" on the County's tax
schedule.
I have attached copies of my TDT and Parks assessment of the SDCs that will be due at issuance of your change of use
permit. Please note that in both cases the charges that would be assessed now for the prior use have been subtracted
from the charges that would be assessed against your proposed use alone to yield a net total of"All TDTs and TSDCs Net
Increase. (The TSDCs do not yet apply to non-residential development.)
That net total of TDT fees due is$31,553. The equivalent figure for the Parks SDC is$6,157.
TDT charges can be offset in part or in full by applying TDT Credits earned by the developer of a project for construction
of public improvements related to the project. In this case, Walmart earned a large amount of TDT credits and those
credits can be applied to a third party completion of construction and use of a part of the overall project, in this case,
some of those credits could be applied to reduce or eliminate the TDT charges for your project. Unfortunately,there are
no Parks Credits that could be applied to the Parks SDC
I understand that, in discussing this with my colleagues yesterday,you indicated that it was your understanding that all
SDCs except sewer were taken care of through Walmart. Unfortunately,we have no record that Walmart instructed the
city to deduct any amount from their credit total to be applied to cover your TDT charges.
In order to make such a transfer we would have to receive a signed letter from Walmart, Inc., directing the city to deduct
your$31,553 TDT charge from their credit voucher(Credit Voucher Number TDT2015-00001.)
Please contact the Walmart representative you have been working with and ask him or her to provide us with such a
letter. Or, if indeed the TDT charges were covered previously by such a transfer from their Credit Voucher, ask them to
fax or email a copy of the authorization letter for that transaction to my attention: Fax: 503-718-2748,

The sooner we receive instructions from Walmart about a transfer of credits,the sooner we can complete work on
issuing your permit. To expedite action on your permit as much as possible I am copying our Building Permiit

Subject: BUP2018-00006, Fido's
BUP2018-00006 is a Change of Use permit for a new tenant. Accordingly, I have added TDT and Parks
charges. However, there was a previous BUP, BUP3027-00124 for the landlord work for this same tenant. TDT and
Parks were entered as fees on that BUP but are not shown in the payment history.
On the one hand, I don't think we charge SDCs on landlord work permits so that may explain why nothing was paid. On
the other hand, this is one of the Walmart buildings and there should still be plenty of TDT Credits for Walmart that they
could apply to this tenant space ... so maybe that was done when BUP2017-00124 was processed?
And if not, then my read is that TDT and Parks SDCs are now due with this change of use permit and the applicant should
contact Walmart about having them apply some of their credits.
Do either of you know whether the applicant has been told to check with Walmart?
