SECTION II. DECISION
Notice is hereby given that the City of Tigard Community Development Director's designee has
APPROVED the above request. This Temporary Use Permit shall be valid from January 19, 2018 to
January 19,2019.The findings and conclusions on which the decision is based are noted in Section IV.
THIS APPROVAL SHALL BE VALID FOR ONE YEAR
FROM THE EFFECTIVE DATE OF THIS DECISION.

SECTION III. BACKGROUND INFORMATION
Site Information:
The subject property is Lot 1 of the Madeline Heights Subdivision,which was approved by the City of
Tigard Planning Division in June 2016 (Case No. SUB2016-00003). This approval was for a 16-lot
subdivision, located north of SW Summit Ridge Street, south of SW Bull Mountain Road,west of SW
132nd Terrace,and east of SW 133`"Avenue. The property is zoned Medium-Density Residential (R-7).
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
18.440 Temporary Uses:
18.440.050 Approval Criteria
C. Temporary sales office or model home. The approval authority shall approve or approve
with conditions a temporary sales office or model home,when all of the following are met:
1. The temporary sales office shall be located within the boundaries of the subdivision or
property in which the real property is to be sold; and
The proposed temporary sales office is located within the boundaries of the Madeline Heights Subdivision
on Lot 1.The real property to be sold includes the subject property.This criterion is met.
2. The property to be used for a temporary sales office shall not be permanently improved for
that purpose.
The applicant proposes to utilize 547 square feet of a detached, single-family dwelling as a temporary
sales office. Once the temporary sales use expires, the space will be utilized for residential purposes, as
part of the associated single-family dwelling.This criterion is met.

Notice:
Notice was mailed to the applicant and property owner.
Final Decision:
The decision of the Director on Type I Procedure is final on the date it is mailed or otherwise provided
to the applicant,whichever occurs first. The Director's decision may not be appealed locally and is the
final decision of the City.
THE DECISION IS FINAL ON JANUARY 18, 2018
AND BECOMES EFFECTIVE ON JANUARY 19, 2018

By means of a Type I procedure, as governed by Section 18.390.030,the director may approve,
approve with conditions or deny the use of any real property within the city as a temporary sales
office, offices for the purpose of facilitating the sale of real property, or model home in any
subdivision or tract of land within this city, but for no other purpose, provided the following
criteria are satisfied:
1. Temporary sales office.
a. The temporary sales office shall be located within the boundaries of the subdivision or tract of
land in which the real property is to be sold;
RESPONSE:
A. The temporary sales office will be located on Lot lof the recorded plat of Madeline
Heights, Condition is met.
b. The property to be used for a temporary sales office shall not be permanently improved for that
purpose.
RESPONSE:
B. The temporary sales office is temporary in nature to be used for the sales of homes in
Madeline Heights.. Upon completion of sales, the temporary sales office will be
converted into garage. Condition is met.
2. Model house.
a. The model house shall be located within the boundaries of the subdivision or tract of land
where the real property to be sold is situated;
b. The property to be used for a model house shall be a permanently designed dwelling structure.
