accommodate a full range of retail, office and civic uses with a city-wide and
even regional trade area. Except where nonconforming, residential uses are
limited to single-family residences which are located on the same site as a

entertainment, automotive equipment repair and storage, mini-warehouses,

Notice is hereby given that the City of Tigard Community Development Director's designee has
APPROVED the above request.The findings and conclusions on which the decision is based are noted in
Section IV.
THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN (18) MONTHS OF
THE EFFECTIVE DATE OF THIS DECISION,NOTED UNDER THE PROCESS AND
APPEAL SECTION OF THIS DECISION.
SECTION III. BACKGROUND INFORMATION
Site Information:
The project is located at 11595 SW Pacific Highway; north of SW Pacific Highway, west of SW 71"
Avenue, and east of SW 78th Avenue. The 0.36-acre site is made up of one tax lot (WCTM 1S136DB,
Tax Lot 200), and contains an existing 5,020-square-foot commercial building that was previously
occupied by a bulk sales use, with associated parking and landscaping. The site is zoned General
Commercial (C-G).
The subject development was originally approved under a Site Development Review by the City of Tigard
Planning Division in October 1993 (Case No. SDR93-0016). Additionally,in November 1999, the City of
Tigard Planning Division approved Tax Lot 200 and a neighboring property (WCTM 1 S 136DB,Tax Lot
501) for a new 4,693-square-foot commercial building, along with a 20 percent reduction to the
development's total off-street parking requirement (Case Nos. SDR1999-00014 and VAR1999-00018).
However,substantial construction of the approved plan did not begin within one-and-one-half years from
the date of approval,and therefore,the approval expired.
SECTION IV. PUBLIC COMMENTS
The Tigard Community Development Code requires that property owners within 500 feet of the
subject site be notified of the proposal, and be given an opportunity for written comments and/or oral
testimony prior to a decision being made. Staff mailed Notices of a Type II Proposal regarding this
Parking Adjustment to affected parties on October 30,2017. No public comments were received.
SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS
18.370 Variances and Adjustments
18.370.020.C.6 Adjustments to parking standards (Chapter 18.765)
a. Reduction from minimum parking requirements. By means of a Type II procedure, as
governed by Section 18.390.040, the director may authorize up to a 20% reduction in
the total minimum vehicle parking spaces required in 18.765.070.H when an applicant
for a development permit can demonstrate in a parking study prepared by a traffic
consultant or in parking data from comparable sites that:
i. Use of transit, demand management programs, and/or special characteristics
of the customer, client employee or resident population will reduce expected
vehicle use and parking space demand for this development, as compared to
standards Institute of Transportation Engineers (ITE) vehicle trip generation
rates and minimum city parking requirements;and

The applicant is requesting a Type II Parking Adjustment for 11595 SW Pacific Highway, in order to
reduce the minimum off-street parking requirement from 15 spaces to 12 spaces (20 percent). The
purpose of this adjustment is to accommodate a new sales-oriented retail use, which has a minimum
off-street parking requirement of 3.0 spaces for every 1,000 square feet (TDC Table 18.765.2). The
subject commercial building is 5,020 square feet in size.
The applicant submitted parking data from comparable sites that demonstrate how special
characteristics of the customer, client, and employee population will reduce expected vehicle use and
parking space demand at this development. The proposed tenant, Rack Attack, sells and installs car
racks. Based on the characteristics of the business, Rack Attack proposes to dedicate 1,295 square feet
of floor space for retail activities, 1,965 square feet for storage, and 1,760 square feet for a service bay
area,where employees install the products on customer vehicles.
Rack Attack operates a store of similar size (5,015 square feet) in downtown Portland (1737 SW
Morrison Street, Portland, OR 97205). This location maintains a similar breakdown of floor space
dedicated to business activities as the subject site: 1,786 square feet of floor space for retail activities,
2,027 square feet for storage, and 1,202 square feet of workshop space. The applicant's narrative states
that this location has operated for 18 years, and historically, peak parking demand at this location has
not exceeded six vehicles. The applicant has also provided parking data from a smaller Rack Attack
store (2,938 square feet) located in southeast Portland (704 SE Washington Street,Portland, OR 97214)
that has operated for seven years,with a historical peak parking demand of four vehicles.
Furthermore, the applicant states that Rack Attack has a relatively low parking demand because in-store
transactions typically make up only 65 percent of sales, with the remaining 35 percent of transactions
being conducted online or by mail.
Therefore, staff finds that the parking data from comparable sites provided by the applicant,and special
characteristics of the proposed business (such as the ratio of in-store to off-site transactions)
demonstrate that expected vehicle use and parking space demand will be reduced at this specific
development. Staff concludes that the subject site will have adequate parking, even with the proposed
20 percent reduction to the minimum off-street parking requirement.This criterion is met.
ii. A reduction in parking will not have an adverse impact on adjacent uses.
The applicant submitted a narrative and parking data from comparable sites that conclude expected
vehicle use and parking space demand will be reduced at the proposed Rack Attack store, located at
11595 SW Pacific Highway. The applicant has also demonstrated that Rack Attack customer and
employee parking can be adequately accommodated on site. Therefore, vehicle traffic associated with
this business is not expected to overflow onto neighboring properties. On-street parking is also
prohibited along the site's frontage on SW Pacific Highway. Furthermore, there are site-specific
characteristics that lessen the likelihood of off-site impacts from the proposed adjustment, such as the
development's access to alternative modes of transportation. In particular, the site is well-served by
transit, with multiple TriMet bus lines running along SW Pacific Highway, adjacent to the site.
Therefore, staff concludes the requested 20 percent reduction to the minimum off-street parking
requirement will not adversely impact or disrupt adjacent uses, which are primarily commercial. This
criterion is met.
18.360 Site Development Review:
18.360.060 Minor Modification(s) to Approved Plans or Existing Development
C. Approval criteria.A minor modification shall be approved, approved with conditions or denied
following the director's review based on the finding that:

1. The proposed development is in compliance with all applicable requirements of this
title;and
The applicant has proposed a change of use for the subject 5,020-square-foot commercial building from
bulk sales to sales-oriented retail, which primarily affects off-street parking requirements. Staff finds 12
parking spaces are required for the subject site, taking into consideration the change of use discussed
above,and the requested 20 percent reduction to the site's minimum off street parking requirement (which
is further detailed in Section 18.370 of this administrative decision). Based on the applicant's submitted site
plan,staff concludes there is adequate parking at the subject site,with 12 spaces provided.
The applicant also proposes to: add a new exterior overhead door to the front facade of the existing
commercial building; remove 189 square feet of landscaping in order to update the layout of the on-site
parking lot for ADA compliance; and construct a new on-site pedestrian walkway. No changes to the
footprint of the existing commercial building are proposed. Based on the applicant's materials, staff finds
the proposed overhead door meets all applicable development standards for the C-G zone, as outlined
in TDC Table 18.520.2. Additionally, staff reviewed the applicant's site plan to confirm the project
continues to exceed the 15 percent minimum landscape requirement for the C-G zone (TDC Table
18.520.2), even with the proposed 189-square-foot landscaping reduction, and that the proposed
walkway meets the on-site pedestrian walkway standards for location, design, and pedestrian safety, as
outlined in TDC 18.705.030.F.
Upon review of the applicant's materials, staff finds that all other applicable requirements are met. This
criterion is met.
2. The modification is not a major modification.
Staff finds that the changes listed in TDC 18.360.050.B.1-11 are either satisfied or do not apply.Therefore,
the proposed development is not a major modification.This criterion is met.
SECTION VI. OTHER STAFF COMMENTS
The City of Tigard Building Division, Engineering Division, Police Department, Public Works
Department, and Senior Transportation Planner were sent copies of the applicant's proposal, and had
no objections.
SECTION VII. AGENCY COMMENTS
The Oregon Department of Transportation, TriMet, and Tualatin Valley Fire and Rescue were
sent copies of the applicant's proposal,and had no objections.

this decision in accordance with Section 18.390.040.G.2 of the Tigard Community Development Code,
which provides that a written appeal together with the required fee shall be filed with the Director within
ten (10) business days of the date the Notice of Decision was mailed. The appeal fee schedule and forms

Unless the applicant is the appellant, the hearing on an appeal from the Director's Decision shall be

The decision of the Director (Type II Procedure) or Review Authority (Type II Administrative Appeal or Type III
Procedure) is final for purposes of appeal on the date that it is mailed. Any party with standing as provided in Section
18.390.040.G.1 may appeal this decision in accordance with Section 18.390.040.G.2 of the Tigard Community
Development Code,which provides that a written appeal together with the required fee shall be filed with the Director

Project Description:
The site is located on tax map I S 136DB on lot number 200. It is 0.36 acres of land located on
SW Pacific Hwy. It is considered part of the general commercial (C-G) zone, of which the
proposed use of retail is permitted, The site was previously developed and has an existing 5,020
square foot retail building on the site with 12 parking stalls, landscape, and signage. There are no
setback requirements for the C-G zone and the building covers 32% of the site, which is less
than the 85% maximum. The existing building is clearly visible from SW Pacific Highway and will
remain the same height of 16'-8.''
The existing building was previously occupied by a bulk-retail use and is now vacant. A new
sales-oriented retail business, Rack Attack, will be leasing the building. Rack Attack sells and
installs car racks. The project is an exterior remodel for the new tenant to replace one
storefront system with a sectional fully glazed overhead door, removal of the fabric awnings, and
new exterior paint. The parking layout will be adjusted to accommodate code-compliant ada
parking and clearance for the drive-in door. Two compact stalls are created to generate space
for the drive-in door, along with the removal of two stalls, However, an extra space is taken out
of the landscape island towards the west to accommodate the number of parking spaces
needed, 15 stalls are determined to be required by the city, with the main use being sales-
oriented retail. A Type II parking adjustment will be sought in order to reduce the number of
required stalls to meet the actual needs of rack attack as well as the physical limitations of the
site.The attached site plan indicates a total of 12 parking stalls, which includes 2 stalls located in
front of the new service bay, which meets minimum parking requirements with a 20% reduction.
With these adjustments the site maintains 18% landscaping

governed by Section 18,390.040,the director may authorize up to a 20% reduction in the total

permit can demonstrate in a parking study prepared by a traffic consultant or in parking data

customer, client employee or resident population will reduce expected vehicle use and parking
space demand for this development, as compared to standards Institute of Transportation

ii. A reduction in parking will not have an adverse impact on adjacent uses.
Compliance:
As part of this Parking Adjustment Proposed, we are requesting an a reduction to the minimum
- parking requirement by 20%vehicle parking stalls, from the required 15 parking stalls to 12

SUITE 200 the number of stalls allowed for parking, and the new tenant needs approximately half of the

facilities meets the business's needs. Please see attached letter by Graeme Patterson for detailed
description of these locations.
The proposed site will have 12 parking stalls, which is expected to amply serve Rack Attack.
Each of the precedents described above are operating efficiently with their available parking
stalls, even at peak hours. With this information, it is believed that the proposed location in
Tigard will operate efficiently with 12 stalls. In addition,there is a bus stop in front of the
neighboring property to the west that employees or customers can use if applicable.
Chapter 18.390 Decision-Making Procedures
8.390.040.B.2.e
2, Submittal Information, The application shall:
e. Include an impact study.The impact study shall quantify the effect of the development on
public facilities and services. The study shall address, at a minimum,the transportation
system, including bikeways,the drainage system, the parks system, the water system,the
sewer system, and the noise impacts of the development. For each public facility system and
type of impact,the study shall propose improvements necessary to meet City standards and to
minimize the impact of the development on the public at large, public facilities systems, and
affected private property users. In situations where the Community Development Code
requires the dedication of real property interests,the applicant shall either specifically concur
with the dedication requirements, or provide evidence which supports the conclusion that the
real property dedication requirement is not roughly proportional to the projected impacts of
the development
Compliance:
ARCHITECTURE The proposed site will not impact the existing transportation system, as there is a path for the
bus to take right in front of the property to the west, We are not changing any access points,
E N G I N E E R I N G curb cuts or sidewalks,therefore also not impacting bikeways. As for the drainage system, water
P E A N N I N G system and sewer system,the existing building that was previously leased to Bed Mart is not
changing besides the exchange of a storefront system to an overhead door,therefore not

impacting any of these systems. The only noise that may be heard over the sound of cars driving
past the site is the opening and closing of the overhead door, which should be very minimal.
The site is not located in a park district. It is believed that this remodel will have very little, if
any, adverse impacts on the site and surrounding sites

Regarding our application for Type 2 parking reduction at the 11595 SW Pacific
Highway. This is supporting information from our existing two retail locations in
Portland to be considered.
Rack Attack has 11 locations across the USA and Canada, our locations can be
various sizes but the split between retail showroom/storage/workshop is very
similar. The parking requirements are generally low as we are a destination store,
not drive by drop in driven. Usually customers find us through our website and our
brand partners, Thule and Yakima who support our locations through their own
marketing.
We are excited by the prospect of a 3rd Oregon store and would be happy to provide
whatever information you require about our businesses. I've gone through a
detailed description below of our two nearest stores to Tigard.
Portland Downtown — 1737 SW Morrison St, Portland, 97205
This business has been operating for 18 years helping local customers get their
outdoor gear on their vehicles and enjoy the outdoors. The split regarding space is
similar to our plan for the Tigard building.
Parking spaces: 5 stalls
Total building size: 5015 sqft
Store retail: 1786sgft
Workshop space: 1202 sgft
Storage: 2027 sgft
No of employees on average 3-4 per day, staff can park in the workshop when
required, sometimes they will use one bay of the customer parking.
Invoice count per day averages at 16 over the year with large average invoice
dollars. On a busy day customer parking may have 3 cars and install bays have 3
cars. Instore business accounts for 65% of the total and mail order the other 35%,
this puts less stress on parking requirements.

Response: The floor area will not be increasing. The only changes are to the exterior shell and the

Narrative
Description of proposed changes:
The site is located on tax map I S 136DB on lot number 200. It is 0.36 acres of land located on SW Pacific Hwy. It is
considered part of the general commercial (C-G) zone, of which the proposed use of retail is permitted. The site was
previously developed and has an existing 5,020 square foot retail building on the site with 12 parking stalls, landscape,
and signage.There are no setback requirements for the C-G zone and the building covers 32% of the site,which is
less than the 85% maximum. The existing building is clearly visible from SW Pacific Highway and will remain the same
height of 16'-8."
The existing building was previously occupied by a bulk-retail use and is now vacant. A new sales-oriented retail
business, Rack Attack, will be leasing the building. Rack Attack sells and installs car racks. The project is an exterior
remodel for the new tenant to replace one storefront system with a sectional fully glazed overhead door, removal of
the fabric awnings, and new exterior paint. The parking layout will be adjusted to accommodate code-compliant ada
parking and clearance for the drive-in door.Two compact stalls are created to generate space for the drive-in door,
along with the removal of two stalls. However, an extra space is taken out of the landscape island towards the west
to accommodate the number of parking spaces needed. 15 stalls are determined to be required by the city, with the
main use being sales-oriented retail. A Type II parking adjustment will be sought in order to reduce the number of
required stalls to meet the actual needs of rack attack as well as the physical limitations of the site.The attached site
plan indicates a total of 12 parking stalls, which includes 2 stalls located in front of the new service bay,which meets
minimum parking requirements with a 20% reduction. With these adjustments the site maintains 18% landscaping.
