The findings and conclusions on which the decision is based are noted in Section IV. CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED PRIOR TO ISSUANCE OF BUILDING PERMITS: The applicant shall prepare a cover letter and submit it, along with any supporting documents and/or plans that address the following requirements to the PLANNING DIVISION,ATTN: LINA SMITH (503)718-2438 or LinaCS(u,tigard-or.gov. The cover letter shall clearly identify where in the submittal the required information is found: 1. Prior to issuance of building permits, the applicant shall submit documentation of approval from the franchised hauler, Pride Disposal, for the proposed mixed solid waste and recyclable storage area. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located at 11701 SW Pacific Highway; north of SW Pacific Highway, south of SW Pfaffle Street,west of SW 78`" Avenue, and east of Highway 217. The subject tenant space is 3,042-square-foot commercial building that was previously occupied by a fast-food eating and drinking establishment (Arby's) with a drive-in facility. The building is located on a 3.07-acre tax lot that includes one (1) additional commercial building, 159 parking spaces, and associated landscaping. In June 2017, the applicant was approved for a minor modification to the subject site (Case No. MMD2017-00022), in order to accommodate a new tenant (Starbucks). The applicant now proposes additional changes to the approved site plan from Case No. MMD2017-00022.The site is zoned General Commercial (C-G). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: Section 18.360.060.0 states that a Minor Modification shall be approved, approved with conditions or denied following the Director's review and as follows: 1. The proposed development is in compliance with all applicable requirements of this title; and FINDING: The applicant is proposing a minor modification to an approved plan for Starbucks at 11701 SW Pacific Highway. Specifically, the applicant proposes to: a. Remove and replace an existing mixed solid waste and recyclable storage area. Staff reviewed the applicant's site plan and elevation drawings to confirm the proposed storage area complies with TDC 18.755.050 Location, Design and Access Standards for Storage Areas. Furthermore, staff has included a condition for the applicant to provide documentation of approval from the MMD2017-00039 Starbucks 2 franchised hauler,Pride Disposal,prior to building permit issuance. b. Create two (2) new on-site pedestrian walkways, which will connect to the proposed Starbucks building. One (1) walkway will be located on the west side, to provide a connection to the mixed solid waste and recyclable storage area, and one (1) walkway will be located on the east side, to provide a connection to SW 78th Avenue. The walkways will also incorporate handrails, ramps, and curbs that comply with ADA standards. Staff reviewed the applicant's site plan to determine that this proposal meets the on-site pedestrian walkway standards for location, design, and pedestrian safety, as outlined in MC 18.705.030.F. c. Update the existing on-site landscaping. In June 2017, the City of Tigard Planning Division approved the subject site for a minor modification (Case No. MMD2017-00022), in order to accommodate the new tenant, Starbucks. In this decision, staff determined the site exceeded the 15 percent minimum landscape requirement for the C-G zone (MC Table 18.520.2). As the applicant proposes to install additional landscaping to the site, staff finds the total on-site landscaping will continue to exceed this minimum requirement. d. Install a new asphalt curb at the existing on-site vehicle stacking lane. Staff reviewed the applicant's site plan to confirm the proposed curb will not modify the length of the on-site vehicle stacking lane, and it will continue to meet the minimum stacking lane requirement for drive-in restaurants (200 feet), as outlined in TUC Table 18.765.1. Upon review of the applicant's plans and narrative, staff finds that all other applicable requirements are met.This criterion is met. 2. The modification is not a major modification. FINDING: Staff finds that the changes listed in 'l'DC 18.360.050.B.1-11 are either satisfied or do not apply.Therefore, the proposed development is not a major modification.This criterion is met. CONCLUSION: The proposal is a minor modification of an approved plan, and is in compliance with the applicable requirements of this Title. SECTION V. The site is situated at the northwest corner of SW Pacific Highway and 78th Avenue.The proposed Starbucks coffee shop will include a 2,316 SF building with an outdoor seating area and drive-thru services. The narrative below addresses each of the evaluation criteria included in TDC 18.360.050.B.1-11. 1. An increase in dwelling unit density,or lot coverage for residential development; Response:Commercial use,not applicable. 2. A change in the ratio or number of different types of dwelling units; Response:Commercial use,not applicable. 3. A change that requires additional on-site parking in accordance with Chapter 18.765; Response:The previous use of the building was an Arby's fast food restaurant,per discussions with Tigard Planning Department, the proposed Starbucks will be considered a fast food eating/drinking establishment,and therefore no additional on-site parking should be necessary. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code; Response: The proposed commercial structure and construction type are A2 VB. 5. An increase in the height of the building(s) by more than 20%; Response:The proposed building height is 17'-0",and the existing building height is approximately 15'-7". The increase in building height does not exceed 20%. 6. A change in the type and location of access ways and parking areas where off-site traffic would be affected; Response:Based on the attached site plan,there are no proposed changes in type or location of access ways and parking areas.Site work will be limited to like-for-like asphalt pavement and sidewalk replacement as necessary for ADA compliance;replaced drive-thru equipment for Starbucks'needs;a proposed dumpster enclosure for Starbucks'needs;modified curb at the proposed drive-thru window location;and brand directional signage and pavement markings. The proposed dumpster enclosure will not result in any changes to the parking spaces west of the building. It should also be noted that two crosswalks are proposed;one providing an accessible route to the public way,and one providing a route to the proposed Tigard, OR 2 of 3 11 September 2017 trash enclosure for employee use. The modified/replaced curb at the drive-thru window is for the new pick-up window location. The new window location will result in a longer drive-thru stacking lane. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day; Response:Per letter provided by Kittleson&Associates dated April 17,2017: "the proposed drive-through coffee-shop development is expected to generate fewer daily trips compared to the former drive-through fast-food restaurant use". A trip generation estimate was also provided. The letter is attached with the submittal for reference. 8. An increase in the floor area proposed for a nonresidential use by more than 10%excluding expansions under 5,000 square feet; Response:There is no increase in floor area proposed. Due to the removal of the freezer/cooler used by Arby's,and the removal of the atrium area, there will be a net decrease in floor area. 9. A reduction in the area reserved for common open space and/or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10%; Response:Not applicable,no proposed change to common open space or usable open space. 10. A reduction of project amenities below the minimum established by this code or by more than 10%where specified in the site plan: a. Recreational facilities; Response:Not applicable, no proposed changes to recreational facilities,however,the proposal does include an outdoor seating area. b.Screening; and/or Response:There will not be a reduction of screening.Screening of mechanical units is proposed, and landscape screening of the dumpster enclosure is proposed. c. The enclosure allows for straight on access as long as there are not vehicles parked directly across from the enclosure. The inside dimensions of the enclosure are at least 20' wide and 10' deep. Some of the other requirements may not be detailed on the site plan but these requirements also need to be met: • The gates need to be hinged in front of the walls,not inside the walls,to allow for the full 20' opening. • The gates need to open to at least 120 degrees. • The gates need cane bolts and holes put in place for the gates to be locked in the open and closed position.The holes for the gates to be held open need to be at the full 120 degree opening angle. • 25' of overhead clearance is required.
