APPLICATION SUMMARY FILE NAME: Tesla CASE NO.: Minor Modification (MMD) MMD2017-00033 PROPOSAL: The applicant proposes a minor modification to off-street parking at Washington Square Mall,in order to accommodate six (6) new electric vehicle charging stations. As a result of this modification, the total off-street parking count for the Washington Square shopping center will be reduced to 6,797 spaces. The MUC zoning district includes land around the Washington Square Mall and land immediately west of Highway 217. Primary uses permitted include office buildings, retail, and service uses. Also permitted are mixed-use developments and housing at densities of 50 units per acre. Larger buildings are encouraged in this area with parking under, behind or to the sides of buildings. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.360.060.0 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. NINID2017-00033 Tesla 1 THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located at 9321 SW Washington Square Road, Suite T05; south of SW Hall Boulevard, east of Highway 217, and west of SW Greenburg Road. The property is located on a 46.24-acre tax lot (WCTM 1S126, Tax Lot 300), and is part of the larger Washington Square shopping center. The property is zoned Mixed Use Commercial (MUC), and is located in the Washington Square Regional Center Plan District. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: Section 18.360.060.0 states that a Minor Modification shall be approved, approved with conditions or denied following the Director's review and as follows: 1. The proposed development is in compliance with all applicable requirements of this title; and FINDING: The applicant proposes to create six (6) new electric vehicle charging stations at Washington Square Mall, which will modify the off-street parking count for the overall Washington Square shopping center; accordingly,that is the main focus of this review. In March 2016, the City of Tigard Planning Division (Case No. MMD2016-00012) determined the minimum off-street parking requirement for all existing uses in the Washington Square shopping center was 3,531 spaces, and concluded there was adequate off-street parking,with 6,803 spaces provided. No subsequent land use approvals have been issued for the shopping center that would impact off-street parking requirements. The applicant proposes to convert six (6) existing off-street parking spaces into electric vehicle charging stations. Accordingly, the new total off-street parking count for the Washington Square shopping center will be 6,797 spaces. Even after the proposed reduction of six (6) parking spaces, staff concludes there is still adequate parking on site,with a surplus of 3,266 parking spaces. Upon review of the applicant's plans and narrative, staff finds that all other applicable requirements are met. This criterion is met. 2. The modification is not a major modification. FINDING: Staff finds that the changes listed in '1'DC 18.360.050.B.1-11 are either satisfied or do not apply. Therefore, the proposed development is not a major modification. This criterion is met. CONCLUSION: The proposal is a Minor Modification of existing site development and is in compliance with the applicable requirements of this Title. M1\1I)2017-00033 Tesla 2 SECTION V.
