ORDINANCE No.72-_
AN ORDINANCE CHANGING THE NAME OF "S.W. Scoffins Court" TO
"S. W. ASH STREET" IN THE CITY OF TIGARD.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1 : The City Council finds that pursuant to §227.120 ORS
the City Planning Commission has submitted a recommenda-
tion to the Council to rename an existing dedicated street within the
City of Tigard from "S. W. Scoffins Court" to "S. W. ASH STREET", said
street not being a county road or state highway.
Section 2: The Council further finds that said public way to be
renamed extends from S. W. Scoffins Street, Southwest-
erly to join with S. W. Commercial Street, and that if further extended
southwesterly of S. W. Commercial Street, said dedicated way would be
substantially aligned with S. W. Ash Street.
Section 3 : The Council further finds that a hearing on said pro-
posal to rename said public way was by resolution of
the Council called to be held on Monday , March 13 , 1972, at 8:00 p.m.
and that the notice of said hearing was given by publication in the
Tigard Times , a newspaper of general circulation within the City of
Tigard within the week prior to the week of said hearing, and that
said hearing was duly and regularly held by the Council at the time
and place as publicized, whereat all persons particularly interested
and the general public were afforded an opportunity to be heard with
respect to said proposal; and the Council further finds that it is in
the public interest and in the best interests of the City and the six-
mile area of the limits of the City that the said proposal be adopted.
Section 4 : That said dedicated public way (heretofore known as "S.W.
Scoffins Court") extending from S. W. Scoffins Street
southwesterly to the intersection thereof with S. W. Commercial Street
in the City of Tigard, be, and the same is , hereby renamed "S. W. ASH
STREET" .
Section 5 : That the City Recorder shall forthwith file a certified
copy of this Ordinance with the Department of Records and
Elections of Washington County, and a like copy with each of the De-
partment of Revenue and Taxation, and Department of Public Works
(County Surveyor) .
Section 6 : i'tiat this ordinance shall be effective on and after the
31st day after its passage by the Council and approval
by the Mayor.

16. ORDINANCE No. 72-6 AN ORDINANCE AUTHORIZING THE MAYOR AND RECORDER
TO EXECUTE ON BEHALF OF THE CITY OF TIGARD A
COOPERATIVE AGREEMENT FOR THE PURPOSE OF
CONDUCTING A CONTROLLED AERIAL RECONNAISSANCE
FEASIBILITY STUDY WITH RESPECT TO THE INTER-
SECTION OF PACIFIC HIGHWAY WEST-GAARDE STREET;
FIXING AN EFFECTIVE DATE, AND DECLARING AN
EMERGENCY.

(a) Motion to adopt: Councilman Bergmann, seconded by Councilman
Moore.

b. Commissioner Whittaker asked how this development mould
effect Gaarde.
c. Chairman Paterson stated that the applicant mould still
have to apply for a variants to the building moratorium
in the Gaarde area.
d. Chairman Paterson asked about the size of the lots
at the end of the cul-de-sac.
e. Chairman Paterson asked about the size of the cul-de-sac.
f. Mr. Kiang explained the advantages of a mountable curb.
g. Chairman Paterson asked if they intended to form a local
improvement district.
h. Mr. Ding stated that they did.
i. It was moved (Nicoli). seconded (Severson) and passed by
a unanimous vote of the Commission present to approve
the preliminary plat with the following conditions:
1. That 5 feet be dedicated to the City along the
frontage of S.W. 115th Avenue for street improvements.
2. That 10 feet be dedicated to the City along the frontage
• of S.W. Gaarde Street for street improvements.
3. That $25 per frontage foot along S.W. 115th Avenue be
deposited with the City for the applicant's share of the
improvements of S.W. 115th Avenue or a Local Improvement
District be formed. Any monies not spent for the street'
project shall be returned bo the applicant.
4. That no lots shall have direct access from S.W. Gearde St.
5. That engineering plans and specifications shall be approved
prior to acceptance of the Final Plea.
