The MUC-1 zoning district, which is designed to apply to that portion of the Durham Quarry site within the City of Tigard, is a mixed-use commercial district bounded by 72nd Avenue, Findlay Street and the Tigard,Tualatin and Durham city limits. This site is the subject of an intergovernmental agreement between the cities of Tigard and Tualatin. Pursuant to that agreement the City of Tualatin shall furnish all planning, building and associated development review/permit services for the property. This zoning district is intended to mirror the City of Tualatin's Mixed Use Commercial Overlay District(IDC,Chapter 57). It permits a wide range of uses including commercial lodging, general retail, offices and housing; the latter includes multi-family housing at a minimum density of 25 units/acre and a maximum of 50 units/acre. Additional uses, including but not limited to major event entertainment and motor vehicle retail fuel sales, are permitted conditionally. In addition to the standards of this chapter, development within this zone is subject to the standards of Chapter 18.640. MMD2017-00004 Ways&Means Oyster I louse 1 APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.360.060.C, 18.640,and 18.745 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is situated within Bridgeport Village, which is an outdoor shopping center located at the northwest intersection of SW 72nd Avenue and SW Bridgeport Road. The northern end of the shopping center is within the City of Tigard's jurisdiction; the southern end is within the City of Tualatin's jurisdiction. The subject tenant space is 4,789 square feet in size. The space was previously occupied by an eating and drinking establishment, and will remain in this use category with the new tenant, Ways & Means Oyster House. The property is zoned Mixed Use Commercial— 1 (MUC-1), and is located in the Bridgeport Village Plan District. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.360 Site Development Review: 18.360.060 Minor Modification(s) to Approved Plans or Existing Development C. Approval criteria.A minor modification shall be approved, approved with conditions or denied following the director's review based on the finding that: 1. The proposed development is in compliance with all applicable requirements of this title;and The applicant is proposing a minor modification to an existing development at 7331 SW Bridgeport Road, in preparation for a new tenant (Ways & Means Oyster House). The requirements of this Title that apply specifically to this proposal are addressed individually below. 18.640 Bridgeport Village Plan District: 18.640.050 Development Standards A. Development shall comply with applicable development standards, except where variances and minor variances are granted in accordance with the terms of the intergovernmental agreement between Tigard and Tualatin. B. Development standards. The applicant is proposing to create two (2) new outdoor dining areas: one will be 448 square feet in size and will be located adjacent to the building's southern facade, and one will be 505 square feet in size and will be located adjacent to the building's eastern façade. Based on the applicant's submitted site plan and detail drawing (Sheet A0.1), staff finds the proposal meets all applicable development standards for the Bridgeport Village Plan District, including setback requirements. In addition, the MMll2017-00004 Ways&Means Oyster I louse 2 applicant is not proposing any changes to the building itself that would impact these development standards. These standards are met. 18.640.200 Design Standards C. Building design standards. 1. Nonresidential buildings shall comply with the following: a. Ground floor windows. Street-facing elevations within the building setback (zero-10 feet) along public streets shall include a minimum of 50% of the ground floor wall area with windows, display areas or doorway openings. The ground floor wall area shall be measured from three feet above grade to nine feet above grade the entire width of the street-facing elevation. The ground floor window requirement shall be met within the ground floor wall area and for glass doorway openings to ground level. Up to 50% of the ground floor window requirement may be met on an adjoining elevation as long as all of the requirement is located at a building corner. The subject building is located within the Bridgeport Village shopping center, and is not located adjacent to a public street.Therefore,this standard does not apply. b. Building façades. Façades that face a public street shall extend no more than 50 feet without providing at least one of the following features: i. A variation in building materials; ii. A building off-set of at least one foot; iii. A wall area that is entirely separated from other wall areas by a projection, such as an arcade; iv. By other design features that reflect the building's structural system; or v. No building façade shall extend for more than 300 feet without a pedestrian connection between or through the building. The subject building is located within the Bridgeport Village shopping center, and is not located adjacent to a public street.Therefore, this standard does not apply. c. Weather protection. Weather protection for pedestrians, such as awnings, canopies and arcades, shall be provided at building entrances. Weather protection is encouraged along building frontages abutting a public sidewalk or a hard-surfaced expansion of a sidewalk, and along building frontages between a building entrance and a public street or accessway. Staff reviewed the applicant's elevation drawing (Sheet A2.1) to confirm that multiple metal canopies for weather protection will be provided at the subject building's entrances.This standard is met. d. Building materials. Plain concrete block, plain concrete, corrugated metal, plywood, sheet press board or vinyl siding shall not be used as exterior finish materials. Foundation material may be plain concrete or plain concrete block where the foundation material is not revealed for more than two feet. Staff reviewed the applicant's elevation drawing (Sheet A2.1) to confirm that none of the prohibited building materials listed above will be used for exterior finishes. This standard is met. MMD2017-00004 Ways&Means Oyster I Louse 3 18.745 Landscaping and Screening: 18.745.50 Buffering and Screening B. Buffering and screening requirements. 8. Fences and walls. a. Fences and walls shall be constructed of any materials commonly used in the construction of fences and walls such as wood, stone, rock or brick, or otherwise acceptable by the director; The applicant proposes to enclose the new outdoor dining areas with metal fences that will be approximately three feet in height. In addition, the applicant submitted documentation of approval from the property owner for the proposed design and materials to be used on the new fences. As the proposed fences are located within the Bridgeport Village shopping center, and do not front any public streets, staff finds that property owner approval is adequate to meet the standard outlined above. This standard is met. C. Setbacks for fences or walls. 1. No fence or wall shall be constructed which exceeds the standards in paragraph 2 of this subsection C except when the approval authority, as a condition of approval, allows that a fence or wall be constructed to a height greater than otherwise permitted to mitigate against potential adverse effects. 2. Fences or walls. a. May not exceed three feet in height in a required front yard along local streets or eight feet in all other locations and, in all other cases, shall meet vision clearance area requirements in Chapter 18.795; b. Are permitted up to six feet in height in front yards adjacent to any designated arterial or collector street. For any fence over three feet in height in the required front yard area, permission shall be subject to administrative review of the location of the fence or wall. The applicant proposes to enclose the new outdoor dining areas with metal fences that will be approximately three feet in height. Staff reviewed the applicant's submitted site plan and detail drawing (Sheet A0.1) to confirm that all proposed fences comply with setback requirements for the Bridgeport Village Plan District,and with the height restrictions outlined above.This standard is met. The proposed development complies with all applicable requirements of this Title,as demonstrated by the analysis contained within this administrative decision.This criterion is met. (TDC 18.360.060.0 continued) 2. The modification is not a major modification. Staff finds that the changes listed in'IDC 18.360.050.B.1-11 are either satisfied or do not apply.Therefore, the proposed development is not a major modification.This criterion is met. Work consist of interior tenant improvements with exterior modifications that include, replacement of existing storefront, replacement of existing canopies, addition of new canopies, and fenced outdoor dining. Outdoor dining areas will be placed on portions of sidewalk adjacent to the building; these areas were used for the same purpose by prior tenants. No change in occupancy or parking. The director shall determine that a major modification(s) will result if one or more of the following changes are proposed. There will be: I. An increase in dwelling unit density, or lot coverage for residential development; Response: Not applicable: The proposed development is located in a commercial zone and has no impact on residential development. 2. A change in the ratio or number of different types of dwelling units; Response: Not applicable: The work is located on commercial property and therefore not associated with any residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765; Response: No, the proposed modifications do not add building area to the site and therefore do not increase required parking. In addition, Joint parking is utilized at Bridgeport Village and there are 2,038 parking stalls with a parking ratio of 4.26/1000 sf. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code; Response: No change to current occupancy type. 5. An increase in the height of the building(s) by more than 20%; Response: No increase in height. 6.
