around the Washington Square Mall and land immediately west of Highway 217.

acre. Larger buildings are encouraged in this area with parking under, behind or

SECTION III. BACKGROUND INFORMATION
Site Information:
The project is located at 10205 SW Washington Square Road in the Washington Square shopping
center; northeast of Highway 217, south of SW Washington Square Road, and west of SW Greenburg
Road. In 1994, the City of Tigard Planning Division approved the building for an approximately 7,000-
square-foot eating and drinking establishment with an outdoor dining area. No subsequent land use
approvals have been issued for the subject building, which is currently occupied by an eating and
drinking establishment, Thirsty Lion Pub & Grill. The property is zoned Mixed Use Commercial
(MUC), as are adjacent properties to the north, south, and west; adjacent properties to the east are
zoned Mixed Use Employment (MUE-1). The property is located in the Washington Square Regional
Center Plan District.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
18.360 Site Development Review:
18.360.060 Minor Modification(s) to Approved Plans or Existing Development
C. Approval criteria.A minor modification shall be approved,approved with conditions or denied
following the director's review based on the finding that:
1. The proposed development is in compliance with all applicable requirements of this
title;and
The applicant is proposing a minor modification to an existing eating and drinking establishment,
Thirsty Lion Pub & Grill,located at 10205 SW Washington Square Road. The requirements of this Title
that apply specifically to this proposal are addressed individually below.
18.520 Commercial Zoning Districts:
18.520.040 Development Standards
A. Compliance required.All development must comply with:
1. All of the applicable development standards contained in the underlying zoning
district, except where the applicant has obtained variances or adjustments in
accordance with Chapters 18.370.
2. All other applicable standards and requirements contained in this title.
B. Development standards.Development standards in commercial zoning districts are contained
in Table 18.520.2.
Development standards are addressed under Section 18.630.020 of this decision.These standards are met.
18.630 Washington Square Regional Center Plan District:
18.630.020 Development Standards
A. Compliance required.All development must comply with:
1. All applicable development standards contained in the underlying zoning district,
except where the applicant has obtained variances or adjustments in accordance
with Chapter 18.370 and subsections C through E of this section;
2. All other applicable standards and requirements contained in this title.
B. Development standards. Development standards which apply within mixed-use zones in
the Washington Square Regional Center Plan District are contained in Table 18.520.2.

Existing developments which do not meet the standards specified for a particular district
may continue in existence and be altered subject to the provisions of Section 18.630.030.
The subject building was lawfully in existence at the time of adoption for the Washington Square
Regional Center Plan District. In addition, the applicant is not proposing an addition, expansion, or
enlargement of the existing structure's gross floor area; therefore, many of the development standards
for the MUC zone (for example, minimum building height) do not apply to this project (MC
18.630.030).
The applicant is only proposing to add a canopy cover above an existing 1,700-square-foot outdoor
dining area. Staff reviewed the applicant's submitted site plan and images of the proposed canopy cover
to confirm it complies with applicable development standards for the MUC zone, such as minimum
setback requirements. These standards are met.
18.630.050 Site Design Standards
Compliance. All development must meet the following site design standards. If a parcel is one
acre or larger a phased development plan may be approved demonstrating how these standards
for the overall parcel can be met. Variance to these standards may be granted if the criteria
found in Section 18.370.010.C.2, governing criteria for granting a variance, is satisfied.
The applicant is not proposing any changes to the project site (site coverage, landscaping, off-street
parking,etc.). Therefore, these standards do not apply.
18.630.060 Building Design Standards
All new buildings constructed in the MUC, MUE and MUR zones within the WSRC shall
comply with the following design standards. Variance to these standards may be granted if the
criteria found in 18.370.010.C.2, criteria for granting a variance, is satisfied.
The applicant is not proposing to construct a new building; the request is to construct a canopy cover
for an existing outdoor dining area. Therefore, these standards do not apply.
The proposed development complies with all applicable requirements of this Title,as demonstrated by the
analysis contained within this administrative decision.This criterion is met.

2. The modification is not a major modification.
Staff finds that the changes listed in TDC 18.360.050.B.1-11 are either satisfied or do not apply.Therefore,
the proposed development is not a major modification.This criterion is met.
CONCLUSION: The proposal is a Minor Modification of existing site development and is in
compliance with the applicable requirements of this Title.

Project Description:
Thirsty Lion Gastropub & Grill is proposing to provide a seasonal enclosure for their existing 1,700 square
foot patio. The patio is currently covered with a wood trellis, patio heaters and fabric panel system, but
during the spring and fall, unpredictable NW weather limits our use as it is not weather protected. We are
proposing a more permanent cover to provide weather protection for our seasonal use. No changes to
the existing building, landscape or parking is proposed.
Per our prior meeting with Cheryl Caines of the City of Tigard Planning Department, the proposed change
requires a "Minor Modification—Type I Application.
Please review the attached site plan, site photographs and images of the proposed patio enclosure as
submittal for the required Type I Application for the Minor Modification approval.

18.360.050 Major Modification(s)to Approved Plans or Existing Development
A. Determination request. An applicant may request approval of a modification to an approved plan or
existing development by:
1. Providing the director with three copies of the proposed modified site development plan; and
2. A narrative which indicates the rationale for the proposed modification addressing the changes
listed in subsection B of this section.
B. Evaluation criteria. The director shall determine that a major modification(s)will result if one or
more of the following changes are proposed. There will be:
1. An increase in dwelling unit density, or lot coverage for residential development;
Response Project is not residential; therefore, this does not apply.
2. A change in the ratio or number of different types of dwelling units;
Response- Project is not residential; therefore, this does not apply.
3. A change that requires additional on-site parking in accordance with Chapter 18.765;
Response. No change in use, increase in area, or increase in occupant load is proposed,
therefore parking requirements are unchanged and this does not apply.
4. A change in the type of commercial or industrial structures as defined by the Uniform Building
Code;
Response: We are not proposing to change project type; therefore, this does not apply.
5. An increase in the height of the building(s) by more than 20%;
Response No increase in building height is proposed; therefore, this does not apply.
6. A change in the type and location of accessways and parking areas where off-site traffic would
be affected;
Response: No change in accessways or parking areas is proposed; therefore, this does not
apply.
7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed
100 vehicles per day;
Response. No increase in vehicular traffic is expected as a result of the proposed change,
therefore, this does not apply.

8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding
expansions under 5,000 square feet;

Response: Proposal is to merely cover existing 1,700 SF patio which is below 5.000 SF
threshold; therefore, this does not apply
9. A reduction in the area reserved for common open space and/or usable open space which
reduces the open space area below the minimum required by this code or reduces the open
space area by more than 10%;
Response: No changes or reduction of open space is proposed; therefore, this does not
apply.
10. A reduction of project amenities below the minimum established by this code or by more than
10%where specified in the site plan:
a. Recreational facilities;
b. Screening; and/or
c. Landscaping provisions.
Response. No changes or reduction in project amenities are proposed; therefore, this does
not apply.
11. A modification to the conditions imposed at the time of site development review approval which
are not the subject of paragraphs 1 through 10 of this subsection.
Response. Proposed project does not modify existing site development conditions;
therefore, this does not apply.
