Approved Minutes from April meeting.
Began with other business because developer Dale DeHarpport and his son were present
to speak about a development proposal. The annexation proposal was presented to NPO
#3 in March meeting. This will be heard at Boundary Commission on Thursday, May 2,
1991. Mr. DeHarpport plans to submit plans development to City, Friday, May 3, 1991.
Proposal on 4.53 acres located approximately 114th and Walnut - 19 lot single family
zoned 4.5. Lots range in size from 1 ,000 to 10,000 square feet.
There was a question about drainage - answer: a catch basin and drainage in the creek
for part of the site; drain north to Walnut Street and into drainage ditch to north.
A question about sewer - answer: sewer available through an easement on a lot to the
north.
Question about road improvements - Traffic impact statement from Washington County
states site distance adequate. They will dedicate 13"additional right-of-way, a total of 33'
from center line, sidewalk along frontage on Walnut Street, improve drainage ditch along
their frontage and culvert under road of subdivision. We will relook at this in June
meeting.
Tree ordinance - Martha Bishop had requested reading of Tigard tree ordinance which
has been updated January 17, 1991. Martha questioned what constituted a permit -
verbal, written, discretionary by Planning Department.
She requested we ask for a policy that the tree removal permit be written. A question
was asked - Does a developer have to have a survey of trees on the property before
development begins? Does a licensed or certified arborist do this survey? Who follows
through with the development to see that only the allowed trees are cut? Martha stated
Beaverton tree ordinance is a model one and Tualatin is refining their tree ordinance
using Beaverton as a model. Tualatin also has a program called Heritage Tree certificate,
to encourage saving of trees on private land within the City. This item will be discussed
again in the June meeting.
Zone Change Annexation - Foran - ZCA 910012 and Price (tax lot WCTM 2S1 9A Lot
1900 2.95 acres adjacent to Foran) We discussed this and will review comments in June
meeting.
Subdivision Preliminary Plat/Subdivision SUB 90-0005/SLR 90-0002/LLA 90-0004NAR
90-0009/PDR 90-0005 Summit at Bull Mountain, Seyer Intl. owner; Thomas Burton,
applicant. We are requesting this be heard at the Planning Commission on June 11,
1991 not the tentative date of June 3, 1991. We did not have a quorum at the NPO #3
meeting and we need to hear this at our June 5, 1991 meeting.
We who were at the meeting are: OPPOSED to the request from owner to eliminate the
requirement to construct street through to Bull Mountain Road. Requested some written
assurance there would be no change in density (to increase in any way) in either Phase
2A.1 or 2A.2 or 2B if this is divided per request.
The transportation update will go before the Council June 11, 1991. Nancy Smith
requested and received the latest information and communication between the City of
Tigard and City of Beaverton. The item was scheduled for Council meeting April 23,
1991, but was set off.
Martha Bishop gave a report about the Gaarde house historic designation. It was
approved by the committee. The minutes of our NPO meeting were not give to the
committee, so we request that our minutes be given to any and all committees when an
item of interest to that committee is addressed.

Ladies and Gentlemen:
Attached you will find a Conditional Use Application and supporting materials for an expansion
project at Christ The King Church, 11305 SW Bull Mountain,Tigard,OR A separate application
is being made to Washington County to have the lot lines extinguished between tax lots 2400,
1700 and 500; all under ownership of Christ the King Church.
The project consists of a Social,Hall addition of approximately 5240 square feet,an expansion of
the existing Sanctuary of approximately 600 square feet,interior remodel of approximately 4.500
square feet for offices and classrooms,and expansion of the Parking Lot for an additional 41
spaces and remodel of the existing residence on tax lot 2400 for classrooms. The classrooms will
be used for Sunday school classes and occasional weeknight meetings. None of the classrooms .
will be used more than 12 hours per week nor will the church operate a full-time school for
educational purposes.
Chris Davies of the Engineering Department has previously reviewed the civil engineering for the
storm drainage for the project.
No new signs are included with this application.

PROPOSAL NO. 2929 - Annexation to the City of Tigard
Petitioner: City of Tigard
Owners: Four D Construction (Dale DeHarport) ; Gerlack;
Lohrenz; Greco; & Parish
90th Day: June 26, 1991
Proposal No. 2929 was initiated by a resolution of the City Coun-
cil . The resolution meets the requirement for initiation set
forth in ORS 199. 4900 )(a) . If the Commission approves the
proposal the boundary change will become effective 45 days from
the date of approval subject to the conditions of ORS 199. 505 and
ORS 199 519.
The territory to be annexed is located generally on the west edge
of the City, south of SW Walnut St. and west of SW 112th Ave.
The territory contains 4.53 acres, 1 single family residence, an
estimated population of 2 and is evaluated at $253,080
REASON FOR ANNEXATION. The property owners have petitioned to
obtain services to facilitate construction of a 19 lot res-
idential subdivison.
BOUNDARY COMMISSION POLICIES. The Boundary Commission has three
adopted policies. The f.irst of these policies states that the
Commission generally sees cities as the primary provider of urban
services. Recognizing that growth of cities may cause financial
problems for districts, the second policy stipulates that the
Commission will help find solutions to the problems. The third
policy states that the Commission may approve irregular bound-
aries in the short term if these lead to logical service arrange-
ments in the long term.
LAND USE AND PLANNING.
Site Information. Property to the northeast of the site is in
the City of Tigard and has a single family residence. Other sur-
rounding properties are in Washington County and sparsely devel-
oped with single family residences with a large undeveloped area
directly east of the subject site. Property to the northeast is
zoned Tigard R-4. 5 (Residential , 4.5 units per acres) . All other
surrounding properties are zoned Washington County R-6 ( res-
idential , 6 units per acre) .
The subject property is gently sloping to the south with a small
creek near the southern boundary. The area is covered with

grasses and weeds and a few trees are scattered throughout the
property.
Rea�io��nal Planning. The territory proposed for annexation is
within the regional Urban Growth Boundary and the boundary of
METRO.
County Planning. The territory is designated Urban on the
Washington County Comprehensive Framework Plan. County zoning
for the the site is R-6 - 6 units per acre. The territory is
within the County' s West Tigard Community Planning Area.
The City and the County have adopted an Urban Planning area
Agreement (UPAA) which designated both an "active planning area"
within which the City is responsible for planning and an "area of
interest" within which the City does not conduct comprehensive
planning but does maintain an interest in planning and develop-
ment actions by the County because of potential impacts on the
City' s active planning area. This territory is within the Active
Planning Area.
Washington County reviewed its role in service provision in its
County 2000 program. The County adopted a service delivery sys-
tem which distinguishes between municipal and county-wide ser-
vices in an attempt to achieve tax fairness and expenditure
equity in the provision of public services. It is County policy
that all County taxpayers should pay for those service which are
County-wide, and municipal services are to be provided by cities
or districts.
City of Tigard Planning. The City of Tigard has an acknowledged
City Limits plan. The City of Tigard and Washington County have
entered into an Urban Planning Area Agreement (UPAA) which is a
part of both the County' s and the City' s adopted comprehensive
plans. The UPAA sets out an Active Planning Area within which
the City assumes responsibility for land use planning and an area
of Interest in which the County agrees to coordinate its planning
with the City because of effects of development outside the City
on concerns inside the City. Under the UPAA, the City agrees to
convert County planning and zoning designations to ones which are
most closely approximated in the City's ordinances. This ter-
ritory is within the Active Planning Area.
The City of Tigard City Council considers an annexation and the
rezoning of property at the same time. Any zoning approved
through this process does not become effective until the Boundary
Commission order is final . The City approved a zone change for
this property, determining that it should be designated at R-4. 5.
The City' s Staff report contains the following findings and
conclusions concerning the compliance of the annexation and zone

change with the City plan:
"The relevant criteria in this case are Tigard Comprehensive
Plan Policies 2. 1 . 1 , Citizen Involvement; 6.3. 1 , Established
Areas; 10. 1 . 1 , Service Delivery Capacity; and 10. 1 .2, Bound-
ary Criteria and chapters 18. 136, Annexations; and 18. 138,
Established/Developing Area Classification of the Tigard Com-
munity Development Code. The planning staff has determined
that the proposal is consistent with the relevant portions of
the Tigard Comprehensive Plan based upon the findings noted
below:
1 . Plan Policy 2. 1 . 1 is satisfied because the Neighborhood
-Planning Organization and Community Planning Organization
as well as surrounding property owners were given notice
of the hearing and an opportunity to comment on the
request.
2. Plan Policy 6. 3. 1 is satisfied because this property is
designated as low density residential on the Comprehen-
sive Plan Land Use Map and will be zoned as R-4.5,
thereby insuring development of the same type and density
as existing neighborhoods.
3. Plan Policy 10. 1 . 1 is satisfied because the City has con-
ducted the Bull Mountain/Walnut Area Urban Services Study
which includes the subject property. This study as well
as the comments from the Police Department, and other
service providers indicate that adequate services are
available in the vicinity and may be extended to accommo-
date the subject property.
4. Plan Policy 10. 1 .2 is satisfied because the annexation
will not create an irregular City boundary, the police
Department has been notified of this request, the land is
located within Tigard's Area of Interest, and adequate
service capacities can be made available to accommodate
the eventual development of the property as noted above.
The planning staff has determined that the proposal is con-
sistent with the relevant portions of the Community Develop-
ment Code based upon the findings noted below:
111 . Section 18. 136.030 of the Code is met because all facil-
ities and services can be made available, the applicable
Comprehensive Plan policies discussed above have been
satisfied and the property has been determined to be a
developing area in accordance with the criteria in Chap-
ter 18. 138 of the Code.

"The Urban Planning Area Agreement between the City and
Washington County requires that when annexing land within
the City' s area of interest, the City adopt a zone
designation which most closely resembles the County plan
and zone designation. In this case, however, the prop-
erty is zoned in Washington County for single family res-
idential use with a minimum lot size of 5,000 square feet
and a maximum density of six units per acre but also car-
ries City of Tigard land use designation of Low Density
Residential for which maximum allowed density is 4.5
units per acre with a minimum lot size of 7, 500 square
feet. The property will be designated as R-4.5 zone
which is the closest comparable zone allowed under the
existing comprehensive plan designation."
2. Chapter 18. 138 of the Code is satisfied because the prop-
erty meets the definition for a developing area and shall
be designated as such on the development standards area
map.
UTILITIES AND SERVICES
Sewer. The territory is within the Unified Sewerage Agency
(USA) . Under an agreement between the City and USA, the City
maintains all sewer lines under 24 inches in size. The District
maintains all larger lines and operates the treatment facilities.
There is an 8 inch lateral sewer line located on tax lot 2100
which is approximately 400 feet north of Walnut Street. The
Tigard engineering staff has reviewed the location and have
approved extension of this line to the property.
The Unified Sewerage Agency bills customers $15.50 per month or
$186 per year. The District' s hook-up fee is $1500 for a single
family dwelling. The District has a $36 annual assessment per
dwelling unit for storm drainage services. The City bills
monthly at $13.62 per year. The City also charges a $1 .50 storm
drainage surcharge for residential users. The hook-up fee for a
single family dwelling in the City is $1285 which includes a $35
inspection fee. USA assesses a property tax which goes towards
payment of bonds sold to construct district-wide, major improve-
ments and regional treatment plants. This tax, which for the
1990-91 tax year is $. 2537 per $1 ,000 assessed value, would
remain the same.
Water. The territory is within the Tigard Water District which
serves the southern and western portions of the City. The
District buys water from Lake Oswego and the City of Portland.
The district has 8 inch and 12 inch mains fronting the property
in Walnut St.

Fire. The territory is within the Tualatin Valley Fire and Res-
cue District. Annexation will not effect this service as the
District provides fire service to the City, which does not have a
fire department.
Police. Upon annexation to the City, the territory will be auto-
ma Cally withdrawn from the Washington County Enhanced Sheriff' s
Patrol District and the $.77 per thousand District tax will no
longer be levied on the site. The County provides a base level
of police service and the District finances the additional level
of service to bring the service level to one officer per thousand
population.
Subsequent to annexation the Tigard Police Department will pro-
vide police protection to the territory. The City provides a
service level of one officer per 700 residents. Emergency
response in the City is under five minutes.
Street Lights. The territory is within the boundary of the
Washington County Service District No. 1 from which it will be
automatically withdrawn upon annexation. The district provides
services to areas upon request and uses local improvement
districts to finance the services. The territory to be annexed
is not within a benefitted area. The City of Tigard pays for
street lighting services out of its street fund which receives
state shared gasoline tax money as its primary source of revenue.
Vector Control . Upon annexation the - territory will be automat-
ically withdrawn from the unfunded Washington County Vector Con-
trol District.
Streets. The territory is within the unfunded Washington County
Servic57 District for Urban Roads Maintenance from which it would
be automatically withdrawn upon annexation to the City.
RECOMMENDATION: Based on the proposed Findings and Reasons for
Decisio-n-7ro-u-0 in Exhibit B, the staff recommends that Proposal
No. 2929 be approved.

potential impacts on the City' s active planning area. This
territory is within the Active Planning Area.
Washington County reviewed its role in service provision in
its County 2000 program. The County adopted a service deliv-
ery system which distinguishes between municipal and county-
wide services in an attempt to achieve tax fairness and
expenditure equity in the provision of public services. It
is County policy that all County taxpayers should pay for
those- service which are County-wide, and municipal services
are to be provided by cities or districts.
7. The City of Tigard has an acknowledged City Limits plan. The
City of Tigard and Washington County have entered into an
Urban Planning Area Agreement (UPAA) which is a part of both
the County' s and the City' s adopted comprehensive plans. The
UPAA sets out an Active Planning Area within which the City
assumes responsibility for land use planning and an area of
Interest in which the County agrees to coordinate its
planning with the City because of effects of development
outside the City on concerns inside the City. Under the
UPAA, the City agrees to convert County planning and zoning
designations to ones which are most closely approximated in
the City's ordinances. This territory is within the Active
Planning Area.
The City of Tigard City Council considers an annexation and
the rezoning of property at the same time. Any zoning
approved through this process does not become effective until
the Boundary Commission order is final . The City approved a
zone change for this property, determining that it should be
designated at R-4. 5.
8. The territory is within the Unified Sewerage Agency (USA) .
Under an agreement between the City and USA, the City main-
tains all sewer lines under 24 inches in size. The District
maintains all larger lines and operates the treatment facil-
ities.
There is an 8 inch lateral sewer line located on tax lot 2100
which is approximately 400 feet north of Walnut Street. The
Tigard engineering staff has reviewed the location and have
approved extension of this line to the property.

The Unified Sewerage Agency bills customers $15.50 per month
or $186 per year. The District' s hook-up fee is $1500 for a
single family dwelling. The District has a $36 annual
assessment per dwelling unit for storm drainage services.
The City bills monthly at $13.62 per year. The City also
charges a $1 .50 storm drainage surcharge for residential
users. The hook-up fee for a single family dwelling in the
City is $1285 which includes a $35 inspection fee. USA
assesses a property tax which goes towards payment of bonds
sold to construct district-wide, major improvements and
regional treatment plants. This tax, which for the 1990-91
tax year is $.2537 per $1 ,000 assessed value, would--remain
the same.
9. The territory is within the Tigard Water District which
serves the southern and western portions of the City. The
District buys water from Lake Oswego and the City of
Portland. The district has 8 inch and 12 inch mains fronting
the property in Walnut St.
10. The territory is within the Tualatin Valley Fire and Rescue
District. Annexation will not effect this service as the
District provides fire service to the City, which does not
have a fire department.
11 . Upon annexation to the City, the territory will be automat-
ically withdrawn from the Washington County Enhanced Sher-
iff' s Patrol District and the $.77 per thousand District tax
will no longer be levied on the site. The County provides a
base level of police service and the District finances the
additional level of service to bring the service level to one
officer per thousand population.
Subsequent to annexation the Tigard Police Department will
provide police protection to the territory. The City pro-
vides a service level of one officer per 700 residents.
Emergency response in the City is under five minutes.
12. Upon annexation the territory will be automatically withdrawn
from the unfunded Washington County Vector Control District.
13. The territory is within the boundary of the Washington County
Service District No. 1 from which it will be automatically
withdrawn upon annexation. The district provides services to
areas upon request and uses local improvement districts to
finance the services. The territory to be annexed is not
within a benefitted area. The City of Tigard pays for street

lighting services out of its street fund which receives state
shared gasoline tax money as its primary source of revenue.
14. The territory is within the unfunded Washington County
Service District for Urban Roads Maintenance from which it
would be automatically withdrawn upon annexation to the City.
REASONS FOR DECISION
Based on the Findings the Commission determined:
1 . _The Proposal is consistent with regional , county, and city
planning.
2. The City has an adequate quantity and quality of service
available to serve the area.
3. The proposal conforms with the Boundary Commission policy on
incorporated status (OAR 193-05-000) .

SUBJECT: Murray Boulevard Extension
We have reached agreement with Beaverton staff on a memorandum of
understanding regarding the Murray Boulevard extension. The
memorandum provides that the proposed extension will not be opened
to through traffic between Old Scholls Ferry Road and Tigard until
road improvements have been completed on the west side of Bull
Mountain, as provided in the County Transportation Plan.
We expect to present this memorandum of understanding to the Tigard
City Council on the agenda of the meeting of June 11, 1991. We
will be recommending that the Council approve the memorandum. We
expect that the memorandum will also be presented to the Beaverton
Council and the Board of County Copmissioners in the near future.
Attached is a copy of the memorandum. Some of the language has
been modified since the draft presented in April. The changes were
made at the request . of Beaverton. However, the intent of the
memorandum remains unchanged.
Any written comments received by June 11th will be shared with the
City Council when they consider approval of the memorandum.
MEMORANDUM OF UNDERSTANDING
REGARDING THE EXTENSION OF
MURRAY BOULEVARD AND WALNUT STREET
This memorandum of understanding between Washington County, the
City of Beaverton, and the City of Tigard is intended to document
the mutual understanding regarding.the schedule for implementation
of a portion of the existing Urban Planning Area Agreements between
the County and the two cities, in order to assure an orderly and
coordinated development of the transportation system in accordance
with adopted planning documents.
RECITALS:
1. In December of 1988 an Urban Planning Area Agreement was
executed between Washington County and the City of Beaverton.
In the same month,. a similar Urban Planning Area Agreement was
executed between Washington County and the City of Tigard.
Both Agreements provide for the extensions of Murray Boulevard
and Walnut Street7 to form a collector street connection
between the two cities. ` No schedule is specified for
completion of the street connection.
2. The Washington County Transportation Plan, adopted in. October
of 1988, calls for the extension of Beef Bend Road asa -minor
arterial to connect between Scholls Ferry Road and Sherwood.
This road . extension is also recommended in the Southwest
Corridor Study Report adopted by the Metropolitan Service
District Council on May 28, 1987.
3. The Southwest Corridor Study Report recommends that the Murray
Boulevard extension not be completed until the Beef Bend Road
extension is completed. Completion of the Beef Bend Road
extension is considered necessary in order to discourage the
use of the Murray Boulevard extension as a through route
between Scholls Ferry Road and highway 99W. The Southwest
Corridor Study Report suggests that the portion of the Murray
Boulevard extension to be delayed is the portion between
Walnut Street and Gaarde Street. The parties to this
agreement have previously supported the recommendations of the
Report.
4. The Southwest Corridor Study Report, while very specific in
some aspects, is considered by the parties to be a generalized
public facilities planning document. As the parties have
undertaken further planning for.the affected area and observed
development patterns in the area, it has become apparent that
the Southwest Corridor Study Report objective of discouraging

the use of the Murray Boulevard extension as a through route
pending the completion of the Beef Bend Road extension can
best be implemented through a modified approach to the one
described in the Corridor Study.
5. In discussions between the Cities of Beaverton and Tigard, it
has been determined that all portions of the Murray Boulevard

extension need to be completed in conjunction with development

of the adjoining properties in order to (1) comply with the
intentions of the Urban Planning Area Agreement and (2)
provide adequate traffic circulation in the developing areas. j
Engineering review has further identified that the opening of
the roadway to through travel between Old Scholls Ferry Road
and the area south of New Scholls Ferry Road can be deferred I�
until the completion of the Beef Bend Road extension or for at 'I
least five years from the date of this agreement.
AGREEMENT:
1. The portion of the Murray Boulevard extension between Scholls
Ferry Road and Old Scholls Ferry Road -shall not be opened to
through traffic prior. to the completion of the Beef Bend Road
extension to Sherwood. Physical construction of the roadway
will be permitted, but the- actual connection for through
traffic will be impeded by the use of barriers or other j
effective devices approved' by all parties to this agreement.
2. Washington County shall actively pursue funding for
construction of the Beef Bend Road extension. The Cities of
Beaverton and Tigard shall- support the County in this endeavor
3. This memorandum of understanding shall remain in effect until
amended by mutual agreement of all parties.
