KNOWN ALL PEOPLE BY THESE PRESENT, that Gregory Palmer Victoria Joy Rini, hereinafter referred to as
Grantor, inconsideration of the sum of $0.00 paid by the City of Tigard, a municipal corporation and political subdivision
of the State of Oregon hereinafter reicrred to as Grantee, its successors and assigns; conveys aperpetual easement and right-
of-way over the following described land, for the purpose of constructing, reconstructing, maintaining, repairing, replanting
and using the same for a. slope to support or help to support filling of an existing drainage ditch, adjacent to real property
located in the County of Washington, State of Oregon. Said land is more particularly described as follows:
See Exhibits "A" and "B" attached and made part of this document by reference
The Grantee and its assigns or its agents shall ]lave the right at any time hereafter to enter upon the above-described real
property for the purpose, hereinabove mentioned. In connection therewith Grantee may remove any trees, shrubs, brush,
fenck: or other materials which it finds necessary or convenient to accomplish said purpose.
The Grantors, their heirs, successors, assigns or representative shall not construct or maintain any building or other structure
upon the above described real property prior to receiving written approval by the City Engineer or his/her designee. The
Grantors, their heirs, successors, assigns or representatives shall not in any way alter the configuration of the material
f-)lT0in- the slope; including alteration by addition or removal of material, without prior written approval by the City
Engineering or his/her designee.
The instrument does not grant or convey to the Grantee any right of title to the surface of the soil except for the purpose of
constructing, reconstructing, maintaining, repairing, replanting and using the same for a slope to support or help to support
filling of an existing c1r i tge ditch. 0

West, Willamette Meridian, City of Tigard, Washington County, Oregon, being a portion of Lot 26
Shannondow as recorded in Boob 27 Page 27 of the Washington County Subdivision records,
described as follows:
Beginning at the Southwesterly corner of said Lot 25; 'T'hence N 37° 48' 53" W, along the westerly
line of said Lot 26 a distance of 7.72 feet to a point which is 7.00 feet northerly of said south line

Thence N 77° 08' 37" E, parallel wieh and 7.00 from said south line, a distance of 98.33 feet to the
