modification in the Fanno Creek floodplain. In order to provide for the
widening of the highway and to afford adequate clearance underneath the
structure for the bicycle path, the bridge must be both widened and raised.
This will extend the toe of the slope into the Fanno Creek floodplain.

SUBJECT: Zoning Ordinance Amendment ZOA 90-0002
Staff has been contacted by several existing Tigard businesses and prospective
industrial developers regarding the possibility of installing above-ground fuel
storage tanks for the needs of - their vehicle fleets. Chapter 18.104 of the
Community Development Code prohibits the installation of above-ground fuel
storage tanks with capacities greater than 60 gallons in all zoning districts.
Businesses seeking to install fuel storage tanks are caught between the City's
prohibition on above ground _fuel storage tanks and increasingly strict federal
and state regulations on underground storage tanks as well as difficulties
relative to insuring underground tanks. The increased concern with regard to
underground fuel storage tanks relates to the potential for groundwater
contamination due to undetected leakage.
After discussions with a representative of the Tualatin Valley Fire and Rescue
District regarding the District's .position on allowing above-ground fuel
storage tanks, staff has decided to propose an amendment to allow above-ground
fuel storage tanks of 4000 gallons or less in all industrial zones in the City
subject to Uniform Fire Code construction, siting, and permit requirements.
The attached Code Chapter 18.104 contains the proposed revisions. All
additions are underlined. Deletions are bracketed.

18.104.010 Purpose
A. The purpose of these regulations is to guide the installation of
stationary fuel tanks within the City limits in residential, commercial
and industrial zones. (Ord. 89-06; Ord. 86-08)
18.104.020 Definitions
A. "Container" - any can, bucket, barrel, drum, or portable tank (except
stationary tanks) , tank vehicles, and tank cans.
B. "Fuel" - kerosene or any hydrocarbon oil or liquefied petroleum gas
conforming to nationally recognized standards. Hydrocarbon oils shall
have a flashpoint of not less than 100° Fahrenheit.
C. "Tank" - a vessel containing more than 60 U.S. gallons. (Ord. 89-06;
Ord. 86-08)
18.104.030 Applicability of Provisions
A. The provisions of this chapter shall apply to all new and existing
development in all zoning districts. These provisions shall not apply
to nonstationary fuel containers. (Ord. 89-06; Ord. 86-08)
18.104.040 Requirements
A. All stationary containers, tanks, equipment, and apparatus used or
intended to be used for the storage, handling, use, or sale of
flammable or combustible liquids or fuels shall be of an approved type
as per the Uniform Fire Code.
B. Small tanks or containers with capacities of 60 U.S. gallons or less,
used or intended to be used for the above round storage of residential
or home heating fuels, are permitted in all districts when they conform
to the standards and requirements of the Uniform Fire Code and local
fire district requirements.

C. Installation of all fuel tanks with capacities greater than 60 U.S.
gallons shall be prohibited above-ground in all commercial and
residential zoning districts.
D. Installation of all above-ground fuel storage tanks 4000 gallons or
less shall be permitted in all industrial zoning districts subiect to
Uniform Fire Code construction, siting, and permit requirements. Fuel
tanks shall be related to and clearly incidental to an approved use of
the site.
[D. ] E. Specific concerns of tank placement on a site with respect to
topographical conditions, barricades, walls, building exits, proximity
to buildings or adjacent properties, tank construction, and storage
permits for Class I, II and III liquids shall be addressed prior to
the time of Building Code permit approval and site development review
(where applicable), and shall conform to all requirements of the
Uniform Fire .Code and the applicable fire district.
[E.] F. All underground fuel tank and above-ground stationary fuel storage
containers may be installed in all districts provided:
1. All- fuel tank installations must be reviewed and approved by the
Building Official; and
2. Application for the necessary permits from the City Building
Official shall be accompanied by a signed, approved document from

Addendum to minor partition application of Zehntbauer's
property on SW North Dakota regarding Justification of
requests for a variance : .

Current access to the back two homes is on a ten foot gravel /
driveway from 26 foot wide North Dakota street . There is no '
sidewalk system along North Dakota into which to tie .
Therefore , we request that none be required along this '
private drive to these homes .
It is anticipated that sometime in themear future with
urban infill occurring , the vacant pasture property to the
west will be developed which will requirsLa 50 foot roadway
to service the lots . Due to set back requirements , it will
be necessary to locate this street half on our property and |
half on the other property . It would be unnecessarily /
costly to pave the private drive in and then to tear it up /
in a few years to construct the 50 foot street to city
standards . A 20 foot gravel drive would adequately provide
access for fire and other emergency vehicles to the two
homes served . Therefore , we request that paving not be
required for this interim access road .

SENSITIVE LANDS PERMIT NARRATIVE
OVERALL PROJECT
The Oregon State Highway Department is currently planning to =
upgrade the level of service of the section of Scholls Highway
between Murray Blvd. and Fanno Creek Bridge in Washington County.
The project involves the widening of the present highway to include
four lanes and a fourteen foot median, the addition of three
traffic signals and the construction of a six foot sidewalk among
other improvements. The total length of the project is
approximately 1.84 miles.
SENSITIVE LANDS AREA
A connection is planned between the Greenway Park area to the
North and the Tigard Park Lands to the South. This connection would
be made by a path leading under the Fanno Creek bridge near the
eastern terminus of the project.
In order to provide for the widening of the highway and to
afford adequate clearance underneath the structure for the bicycle
path it will be necessary to both widen and raise the bridge. The
net effect will be to extend the toe of the slope into the Fanno
Creek flood plain.
