DECEMBER 21, 1992
1. The meeting was called to order at 7:02 PM.

3. CALL TO AUDIENCE FOR NON-AGENDA ITEMS - No one appeared before the
Committee to speak.
4. APPROVE MINUTES: 11/16/92 - Motion by Committee Member McReynolds,
seconded by Committee Member Jacobs to approve. Approved by unanimous
vote of Committee present.
5. PUBLIC HEARING - SWAC considered their recommendation to the City Council
regarding amendment of the length of term of the Solid waste Management
Ordinance codified as Tigard Municipal Code 11.04. This amendment, if
approved by the city Council, would change the term of the franchise
ordinance from 10 years with an automatic renewal clause, to a 7 year,
automatically renewable contract over the next three years.
A. PUBLIC HEARING OPENED: Public Hearing was opened by Chair Wogen.
B. There were no declarations or challenges
C. STAFF REPORT AND RECOMMENDATION: Loreen Edin presented the staff
report (see minutes file for complete copy of report) . She noted
that Council was considering giving notice to the haulers to stop
the automatic renewal of a 10 year franchise in a process as defined
in TMC Section 11.04.050B. The haulers had offered a compromise
position of a 7 year automatically renewable contract term, if
Council's intent was to reduce the existing 10 year language. The
haulers proposal would change the term to 7 years by January 1,
1995, thus giving the ordinance the next three years to
automatically count down to the 7 year term from the existing 10
year term. Ms. Edin noted that under the 7 year term proposal, the
franchisees believe that rate changes would not be necessary due to
the change in franchise term. She recommended approval of the
franchisees proposed language.
D. PUBLIC TESTIMONY: No opponents appeared to speak.
Proponent: Bill Martin, Director of the Washington County Haulers
Association, 591 NW Queens Court, Hillsboro, appeared on behalf of
the three franchise holders and made their request. (See attached
packet presented to the SWAC members at the meeting.) Mr. Martin
noted the history of hauling in the City of Tigard. He discussed
the changes in the industry over the last few years and compared to
solid waste bill to other utility charges for single family
households in Washington County. He noted that while the cost for
garbage collection was remaining fairly constant due to efficiencies
by the haulers, the cost of disposal and mandated recycling programs
was increasing. He also noted that yard debris, and medical waste
collection were required to be separate hauls in the near future.
He stated that the haulers are working with the City of Tigard to
develop a plan to implement automated collection at curbside for
residential customers perhaps as early as 1994. Mr. Martin stated
that the haulers would recommend SWAC forward a recommendation to
approve the haulers 7 year term proposal to Council, if Council
wished to change the existing 10 year language in the franchise
ordinance.
E. SWAC QUESTIONS:
Chairman Wogen asked what the benefit was of an automatic renewal
clause. Franchisee Miller responded stating that it allows haulers
to implement new programs more quickly, allows newer upgraded
equipment on the street on a regular basis, and encourages banks to
loan to the haulers. Banks give good terms or better terms on loans
when haulers have automatic renewal clauses in their contracts with
cities.
Committee Member Jacobs asked why the Council was interested in
changing the 10 year term. Staff Liaison Edin noted that Council
had begun to express a different philosophy regarding length of
franchise term as early as the rate increase hearings in the Spring
of 1991. Council had discussed the desire to have more of a free
market system rather than franchise areas.
F. PUBLIC HEARING CLOSED
G. SWAC CONSIDERATION AND RECOMMENDATION
After lengthy discussion, Committee Member McReynolds moved to
recommend Council adopt Option #1 which would modify the language in
TMC Section 11.04.050B to change the term of the franchise to be
seven years by January 1, 1995 and to cancel the automatic renewal
of the 10-year contract if the haulers failed to sign acceptance of
the new ordinance language by the end of the calendar year. Motion
seconded by Committee Member Jacobs. Approved by unanimous vote of
Committee present.
H. Committee Chair Wogen commended the haulers on their presentation
and for taking action to recommend a modification to the Council.
He noted that turning on the 10-year clock and doing nothing was
disastrous. A 7 year contract period was a better window for
looking at solid waste issues. He noted that solid waste is no
longer a simple issue and that each legislative session makes more
complex rules.
Committee Member Sullivan noted that the 7 year contract period was
good and that he would be willing to consider a 5 year period in the
future to be more flexible. He believed that competition tends to
create more efficiencies.
Committee Member McReynolds stated that a 7 year period was fair as
it reflected the federal guidelines for depreciation. He did note
that a 5 year contract might speed up turn over of equipment.
Franchised hauler Miller stated that the service standards that SWAC
will be reviewing will give the City a better "hammer" to hold the
haulers accountable to serve and be responsive to the rate payers in
the City.
Committee Chair Wogen stated he would present the Committee concerns
to the Council at their public hearing scheduled for 12/22/92.
6. UPDATE ON SOLID WASTE ANNUAL REPORT FORMAT - Staff Liaison Edin reported
that she was continuing to work with the Washington County Wasteshed
cities to develop a revised annual report format. She had meet with Delyn
Kies of Washington County and the Washington County Haulers Association to
negotiate changes. The draft will be reviewed by both parties and
finalized in early January. She hoped to share a copy of the format with
SWAC and haulers no later than the January SWAC meeting.
7. SERVICE STANDARDS DRAFT REVIEW - Motion by Committee Member Sullivan,
seconded by Committee Member Irwin to move consideration of this item to
the January SWAC meeting. Approved by unanimous vote of Committee
present.
8. OTHER BUSINESS: Consensus of Committee was to hold the next meeting on
1/25/93 since the regular meeting night fell on a City holiday.
9. ADJOURNMENT: Motion by Committee Member McReynolds, seconded by Committee
Member Sullivan to adjourn. Approved by unanimous vote of Committee
present at 8:35 PM.

This schedule pertains to the operations of the collector as a solid waste collector. Other
activities are not to be included. The only revenues to be included are those directly
resulting from the operations as a solid waste collector, and the only costs to be included
are those necessary to support those operations. The owners/officers total
compensation are to include their salary/wages, expense account, company vehicles,
insurance premiums, and any other forms of compensation, to be allocated to the

Do include road use taxes, the cost of rental or leasing of tires, tubes and other
components of collection equipment. Do include the cost of short term (temporary,
usually one month or less) rental or leasing of equipment used while permanent
equipment is being repaired. Include the cost of repairs and maintenance of buildings,
shops, garages, storage facilities, grounds and related equipment based on the actual
percentage of use in the solid waste collection operation, including the utility costs such

EXTRAORDINARY COSTS: Include any special costs incurred during the period that is
directly related to the collection of solid waste business. (For instance, liability claims paid
when not covered by insurance.) Include a detailed explanation.
SCHEDULE 11 SUMMARY
BRAND TOTAL NET INCOME: Compute the differences between operating revenues and
operating costs. Indicate clearly if costs exceed revenues for the three columns and
explain why any losses have occurred.
PROFIT PERCENTAGE: Compute the profit percentage by taking the Net Operating
Income or (Loss) and dividing by the sum of Revenues (Drop Box Revenue + Recycling
Revenue + Residential/Commercial Revenues, including other operating revenues).

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TIGARD AMENDING CHAPTER 11.04, SOLID WASTE
MANAGEMENT, RELATING TO FRANCHISE TERM AND AUTOMATIC RENEWAL
WHEREAS, pursuant to Section 11.04.080(C) of the Tigard Municipal Code, an amendment to the solid waste
management franchise has been proposed;and
WHEREAS, the proposed amendment would change the tern of the automatic franchise renewal from ten years
to seven years;and
WHEREAS, the Solid Waste Advisory Committee has reviewed the -proposed amendment and made a
recommendation to the C11y Council;and
WHEREAS, on December 22, 1992, the City Council held a public hearing to gather Input on the proposed
amendment;now, therefore,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1. Subsection B of section 11.04.050 of the Tigard Municipal Code is hereby amended to read:
"B. Unless the council acts to terminate further renewals of the franchises herein granted:
each January 1st, the franchises are automatically renewed for a term of ten years from the
January 1st renewal; on January 1, 1993, the franchises are automatically renewed for a
term of nine years;on January 1, 1994, the franchises are automatically renewed for a term
of eight years;and, on January 1, 1995,and on each January 1st thereafter, the franchises
are automatically renewed for a term of seven years from the January 1st renewal."
SECTION 2. All of the franchisees shall sign an acceptance of this amendment and said acceptances shall be
flied with the City Recorder by 5:00 pm on December 30, 1992 or this ordinance and amendment
shall be null and void.
SECTION 3. This ordinance shall be effective 30 days after its passage by the Council, approval by the Mayor,
and posting by the City Recorder,and upon acceptance by the franchisees pursuant to Section 2
above.

Please accept my apology for having to be absent from the December 22, 1992, Tigard
City Council meeting_ A travel commitment made several months ago prevents my
attendance.
I believe it is well known within the Tigard City Council that I have questioned the logic of
maintaining a 10-year, automatically renewable, contract term with our solid waste
franchisees. My questioning of this term is related to the ability of the city to control the
contract in order to best serve the'interests of our citizens and is not intended as criticism
of the individual franchisees.
I understand that a reasonable franchise term is desirable in order to provide for planning,
equipment purchases and other legitimate business needs. However, a ten-year term
does not meet my requirements for being reasonable.
Although my preference would be for an automatically renewable contract term of fire (5)
years, 1 will at this time support an automatically renewable contract teral of seven (7)
years. Perhaps future councils will find this to have been a good first step.
Again, please accept my apology for being absent and my recommendation for a shorter
contract term.

SWAC RECOMMENDATION TO CITY COUNCIL - 12/22/92
The Solid Waste Advisory Committee held a public hearing on 12/21 to gather
Information which would allow a recommendation to be formulated for the City
Council on the haulers' proposed franchise ordinance change. After receiving
public testimony, SWAC's unanimous vote was to recommend Alternative#1 -Stop
the automatic renewal of the existing 10-year franchise term and adopt franchisee's
proposed language to change the term of the franchise to 7 years by 1995.
During the SWAC's consideration of this issue last evening, three main themes
were heard which reflect the reason for our recommendation to you. Those were:
1. SWAC believes that canceling the 10-year automatic renewal and taking no
further action would be disastrous to the rate payer and the franchisees in
the long run.
2. SWAC favors an automatic renewal clause in the ordinance. This is
especially true with the possible change in the citizen involvement process
that Tigard is considering. In other words, with the Committee structure
changing to CITs, over time there would not be a group of citizens as well
informed on solid waste issues to review the franchise ordinance periodically
as it would come up for renewal.
3. The Solid Waste Advisory Committee also believed that solid waste collection
was no longer a simple issue. Metro, and each legislative session creates
more complex sets of rules for solid waste service delivery. This means that
a change in the length of contract is appropriate now. A 7-year contract with
the adoption of better defined service standards should give the City of
Tigard the opportunity to have an efficient and effective solid waste
collection service for its citizens while maintaining reasonable rates.

Solid waste collection within the City of Tigard is a three way partnership between the customer, the City of Tigard and the regulated
franchise hauler. The authority to regulate and set standards are expressed in Chapter 11 .04 of the City Ordinance.
The following "Rules of the Game" are provided in order to describe the roles and responsibilities of each of the three partners in assuring
an efficient and effective solid waste collection system in Tigard. Additionally, these minimum standards are offered as a guideline for
service and are not to be construed as the total responsibilities for each party.

can be contained and neutralized.
