UTILITY & FRANCHISE COMMITTEE MINUTES
May 20, 1991
1. The meeting was called to order at 7:00 PM.
2. ROLL CALL:

3 . APPROVAL OF MINUTES: 4/22/91
Motion by Committee Member Jacobs, seconded by Committee Member
Sullivan to approve as submitted. Approved by unanimous vote
of Committee present
4. SOLID WASTE ORDINANCE RECOMMENDATION FOR COUNCIL
Committee discussed the definition of "placed out for
collection" and determined that while the language was not
perfect, it would be best to include in the ordinance noting
that revision may be necessary in the future.
Committee discussed whether new language in section 11.04.130A
should state a public hearing "may" be held immediately versus
changing it to "shall" . Consensus of the Committee was to
leave the word "may" in the recommended ordinance.
Consensus of Committee was to submit the ordinance as drafted
for Council adoption on 6/11/91. The Committee noted concern
that Council understand the ordinance will need to be revised
again in the near future due to constant industry changes as
well as pending state legislative actions.
5. RATE STRUCTURE ADJUSTMENT DISCUSSION AND RECOMMENDATION
Chairman McReynolds advised the Committee that the weight
assumptions used by the City and recommended by Metro do not
appear accurate based on a weight sampling taken by Pride.

Chairman McReynolds noted that the Committee had three options
to consider for computing the pass through rate change. The
pass through is $13 .00 per ton.

(A) Use the same method the City has historically used since
1987 and compute the pass through on the Metro
recommended weights and spread throughout the rate
structure. This would result in $1.00 per can increase
for residential customers.
(B) Use the same method the City has historically used since
1987 except base the assumption on the sampling weight
results and spread throughout the rate structure. This
would result in a $.70 per can increase for residential
customers.
(C) Spread the pass through increase to residential customers
only in an attempt to relieve the apparent rate structure
inequities between service types. This would result in
a $1.95 per can increase for residential customers.
Chairman McReynolds suggested that a financial and operational
audit of the haulers' businesses was needed based on the
following concerns discussed by the Committee: weight
assumption differences; rate structure inequity; cost
allocation inconsistencies; service level definitions; and the
need to establish a methodology for rate establishment.
Lengthy discussion followed. Recommendation to City Council:
the Committee noted while it appeared that historically the
City may be required to pass through the increase based on item
(A) above, method (C) would be preferred by the Committee
(though Pride Disposal supported method (B) above) . Method (C)
was seen to begin the rate structure modification to relieve
inequity concerns by the Committee between service types.

6. COMMITTEE SCOPE DISCUSSION
Staff Liaison Edin presented a discussion draft of a revised
functions and duties list for the Committee. She suggested the
Committee focus on solid waste management exclusively due to
the constant changes in the industry.
After some discussion, the Committee offered suggested
amendments to the list and recommended forwarding to the
Council with a recommendation of approval.

7. OTHER BUSINESS
Committee member Mieneke reported that he had a plastics
collection program in place at the Phil Lewis School. He
reported this was open for the general public during school
hours.

A RESOLUTION OF THE TIGARD CITY COUNCIL REPEALING RESOLUTIONS 85-99 AND 85-104
ESTABLISHING A SOLID WASTE ADVISORY COMMITTEE; DEFINING STRUCTURE AND GOALS; AND MAKING
APPOINTMENTS TO THE COMMITTEE. (FORMERLY KNOWN AS THE UTILITY & FRANCHISE COMMITTEE) .
WHEREAS, Resolution 85-99 and 85-104 established a Utility & Franchise Committee which
was to review all utility franchise, storm water and waste water issues; and
WHEREAS, the solid waste industry is rapidly changing and requires the full focus of
the Committee's efforts.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section 1: REPEAL. The Utility & Franchise Committee is hereby discontinued by the
repealing of Resolutions 85-99 and 85-104.
Section 2: COMMITTEE ESTABLISHED AND TERMS. The City of Tigard Solid Waste
Advisory Committee is hereby established. The Committee shall consist of seven
members, all of whom shall either live or work within the Tigard city limits. All
subsequent appointments shall be for three year terms to expire December 31st. Any
vacancy shall be filled by motion of the City Council for the unexpired portion of any
term. Committee members shall receive no compensation. A chairman and secretary shall
be elected by the membership at the first meeting after January 1st each year.
The Committee shall hold meetings as needed, but shall not meet less than six times per
year. Minutes of each meeting shall be prepared and kept on file with the City
Recorder.
Each of the City's franchised haulers shall be non-voting, ex-officio members who shall
be notified of all meetings and shall have full rights of participation in committee
meetings except Executive Sessions. A non-voting, ex-officio staff liaison person
shall be appointed by the City Administrator.
Section 2: MEMBERSHIP TERMS. The following persons are appointed to the Tigard
Solid Waste Advisory Committee for the terms of office as indicated:

Section 3: GENERAL FUNCTIONS AND DUTIES. The Committee shall be advisory to the
City Council. The Committee shall review regional and local solid waste issues.
The general functions of the Committee shall be to:
(1) Keep public officials informed of the status and progress of solid waste
management in the City;
2 Balance the needs of the franchised haulers with the needs of the community in
developing plans and requirements for the delivery and use of the solid waste
services in the City;

-'"(3) Serve as a modsor for solid waste complaint0hat are not able to be
resolved between haulers and customers;
(4) Review and make recommendations to the City Council on rates, rate structure,
and reporting issues;
(5) Recommend franchise ordinance amendments as necessary to assure the best
service delivery available to citizens and to ensure compliance with other
governmental rules and regulations;
(6) Continue an active and visible educational program for solid waste management
and recycling within the community; and
(7) Perform other duties and research as assigned by the City Council.

SUBJECT: Scope of Study - Financial Review
At the 6/11/91 Council meeting, staff was directed to complete a
financial review of the franchisees' businesses as soon as
possible. This was in response to the Committee's concern with
rate disparity.
Wayne and I are developing a draft of the scope statement for the
review now. A discussion draft will be mailed to each of you by
Friday. I would be interested in hearing your suggestions or
comments Monday evening. Staff hopes to finalize the scope after
talking with Washington County & some consulting firms over the
next couple of weeks.
Sorry we were not able to get this item into your packet today.

Dear Billy,
This person has continued to deposit her garbage illegaly at Tigard
Towne Center on a regular basis . We have contacted the code enforcement I
department in the past to inform this person to discontinue this
illegal practice. At this point in time I believe she is in violation
and needs to be cited. Phone calls and letters of repremand are
not being resonded to. Enclosed is evidence retrieved from her
garbage placed at a container by Washington Mutual Bank.

A RESOLUTION OF THE TIGARD CITY COUNCIL INCREASING GARBAGE RATES DUE TO DISPOSAL
SITE FEE INCREASES
WHEREAS, the Metropolitan Service District (Metro) has announced solid waste
disposal fee increases at dump sites of $13.00 per ton effective July 1, 1991;
and,
WHEREAS, TMC Section 11.04.090(c) provides that increases in charges to the solid
waste disposal franchises for disposal site fees imposed by a governmental agency
may be included in consumer rates established by resolution provided they are
evenly distributed among the rates; and, •
WHEREAS, each member of the Utility and Franchise Committee has reviewed the
proposed rate schedule prepared by the Finance Director which adjusts the rates
for the metro dump fee increase; and,
WHEREAS, the recommended rates will result in increases of $1.00 per can per
month for residential accounts, $5.63 per yard of loose material and $14.07 per
yard of compacted material; and,
WHEREAS, the City Council recognizes the need for prompt action to ensure a
timely pass through of this government agency imposed operating cost increase.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section 1: The Tigard City Council hereby approves an increase in the current
garbage rates to reflect a complete pass through of increased metro
garbage , disposal site fees, to be effective July 1, 1991. Said
increases are reflected in the attached Exhibit "A. "

Once again another party has decided to start a collection of cardboard within
the City of Tigard. Our driver has spotted a white Ford van, Oregon license #DMR 211
full of cardboard in the Fanno Creek subdivision off Bonita Rd. The driver did not
pick up one single piece of cardboard in this residential neighborhood, where
historically she has recycled a fair amount. This is clearly a violation of the
franchise in the City; this person is collecting residential recyclables from the
customers placed out for Pride Disposal.
