1. The meeting was called to order at 7.00 PM.

3. APPROVAL OF MINUTES: 1/20/91
Motion by Committee Member Wogen, seconded by Committee Member Sullivan to approve. Approved by
unanimous vote of Committee present.
4. ELECTION OF OFFICERS
A. Chairman McReynolds advised the Committee that he had served as Chair for over five years. He stated
that due to his commitments as Councilor for the City of King City and his business commitments,he would
not be able to continue to serve as Chair but would serve as a Committee member until his term of office
expired. Lengthy discussion followed.
Motion by Committee Member Sullivan, seconded by Committee Member Dispenza to appoint Eldon
Wogen as Chair for 1992. Approved by unanimous vote of Committee present.
Motion by Committee Member Sullivan,seconded by Committee Member Wogen to appoint Cece Dispenza
as Vice-Chair for 1992. Approved by unanimous vote of Committee present.
5. DEVELOPMENT OF ADMINISTRATIVE RULES REQUIRED
A. Loreen presented listing of administrative rules which needed to be developed. After some discussion,she
noted rules would be dratted over the next few months and sent to the haulers and SWAC for comment.
During these conversations, it was noted that the City would like "on-call"residential customers to receive
recycling bins with the understanding that on-call customers could only have recyclable material picked up
on those days when they placed their can out for pick up.
6. OTHER BUSINESS
A. Vehicle Size Exemption Update:Loreen noted that the staff will be recommending the Council allow the
late filing of the ViN number for the Joy Theater owner since all the rest of the information was received
by the City prior to the filing deadline of 1131192.
B. Next Meeting: The next meeting was scheduled for the third Monday of March (3/16/92) at 7:00 pm.
7. SOLID WASTE RATE STUDY RESULTS- Loreen& Wayne shared information from the public portion of the City
Council meeting noting Coopers& Lybrands general findings. After lengthy discussion, it was noted that new rates
should, in keeping with state law, penalize more garbage and benefit customers producing less garbage.
8. EXECUTIVE SESSION: The Solid Waste Advisory Committee went into Executive Session at 8:30 PM under the

CITY OF TIGARD SOLID WASTE MANAGEMENT ORDINANCE (TMC 11 . 04)
Per Tigard Municipal Code Section 11 . 04 . 160, Administrative Rules
are to be developed to assist with interpretation of the Solid
Waste Management Ordinance .
ADMINISTRATIVE RULE 92-2 PROPOSED March 9, 1992
EFFECTIVE
The purpose of this rule is to clarify the intent of Section
11 . 04 . 105 (Stationary Solid Waste Compactors) of the Solid Waste
Management Ordinance.
The section is unclear as to whether the compactor permit process
is for each compactor or for each site (which could include more
than one compactor) .
Section 11 . 04 . 105 .0 requires each compactor be reviewed for
compatibility with the hauler' s equipment, adequate maneuvering
distances, and whether the compactor can adequately serve the
purpose for which it was installed. Since it appears necessary to
review each compactor individually to determine whether the
approval criteria are met, the City of Tigard will charge a
separate fee for each compactor whether it is located on a site
with another compactor or not . The City will also issue separate
permits for each compactor.

ADMINISTRATIVE RULE 92-3 PROPOSED March 9, 1992
EFFECTIVE
The purpose of this rule is to adopt the Annual Report form which
is referenced in Section 11 . 04 . 090 .E (Stationary Solid Waste
Compactors) of the Solid Waste Management Ordinance .
The section refers to the Annual Report form being adopted by
administrative rule. The City is using the same reporting form
that all other jurisdictions use in the Washington County
Wasteshed.
Attached is the form for use by the solid waste franchisees for
reporting activity for the 1991 calendar year.

1. Multi-Family Recycling —�� &"
Local Government Activity
Actively supportl and promote2 the implementation of recycling systems in multi-family units.
Elements of such systems should include prominently placed, readily accessible containers of
an acceptable type and quality, training of apartment managers in the effective management of
such systems, and promotion/education for tenants. Plan a program to offer recycling to all
multi family complexes by FY 93194.

2. Commercial Waste Audits and Recycling
Local Government Activity:
Implement a comprehensive commercial waste audit program and designate a contact person
for the program. Such a program should enable businesses to receive waste audits upon
request. Keep records on the number of audits performed. Promote the use of existing waste
exchanges and other recovery options. Work with Metro, DEQ,fire marshals, and commercial
recyclers to eliminate impediments to commercial recycling.

Metro Support:
- Conduct a limited number of waste audits (local governments will have primary
responsibility to make waste audits available to businesses.)
- Train Recycling Coordinators and others in how to conduct waste audits.
- Make available a Metro-produced commercial recycling video.

- Provide industry specific information, including a waste generation profile, on businesses

- Provide updated information and workshops on how to set up school-wide recycling.
- Provide inforrnation on how to buy recycled.
3. Construction/Demolition Recycling and Recovery
Local Government Activity:
By the end of FY 92/93, uire completion of a brief waste disposal/recycling form when a

structure is built or demolished. The purpose of the form will be to urge the permittee to
explore waste reduction and recovery options. The permittee should identify
disposal/recycling facility to be used in order to help assure proper disposal and avoid illegal
dumping.
Metro Support:
- Provide technical assistance to processors.
- Provide comprehensive information to processors, haulers, and others on pending permits.
- Provide information regarding recycling and recovery options.
- Develop and distribute a brochure on "clean building."
4. Building Design Review
Local Government Activity:
Incorporate into building design review/site plan review procedures, language that specifies the
incorporation of recycling areas in new multi-family, commercial, institutional, and industrial
developments. Such recycling areas must provide space and access to facilitate effective
recycling on the part of building users and efficient recycling on the part of haulers.
Metro Support:
- Provide technical information regarding placement of and access to recycling systems.
- Develop model ordinance.
5. Home Composting
Local Government Activity:
Promote proper home composting to complement other yard debris recycling programs.

- Maintain home composting demonstration sites.
- Conduct home composting workshops at demonstration sites.
- Extend home composting education programs through Compost Corps.
- Provide home composting brochure.
6. Household Hazardous Waste
Local Government Activity:
Promote the concept of minimizing the use of products and containers that must be disposed as
hazardous waste. Promote the use of Metro's new household hazardous waste disposal
facility. Coordinate with Metro to help find appropriate sites for a mobile collection depot.
Metro Support:
- Public affairs campaign to promote hazardous waste minimization.
- Extend educational programs through coordination with established networks such as
Extension Home Economists to integrate IU-1W into their programs.
- Sponsor seminars on HHW.
- Maintain a household hazardous waste depot at the Metro South transfer station.
- Provide educational brochures on HHW.
- Include information on HHW in presentations given to grades 9-12.
7. Support Depots
Local Government Activity:
Promote the use of recycling depots that accept non-curbside materials or that serve rural
communities. Such depots include temporary depots that collect materials such as phone books
and Christmas trees.
Metro Support:
- Provide Information about depots through Recycling Information Center.
- Facilitate the coordination of phone book recycling programs.

8. "Precycling"
Local Government Activity:
Promote the concept of minimizing the use of products that are excessively packaged or that
are packaged in materials that are not readily collected for recycling in the Metro area.
Metro Support:
- Public Affairs campaign to promote waste reduction.
- Provide presentations that include precycling to grades 9-12.
9. Continuation of Ongoing Programs
Local Government Activity:
Continue to maintain, promote, and enhance the activities begun in years one and two of the
Annual Waste Reduction Program. Maintain yard debris collection program.
10. Buy Recycled
Local Government Activity:
Expand purchases of recycled materials such as yard debris compost, paper, tires, oil, paint,
and building products whenever possible.
Metro Support:
- Provide specifications and technical information on recycled materials and products with
recycled content.
11. Assess Viability of New Curbside Materials
Local Government Activity:
Include additional materials in curbside collection programs as warranted by volumes of
material available, technical and economic feasibility of collection, and adequacy of markets.
Metro Support:
- Monitor performance of existing rbside plastic and magazine collection programs.
- Provide technical information on curbside collection systems.

12. Record Recycling Tonnage
Local Government Activity:
Monitor and record recycling tonnages and participation in such a way that the data can be
used to evaluate the effectiveness of recycling and waste reduction programs.
Metro Support:
- Compile and analyze data to better manage solid waste system.
- Provide statistics to local governments and haulers.
- Submit annual report to the DEQ.

The Tigard City Council, at its meeting of 2125/92, directed staff to grant you a nonconforming use status for the vehicle
you use to haul solid waste with in Tigard. Council found that while you did not include your vehicle identification number
(VIN) in the original filing of information with the City, that the VIN was supplied upon request by the City.
Therefore, the City of Tigard hereby grants you a nonconforming use status until January 31, 1999 for the following vehicle

"It is the purpose and intent of this subsection to permit the nonconforming use status to continue until
January 31, 1999 after which time use of a vehicle with a gross vehicle axle weight rating of more than
10,000 pounds for the collection and transport of any waste produced by that person shall be prohibited.
The site where the waste is produced may be changed, however, the vehicle(s) and the type of
operation(s) must remain the same or the exemption provided in this subsection shall not apply. There
shall be no transfer or expansion of the exemption to use a vehicle with a gross vehicle axle weight rating
of more than 10,000 pounds."
I understand that you are currently applying to the City of Tigard to begin a second type of business at this site;namely
an espresso shop. Under the conditions of Section 11.04.040.D.1, the nonconforming use status is only for the theater
use. If you do start another type of business at this location, you will either need to haul the solid waste for the new
business in a vehicle smaller than 10,000 pounds gross vehicle axle weight, or contact Pride Disposal Company(625-
6177) to provide that service for you.

Please consider changing the current policy of trash
haulers which allows them to charge customers whether
there is a can to be emptied or not.
I believe this policy is unfair to citizens of Tigard,
since it requires us to pay for services not rendered.
I have heard the follmTing arguments from haulers to
explain the charge:
1 . Our service is like the telephone company, there is
a phone charge whether you use it or not.
2. Their accounting is not set up to handle missing
cans , however, they have no problem charging for
extra cans .
I.:am frequently out of town and cannot make arrangements
in advance as one of the haulers requires . I believe I
should pay only for those services rendered by the haul-
ers. Since they have exclusive territories , there is no
reason they should charge a customer when there is no
can to pick up. The hauler is picking up -my neighbors
cans on either side and so must come down my street any-
way. I can think of no credible reason to allow this to
continue.

Garbage rates have increased in
the city since then,but the increases
were all authorized by Metro for dis-
posal costs. Like many cities, Bea-
verton allows garbage collectors to
pass along Metro's increases to their
customers.
Portlanders pay$17.50 per month
for one-can, weekly service. Tuala-
tin residents pay $16.60, unincor-
porated Washington County resi-
dents $12.47 and Tigard residents
$12.03,Carlson said.
Two companies, Beaverton Sani-
tary Service and West Beaverton
Sanitary Service, serve about two-
thirds of the city. The number of
haulers has increased to nine in
recent years as the city has annexed
territory.
The council will be asked to
approve the proposed increases,
allowing them to take effect March

RE: Solid Waste Compactors
This letter is to inform you that on December 17, 1991, the Tigard
City Council approved Ordinance No. 91-36, which requires the City
to issue permits for solid waste compactors. The ordinance became
effective on January 16, 1992. The reason these permits are
required is to maintain sufficient maneuvering space to ensure each
compactor is compatible with hauler's equipment, to minimize
disturbance to neighboring properties, and to provide safe and
efficient service.
All owners of solid waste compactors in the City are required to
apply for a one-time permit through the Community Development
Department. The fee for the permit is $100 per compactor. As of
January 16, 1992, owners of existing compactors must obtain permits
by January 16, 1993. Any new compactor to be installed after
January 16, 1992 is required to have a permit prior to
installation.
Please review the enclosed requirements and provide the city with
a site plan and a letter from your solid waste hauler stating the
compactor is compatible with the hauler's equipment. The Solid
Waste Compactor Permit Application is enclosed with this letter.
Please complete the application form and return it with your fee to
Tigard City Hall, Attention: Codes Enforcement Officer.
Your Permit/Application will be reviewed in a timely manner, and a
permit will be issued if all conditions have been met.

Letter of compatibility with the franchisee's hauling equipment, signed by the
franchisee.
APPROVAL CRITERIA:
Applicant shall demonstrate that:
1. The compactor is compatible with the franchisee's hauling equipment, (attach
letter from solid waste hauler) ;
2. The proposed site plan provides adequate maneuvering distances for the franchise
hauler's equipment and maintains adequate and safe access for all other vehicles
and pedestrians as required by local, state or federal law;
3. The compactor and applicant can comply with any applicable federal, state, and
local health, safety and environmental regulations including, but not limited to
OAR 437-02-242; and this section;
4. Adequate opportunity for recycling has been provided and the area where the
franchisee collects separated recyclable materials is at central locations
accessible to the franchisee's hauling equipment;
5. The compactor can adequately serve the purpose for which it is installed,
including:
a. able to hold all wastes generated by the permittee;
b. accessible, and easy for the permittee and its tenants and employees to
insert waste into the compactor in a safe manner;
C. safety measures to prevent unauthorized or accidental operation, or
attraction to minors; and
d. sanitary and tight design to prevent waste from leakage, dropping,
blowing, or otherwise escaping from the compactor or unauthorized removal
of waste from the compactor.
6. The compactor shall be located outside of any required building setback areas and
(or) required buffered areas as required by the applicable zoning district and
related Community Development Code or Municipal Code standards.
Note: The Director may waive the setback requirements if the permittee can demonstrate
that this amount of setback will be impractical. Additional screening or other
noise reduction measures may be required.
OPERATIONAL STANDARDS:
At all times the applicant and the compactor shall remain in compliance with the following
requirements:
1. Compliance with any applicable federal, state, and local health, safety and
environmental regulations including, but not limited to OAR 437-02-242 and the
City's Solid Waste Management Codes (Chapter 11.04);
2. The compactor and surrounding area will be kept clean at all times;
3. The compactor will undergo regular preventive maintenance and adequate emergency
maintenance shall be available;
4. The compactor and operation of the compactor shall remain in compliance with all
representations made in the application for and the permit issued for the
operation;
5. There will be no operation of the compactor between the hours of 9:00 PM and 7:00
AM.
SAFETY:
No stationary compactor or other container for multifamily residential, commercial or
industrial use shall exceed the safe-loading design limit or operation of the collection
vehicles provided by the franchisee serving the area.
SIGNING•
Each container shall be clearly labeled with the name, address, and telephone number of the
permittee, and the name of a contact person.
HEALTH:
Compactors containing putrescible waste shall be emptied at least weekly.
REIMBURSEMENT FOR FINES:
Permittees shall reimburse the franchisee for any fines incurred by the franchisee for weight
or environmental violations, or any other violation caused by the ownership, operation, or
use of the compactor.
ADDITIONAL CONDITIONS OF APPROVAL:
I hereby certify that I have read and understand the above conditions and standards as they
apply to Stationary Solid Waste Compactors. I acknowledge that this compactor approval may
be revoked if the above conditions have not or are being conducted in a manner contrary to
the Solid Waste Management Chapter of the Tigard Municipal Code Chapter 11.04.

Until recently,most:recycling-professionals felt as though they had
no voice in how the state made fire policy on-the collection and storage of
-.recyclable paper and plastic.But the state fire marshal's office has.ex-

Sec.11.707 Group I and Large SR Occupancies(a)Containers used for the short term storage of combus-
tible;materials for recycling shall.be of a metal or other approved and listednoncombustible material with a self
dosing lid,not to exceed in capacity that of a 15 gallon drum.The container shall be emptied each day.
(b)Containers for long term storage shall be placed outside.away from the building and shall be of a metal
or other noncombustible approved and listed material With a metal or approved noncombustible lid in place at
all times.
