Gerry McReynolds met with City staff and developed the language you will find in the attached 3/12/91 draft of the ordinance. I also asked the City's Legal Counsel, Jim Coleman, to review the draft ordinance and raise policy and technical concerns he saw (see attached 3/11/91 memo from his office) . Lee Kell, Jim Coleman, Gerry McReynolds and myself will be meeting Monday to try and resolve some of these issues prior to the meeting. Besides cleaning up some typographical errors, other changes shown on the 3/12/91 draft ordinance are: 11.04.030 Curbside definition highlighted 11.04. 100(c) Deleted double reference to this section 11.04. 105(c) (3 ) Changed language to include reference to compactor continuing to comply with reqs and the ordinance 11.04 .105(m) Deleted penalties since reference in 11.04 .180 is sufficient and added compactor rule adoption language. The ordinance codified in this chapter shall be known as the "city of Tigard solid waste management ordinance, " and may be so cited and pleaded, and shall be cited herein as "this chapter. " 11. 04 . 020 Purpose, policy and scope of chapter provisions. (a) It is declared to be in the public interest for the city of Tigard to establish this policy relative to the matters of solid waste management to: PAGE 1 - CHAPTER 11. 04 [A47.LDK] (1) Provide sufficient waste volume to sustain solid waste management facilities necessary to achieve resource recovery goals established by the city, county, State Department of Environmental Quality and Metropolitan Service District; (2) Provide the basis for agreements with other governmental units and persons for regional flow control to such facilities; (3) Insure safe accumulation, storage, collection, transportation, disposal or resource recovery of solid waste; (4) Insure maintenance of a financially stable, reliable solid waste collection and disposal service; (5) Insure rates that are just, fair, reasonable and adequate to provide necessary service to the public; (6) Prohibit rate preference and other discriminatory practices which benefit one user at expense of other tigers eus oi€er ; of the service or the general public; (7) Conserve energy and material resources; (8) Eliminate overlapping service to reduce truck traffic, street wear, air pollution and noise; (9) Provide standards for solid waste service and public responsibilities; and (10) Provide technologically and economically feasible recycling by and through solid waste collectors. (b) No person shall: (1) Provide service, offer to provide service or advertise for the performance of service without having obtained a franchise from the city of Tigard; (2) Accumulate, store, collect, transport, dispose of or resource recover solid waste except in compliance with this chapter, other city ordinances, and Chapter 459, Oregon Revised Statutes, dealing with solid waste management and regulations and amendments promulgated under any of the foregoing. 11. 04 . 030 Definitions. (g ) "Recycling" means any process by which solid waste materials are transformed into new products in such a manner that the original products lose their identity. (i=r ) "Reuse" means the return of a commodity into the economic stream for use in the same kind of application as before without a change in its identity. N_ ) "Solid waste" means all putrescibl"e and "ori= 11. 04. 040 Franchise - Granted to Certain Persons - Scope of Regulations. (a) Subject to the provisions of this section, this chapter, the city charter, and any amendments to these documents, there is hereby granted to the following persons an exclusive franchise to provide service within the exclusive area shown within a map of existing franchised areas on the effective date of the ordinance codified in this chapter, which map is hereby attached hereto, marked "Exhibit All, and by reference is hereby incorporated herein. (b) The franchisees are: (1) Area I. Pride Disposal Company, ae Leichner, President, P.O. Box &3'9:$:x10', Sherwood, OR 97140; (2) Area II. Miller"Sanitary Service, Inc. , Thomas Miller, President, 5150 S.W. Alger Avenue, Beaverton, OR 97005; (3) Area III. Schmidt's Sanitary Service, Inc. , John Schmidt, President, 8325 S.W. Ross, Tigard, OR 972233.4:• (c) Where any area is annexed to the city of Tigard and the area had been franchised by Washington County for solid waste collection service prior to annexation, the county franchise shall be recognized as to the area; but service, term and other requirements shall be those of this chapter. If the area was franchised to any of those listed in subsection (b) of this section, the area shall be added by the city ::csact by amendment to "Exhibit A. " For persons other than those listed in subsection (b) of this section, an acceptance of franchise must be signed and recorded as provided in Section 11. 04 . 070 of this chapter. (e) Where a permit is required from the city administrator, it shall be issued only upon a finding that the service is needed, has not been provided by the franchisee or, in the case of fixed base facilities, by other persons. The City Administrator shall give due consideration to the purposes of this chapter. He may attach such conditions as he determines are necessary to obtain PAGE 5 - CHAPTER 11. 04 [A47.LDK] an adequate bookkeeping system showing the gross cash receipts resulting from the solid waste services conducted under the franchise. Records shall be open at all times for audit by authorized personnel designated by the city administrator. (b) Wilful misrepresentation of gross cash receipts by a franchisee shall constitute cause for immediate revocation of the franchise, pursuant to Section 11.04.080 of this chapter. (c) The franchise fee shall be in lieu of any business license or regulatory fee or tax, but shall not be in lieu of any ad valorum tax, imposed by the city of Tigard. 11.04. 070 Responsibility of franchise . (a) The Franchise"*s shall: (1) Resource-recover or dispose of wastes collected at sites approved by the city that are in compliance with Chapter 459, Oregon Revised Statutes and regulations promulgated thereunder; (2) Provide and keep in force public liability insurance with a thirty-day cancellation clause in the ameunt of net less than enured theusand de=lars fer injury te—a- single=gersen-,- ii::.:::::.:::::.::.Y::":! Wlt1 d �C?mb1lTe d sang kit C>:.:::::>4kt ::a : c' C >: relating to a single occurrence which shall be evidenced by a certificate of insurance filed with the city recorder; the insurance shall indemnify and save the city harmless against liability or damage which may arise or occur from any injury to persons or property resulting from the franchisees operation under this chapter; (3) Within thirty days after the effective date of the ordinance codified in this chapter, file with the city recorder a written acceptance of the franchise; (4) Furnish sufficient collection vehicles, containers, facilities, personnel, finances and scheduled days for collections in each area of the city necessary to provide all types of service required under this chapter or subcontract with others to provide such service pursuant to this chapter; (5) Provide a cash security deposit or a performance bond in the amount of five thousand dollars to guarantee payment to the city or other affected person of a judgment secured against the franchise holder because of work performed that does not conform with the requirements of this chapter or other ordinances of the city. The deposit or bond shall continue until one year after expiration of the franchise, or until all claims or demands made against the franchisee have been settled or secured; (6) Collect no single-family residential solid waste before five a.m. or after seven p.m. unless this condition is waived by the city administrator or h4s-designee; (7) Provide collection and disposal of solid waste from all city facilities, city parks, city sidewalk containers and city activity areas at no cost to the city on a regular schedule; PAGE 7 - CHAPTER 11. 04 [A47.LDK] compliance with this chapter and may restrict the term of such permit. The permittee will comply with all applicable provisions of this chapter. (f) Solid waste placed out for collection, whether or not source-separated, belongs to the franchisee when so placed; or, where placed out for collection by a permittee, belongs to the permittee. A franchisee ":: under this subsection (�=(;Z� <�shall comply with all applicable requirements of this chapter: (4) Nothing in this subsection shall prevent the franchisees from instituting on-route recycling prior to a council determination nor from including income and expense in the rate justification section. 11.04 . 050 Franchise--Term-Automatic renewal when. (a) The rights, privileges and initial franchise granted herein shall continue and be in full force to and including the thirty-first day of December, 1988, subject to terms, conditions and payment of franchise fees to the city as set forth in this chapter. (b) Unless the council acts to terminate further renewals of the franchises herein granted, each January 1st, the franchises are automatically renewed for a term of ten years from e- January 1st rental ?. 11. 04 . 060 Franchise--Fees. (a) Effective July 1, 1978, as compensation for the franchise granted to each franchisee and for the use of city streets, the franchisee shall pay to the city a fee equal to three percent of gross cash receipts resulting from the solid waste services conducted under the franchise. Such fees shall be computed on a quarterly basis and paid within thirty days following the end of each quarter calendar year period. Each franchisee shall maintain PAGE 6 - CHAPTER 11. 04 [A47.LDK] (8) Make collection no less often than once each week, except for will-call collections and drop box operations, and except as provided in Section 11. 04. 140; (9) Permit inspection by the city of the franchisee's facilities, equipment and personnel at reasonable times; (10) Respond to all calls for special hauling requiring equipment regularly supplied by franchisee within ninety-six hours of receiving said call unless a later pickup is agreeable to the customer. The purpose of this subsection is to prevent the added cost from being 9 assessed against other ratepayers if the customer later withdraws from service. 11. 04 . 080 Franchise--Transfer, suspension modification or revocation--Conditions. (a) The franchisees shall not transfer this franchise or any portion thereof to other persons without sixty days prior written notice of intent and the subsequent written approval of city council, which consent shall not be unreasonably withheld. The city council shall approve the transfer if the transferee meets all applicable requirements met by the original franchisees. A pledge of this franchise as financial security shall be considered as a transfer for the purposes of this subsection. The city council may attach whatever conditions it deems appropriate to guarantee maintenance of service and compliance with this chapter. (b) Failure to comply with a written notice to provide the services required by this chapter or to otherwise comply with the provisions of this chapter after written notice and a reasonable opportunity to comply shall be grounds for modification, revocation or suspension of franchise. PAGE 8 - CHAPTER 11. 04 [A47.LDKJ (1) After written notice from the city council that such grounds exist, franchisee shall have thirty days from the date of mailing of the notice in which to comply or to request a public hearing before the city council. (2) If franchisee fails to comply within the specific time or fails to comply with the order of the city council entered upon the basis of written findings at the public hearing, the city council may suspend, modify or revoke the franchise or make such action contingent upon continued noncompliance. (3) At a public hearing, franchisee and other interested persons shall have an opportunity to present oral, written or documentary evidence to the city council. The finding of the city council thereon shall be conclusive; provided, however that such action may be reviewed by a court on a writ of review. (4) In the event that the city council finds an immediate and serious danger to the public through creation of a health or safety hazard, it may take action to alleviate such condition within a time specified in the notice to the franchisee and without a public hearing prior to taking such action. 11. 04 . 090 Rates for service. (a) The rates to be charged to all persons by the franchisee shall be reasonable, uniform, and based upon the level of service rendered :>:::< t1ctt ? �cacWS caregttc�ns, haul distance, concentration of dwelling units and other factors which the city council considers to justify variations in rates that outweigh the benefits of having a single rate structure unless otherwise noted in this chapter; (b) Nothing in this section is intended to prevent: (1) The reasonable establishment of uniform classes of rates based upon length of haul; type of waste stored, collected, transported, disposed of, salvaged or utilized; or the number, type an location of customer's service, or uequ; + d lry #sAt » x` guats, or upon other factors as long as such rates are reasonably based upon the cost of the particular service and are approved by the city council in the same manner as other rates; (2) The franchisee from volunteering service at reduced cost for 4re=c1 civic, community, benevolent or charitable program. (c) Rates to be charged by the franchisees under this chapter shall be set by the city council by resolution as deemed necessary by the council. The franchisees shall provide sixty days written notice with accompanying justification for all other proposed rate changes. The council shall give due consideration to the purposes of this chapter and the annual report filed by the franchisees. PAGE 9 - CHAPTER 11.04 ta47.LDK1 (d) The franchisee shall be provided with thirty-day prior written notice with accompanying justification for a city-initiated reduction in rate schedule. (e) Unless a governmental unit or legislative body has raised or lowered the cost of providing service or there is a substantial increase in the cost of doing business that was not provided for in the previous rate adjustment, rate adjustments shall be made annually on the following schedule: (1) On or before March 1st, the franchisee shall file an annual report (Exhibit " ") with the city recorder for the year ending the previous December 31st. (2) The city administrator shall report to the council by April 1st on the franchisee reports and propose rate adjustments if any. �Fe— ` ' t' ? 1 t smaY make such recommendations as appropriate to the rate determination. A copy shall be delivered to each franchisee. (3) The council may set a hearing on any proposed rate adjustment. (4) Unless there is good cause shown and recorded in the minutes of theeeC t')xl: d;.'; : :�'�. l .the council shall act upon any rate adjustment by May 31st, and ..the adjustment shall take effect June 1st. Rate adjustments shall be b resolution and order of the council. ... (5) The reports are required from each franchisee regardless of whether or not a rate adjustment is requested. (f) Emergency rates or an interim rate for a new or altered service may be set by the city administrator; provided, however, that an emergency or interim rate is not valid for more than g Y n six months from the effective date. The city administrator shall report any emergency or interim rate adopted together with justification to the council for action by resolution and order, if the rate is to continue for more than six months. (g) Rates established by the council are fixed rates and the franchisee shall not charge more or less than the fixed rate unless pursuant to subsection (b) (2) of this section. (h) Nonscheduled services shall be charged at the reasonable cost of providing the service taking into consideration the factors in subsection ) ( ac (c) of this section and as determined by franchisee. (i) In establishing rates, the council may set uniform rates, uniform rates by zone and different rates for collectors where there is a service and cost justification. (j) Until changed by the council, rates to be charged are those in effect on the effective date of the chapter. PAGE 10 - CHAPTER 11. 04 [A47.LDK] (k) If approved in a rate schedule, a "start charge" for new service and a "restart charge" for reinstituted service may be added. (1) Franchisee may request and the council shall schedule a public hearing on the application for adjustment or action of the council where no public hearing has been held prior to rate determination. (m) Franchisee may require payment for residential and multi- family residential service up to three months in advance, and may bill up to three months in advance, arrears, or any combination. Where billed in advance, franchisee will refund a prorated portion of the payment for any complete months in which service is not to be provided. Where billed in advance, no rate adjustment shall be effective until the end of the advance payment. (n) Any person who receives solid waste service from the franchisees shall be responsible for payment for such service. The owner of a rental or lease facility shall be liable for payment for services provided to a tenant of such dwelling if the tenant fails to make timely payment for such services. The owner of any multiple-unit rental or lease facility having two or more units shall be primarily responsible for services provided to the occupants of such facility, and shall be billed for the services. No person shall, without authorization and compliance with the disposal site requirements of this chapter, deposit waste on public property or the private property of another. Streets and other public places are not authorized as places to deposit waste except as specific provisions for containers have been made. 11.04. 130 Interruption of franchisee's service. The franchisee agrees, as a condition of a franchise, that whenever the city council finds that the failure of service or threatened failure of service would result in creation of an immediate and serious health hazard or serious public nuisance, the city council may, after a minimum of twenty-four hours' actual notice to the franchisee and a public hearing if the franchisee requests it, provide or authorize another person to temporarily provide the service or to use and operate the land, facilities and equipment of a franchisee to provide emergency service. The city council shall return any seized property and business upon abatement of the actual or threatened interruption of service, and after payment to the city for any net cost incurred in the operation of the solid waste service. 11. 04 . 140 Termination of service by franchised. The franchisee shall not terminate service to all or a portion of his >�customers unless: ( ) The street or road access is blocked and there is no alternate route and provided that the franchisee shall restore service not later than twenty-four hours after street or road access is opened; ( -Z) As determined by the franchisee, excessive weather conditions render providing service unduly hazardous to persons providing service or to the public or such termination is caused by accidents or casualties caused by an act of God, a public enemy, or a vandal, or road access is blocked; ( 3) A customer has not paid for provided service after a regular billing and after a seven-day written notice from the date of mailing, which notice shall net be sent c '';less than fifteen days after the first regular billing; or ( 4) Ninety days written notice is given to the city council and to affected customers and written approval is obtained from the city council; (ems) The customer does not comply with the service standards of Section 11. 04. 100 of t-he this chapter. 11. 04 . 150 Subcontracts. The franchisees may subcontract with others to provide a portion of the service where the franchisees do not have the necessary equipment or service capability. Such a subcontract shall not relieve the franchisees of total responsibility for providing and maintaining service and from compliance with this chapter. Coleman'; City Attorney's Office RE: 2/27/91 Draft of Solid Waste Management Franchise Ordinance At your request, I have reviewed the referenced draft and provide to you the following comments. These comments are broken into two categories, the first being provisions which raise policy issues, and the second being technical changes which will help in the implementation of the ordinance. POLICY 1. Section 11. 04. 040(6) . Construction Waste This subsection allows a contractor to use its own forces to clear a construction site of construction waste. No other person may be employed to provide this service, as has been the practice in many cases. The draft of the Metropolitan Service District Special Waste Chapter for the Regional Solid Waste Management Plan encourages the recycling of construction waste and encourages local governments employ methods which will accomplish that goal. The policy choice is presented whether construction waste removal will be limited to the franchise holder or can be contracted out by the building contractor to a third party not holding a franchise. In order to carry out the goal in the Metro draft policy, in either approach an emphasis on recovery and recycle of materials should be made. That emphasis may be accomplished through the franchise, or through a permit process for third party haulers. 2. Section 11.04. 040(d) . Recycling of Business Waste. Subsection (d) provides the exceptions from the requirement of the franchise ordinance that all solid waste be collected and disposed of by the franchise holder. Subsection (d) (1) provides an exception for the collection and transportation of residential waste by the person that produces that waste. Likewise, there is no opportunity for a business or a resident to sell recyclable materials to a person who comes to the site and transports that material. The Metro Solid Waste Management Plan Policies encourages waste reduction and recycling and requires the City to design its collection programs carry out this policy in an "efficient and reliable" manner. The Council should decide if this franchise restriction carries out that policy. 3 . Section 11.04.040 (I) . Opportunity for On-Route Recycling This subsection provides a process by which the City Council can require on-route recycling when it is "technologically and economically" feasible. ORS 459.200 and the Metro Solid Waste Management Plan currently require on-route recycling. Section 11. 04 .070(11) is an addition to the franchise which requires a provision of an opportunity to recycle, including on-route recycling. The two sections are inconsistent. Therefore, the apparent conflict should, at a minimum, be clarified with the franchisee's and probably the referenced provision in subsection .040 (I) should be deleted as unnecessary. 4 . Section 11.04. 050(B) . Automatic Renewal This subsection provides for the automatic renewal of the franchise on the first of January of each year for a 10 year term, unless the Council acts to terminate further renewals. The Council has the choice of creating a set term for this franchise, eliminating the automatic renewal provision. An option that could also be employed would be continuing the automatic renewal provision subject to the City reserving for itself the unilateral ability to initiate amendments as it deems necessary to the terms of the franchise. The arguments in favor of current term provision include the need on the part of the franchise holder for certainty as a basis for investment and expenditures related to the equipment used in providing the service. Section 11.04. 070. Indemnity Provision Subsection (A) (2) of this section places a public liability insurance requirement on the franchise holder. This section requires that the insurance shall indemnify and save the City harmless from liability arising from injury to persons or property resulting from franchisee's operation under the Chapter. I suggest that this requirement be expanded to include the defense of any claims that are brought against the City by any person as a result of the franchisee's operation of the Chapter, and a similar addition to the indemnity provision. In many cases, the cost of defense exceeds the amount of the claim. 6. Section 11.04. 090. Rates (a) Subsection (C) provides for an automatic increase in rates for solid waste disposal site fees imposed by governmental agencies and "charges to the franchisee by governmental agencies regulating solid waste management. " While it is unlikely that these fees would go down, you may want to consider making the pass-through of a decrease also an automatic change. The Council may want to clarify what "charges" are included in the second class of automatic pass through charges. A general business tax arguably fits within this description. (b) You may want to require or to create an obligation for the franchise holders to provide financial information, including audited financial statements, upon a request of the Council when necessary to adequately analyze rate adjustment requests. (c) Subsection (N) of this section places upon the owner of a rental or lease facility responsibility for payment of services provided to the occupants of the facility, and requires that the owner of a multi-unit rental be billed and be primarily responsible for the services. This arrangement creates a potential problem with this charge for solid waste disposal services being classified as a tax for the purposes of Ballot Measure 5. As structured, O'DONNELL, RAMIS, CREW & CORRIGAN Memo re: 2/27/91 Draft of Solid Waste Management Franchise Ordinance March 11, 1991 Page 4 this charge upon the property owner may be "due to ownership of property or a direct consequence of ownership" under definitions contained in the proposed implementation legislation for Ballot Measure 5. I suggest that the section be deleted and that the franchise holders be required to seek payment from the user of the service and not from persons solely due to their status as a property owner. 7. Section 11. 04 . 100. Container Requirements This section provides, in great detail, for the type and location of the containers to be used by customers. Subsection (12) requires that customers "supply a location and properly maintain the container so that they meet the standards of the Consumer Products Safety Commission. " It is unlikely that the City and customers are going to have any idea what those standards are or what those standards require. If more detail is necessary to insure compliance with those standards, that detail should be built into the ordinance at this time and not referred to with such a vague reference. 8. Section 11. 04 . 105 (M) . Annual Inspection Requirement This subsection of the compactor provisions for this ordinance requires the City to engage in an ongoing notification and inspection process for the compactors. By creating such a regulatory program, the City is assuming a new tort liability exposure if the regulatory program is not carried out in a reasonable manner. The program is not one that is required by law, and it is optional whether the City chooses to actively involve itself in the regulation of compactors once the siting permit is issued. 9. Section 11.04. 180. Penalties (a) This subsection classifies a violation of a variety of provisions of this ordinance as a Class A misdemeanor. That is a choice that the City can make. However, that classification carries with it the opportunity for defendants of a court appointed counsel, trial by jury, and a burden of proof on the City of "beyond a reasonable doubt" in proving the violation. The criminal process is generally more expensive than a civil enforcement • i O'DONNELL, RAMIS, CREW & CORRIGAN Memo re: 2/27/91 Draft of Solid Waste Management Franchise Ordinance March 11, 1991 Page 5 process. Council may want to consider decriminalizing the provisions of this ordinance and using the civil infraction process. In the conversation we had last week, you expressed the desire to maintain the criminal sanction in order to retain the ability to jail a person who refuses to comply with the provisions of the code. There are provisions in ORS Chapter 30 which allow the City to go into circuit court to enforce provisions of its ordinance. Failure to comply with a circuit court order can lead to a contempt order, with the threat of jail as a consequence. If the need for the threat of jail time occurs on a very infrequent basis, it may be that for administrative purposes the decriminalization of violations, with resort to the circuit court when necessary, would increase the efficiency of the enforcement process and minimize the cost. (b) Another enforcement opportunity that may be created is to provide for a private right of enforcement on the part of the franchise holder. This ordinance currently places the entire enforcement burden upon the City. By allowing the franchise holder to enforce provisions dealing with persons who are accepting and transporting solid waste without a franchise, the real party in interest, which is the franchise holder, would have an opportunity to act on their own behalf. That would result in enforcement at a lower cost to the City. Another opportunity to reduce City enforcement costs, would be to provide in the ordinance that the franchise holder reimburse the City for enforcement actions taken essentially on behalf of the franchise holder to prevent unauthorized persons from hauling solid waste. TECHNICAL CHANGES 1. 11. 04. 020(b) (2) The reference to "other City ordinances" should be to the City code. i O'DONNELL RAMIS CREW & C09RIGAN Memo re: 2/27/91 Draft of Solid Waste Management Franchise Ordinance March 11, 1991 Page 6 2. 11. 04. 030(d) . The definition of person contains a reference to a "industry. " It is not clear what that means and the reference seems too broad. The deletion of the word "industry" leaving the words individual, partnership, association, corporation, should cover all circumstances. We should inquire of the franchisees what the intent was with the addition of the word industry. 3 . 11. 04.030(8) , (j) , (k) , (1) . Depending on the Council 's policy determinations concerning commercial recycling and construction waste, there may need to be adjustments to this series of definitions. All of these definitions when read together provide the scope of "service" which is the activity guaranteed solely to franchise holders by this franchise. 4. 11.04. 040 This section deals with the treatment of areas annexed to the City. We need to be sure that provisions of this subsection are consistent with ORS 459.095(3) . That section of the state law allows for coordination of transfer of service means between the County and the City for annexed areas. I am not familiar with the current relationship between the City and the County and what agreements may have been entered into in the past. This section may or may not need change depending on the coordination of that relationship. I will follow up on this section and prepare necessary changes for the final draft. 5. 11.04. 040 (12) . This section allows nonprofit charitable and civic organizations to collect and recycle waste. However, it requires those organizations to either obtain a subcontract from the franchisee or a permit from the City Administrator. Subsection (e) of this section states that if a permit from the City Administrator is required, it shall be issued only under particular circumstances, i.e. , that the service is needed and that it has not been provided by the franchisee. These sections seem to be inconsistent in that sub (12) allows an exception for nonprofit activities, but that exception is • • O'DONNELL, RAMIS, CREW & CORRIGAN I Memo re: 2/27/91 Draft of Solid Waste Management Franchise Ordinance March 11, 1991 Page 7 II subject to a veto of such activities by the franchisee. If the intent is that the charitable organizations be allowed to recycle waste, then the requirement for permits and subcontracts which allow a franchisee veto should be deleted. 6. 11. 04. 040(h) . This section prohibits persons from taking or removing solid waste which has been "placed out for collection. " This term is not defined and in reviewing the file, it has created some confusion concerning under what exact circumstances waste has been subject to this restriction. We should work with the franchisees on a definition of this term to aid the City in its enforcement process. 7. 11. 04.090. i Subsection (a) of this section leaves to the Council great discretion in the types of factors that it will consider in evaluating a rate change request. If the City deems it advisable, a subsection could be inserted here which would provide a set of more specific criteria or standards that the Council would consider in evaluating rate adjustment requests. A subsection is not necessary but it could be helpful to the staff and the Council in guiding its analysis of such requests. In subsection (c) , the rate adjustment is to be implemented by Council resolution. Subsection (e) (4) requires that the rate adjustment be put into effect by resolution and "order" of the Council. These sections are inconsistent and one method of implementation of rate changes should be chosen. The resolution format is sufficient. B. 11.04 . 100(11) . There is a requirement here that containers shall be cleaned by the customer or a "user. " I suggest the deletion of the term user and leave the term customer. That term is defined and is the person who receives the service. The addition of the word "user" simply raises confusion. The definitions contained in this subsection should be moved to the definition section. 10. 11.04. 130. This section gives the franchisee a right to a public hearing if the Council determines that there has been a failure to provide service. I would suggest the addition in this section that if a public hearing is requested it may be held immediately. The nature of the hazard giving rise to the Council's determination to provide service may override normal consideration through a typical notice and hearing process. 11. 11. 04. 150. I suggest the addition of a requirement of prior written notice to the City of the franchisee's intent to subcontract. 12 . 11. 04. 170. This section authorizes the entry of premises for the purpose of determining compliance with the provisions of the chapter. I will provide some additional language for the final draft which provides guidance to the City administration in the exercise of this administrative search provision. Additional technical changes for the purpose of internal consistency and clarification may be necessary after the Council has reviewed this draft ordinance and made its policy decisions. I propose that I provide the next draft of this ordinance rather than the franchisee's attorney. I make that suggestion because this ordinance is just about in its final form and in the next drafting process all of the additional technical changes can be accomplished at the same time that the policy choice changes are drafted. The meeting was attended by Attorney for the City - Jim Coleman, Attorney for the Haulers - Lee Kell, U & F Committee Chair - Gerry McReynolds, and U & F Committee Staff Liaison - Loreen Edin. Following is a synopsis of the issues outlined in Attorney Coleman's memo and the tentative result of the meeting today for the Committee's review. LISTED UNDER POLICY ISSUES Item #1 & #2 - Policy issue - third party hauling of purchased recyclable goods. These two issues are no longer policy issues. Agreement was reached that Attorney Coleman would draft language consistent with state statute that would exempt from the franchise materials that are source separated by the generator and sold to a third-party hauler at fair market value. Item #3 - Technical clarification - opportunity for on-route recycling. No longer an issue. Attorney Coleman will draft new language to clarify that 11.04.040(i) is in addition to 11.04.070(a) (11) . Item #4 - Policy issue - automatic renewal of franchise term and ordinance amendment process. These are still policy issues for Council to discuss. Committee will revisit this tonight. Item #5 - Policy issue - indemnity provision. No longer an issue. Attorney Coleman will draft new language to state that any claims brought against the City by any person as a result of the franchisee's operation of the Chapter would be covered by franchisee's insurance policy.
