After your discussion Monday evening, we will need a motion to forward the ordinance to the Council with a recommendation of approval. Should the Committee want to direct a written recommendation to the Council, I would need to receive that no later than Thursday, May 30th, for inclusion in the Council's meeting packet. Attached is the newest draft of the ordinance. This combines comments from your last meeting and comments from Jim Coleman and Lee Kell. Following is a list of the changes made and issues left to discuss. I asked Lee Kell whether he had a recommendation regarding the City's suggestion that another enforcement opportunity could be created to allow the franchise holders to also enforce provisions dealing with persons who are accepting and transporting solid waste without a franchise. The ordinance codified in this chapter shall be known as the "city of Tigard solid waste management ordinance," and may be so cited and pleaded, and shall be cited herein as "this chapter." 11.04.020 Purpose, policy and scope of chapter provisions. {a} It is declared to be in the public interest for the city of Tigard to establish this policy relative to the matters of solid waste management to: (�} Provide sufficient waste volume to sustain solid waste management facilities necessary to achieve resource recovery goals established by the city, county, State Department of Environmental Quality and Metropolitan Service District; {�- Provide the basis for agreements with other governmental units and " persons for regional flow control to such facilities; {�} *_ Insure safe accumulation, storage, collection, transportation, disposal or resource recovery of solid waste; '••#- Insure maintenance of a financially stable reliable solid waste collection and disposal service; Revised 5/10/91 Page 1 Insure A that are just, fair, reasonable and adequate to provide necessary service to the public; Prohibit rate preference and other discriminatory practices which benefit one a expense of other esus- � of the service or the....g.e.n.e..r at er I public; Conserve energy and material resources; +84'*'.--..'- Eliminate overlapping service to reduce truck traffic, street wear, air pollution and noise; Provide standards for solid waste service and public responsibilities; and Provide technologically and economically feasible recycling by and through solid waste collectors. MM.'M and other wastes. +.I+ For the purpose of this subsection, "waste" means any material that is no longer wanted by or is no longer usable by the generator, producer or source of the material, which material is to be disposed of or to be resource-recovered by another person. The fact that materials, which would otherwise come within the definition of "waste" may from time to time have value and thus be resource-recovered does not remove them from this definition. He may attach such conditions as he determines are necessary to obtain compliance with this chapter and may restrict the term Of such permit. The permittee will comply with all applicable provisions of this chapter. Solid waste placed out for collection, whether or not source-separated, belongs to the franchisee when so placed; or, where placed out for collection by a permittee, belongs to the permittee. The purpose of this subsection is to prevent the added cost from being assessed against other ratepayers if the customer later withdraws from service. Revised 5/10/91 Page 7 11.04.080 Franchise--Transf*suspension, modification or reecation--Conditions. {ar The franchisees shall not transfer this franchise or any portion thereof to other persons without sixty days prior written notice of intent and the subsequent written approval of city council, which consent shall not be unreasonably withheld. The city council shall approve the transfer if the transferee meets all applicable requirements met by the original franchisees. A pledge of this franchise as financial security shall be considered as a transfer for the purposes of this subsection. The city council may attach whatever conditions it deems appropriate to guarantee maintenance of service and compliance with this chapter. { Failure to comply with a written notice to provide the services required by this chapter or to otherwise comply with the provisions of this chapter after written notice and a reasonable opportunity to comply shall be grounds for modification, revocation or suspension of franchise. {3�- _ After written notice from the city council that such grounds exist, franchisee shall have thirty days from the date of mailing of the notice in which to comply or to request a public hearing before the city council. If franchisee fails to comply within the specific time or fails to comply with the order of the city council entered upon the basis of written findings at the public hearing, the city council may suspend, modify or revoke the franchise or make such action contingent upon continued noncompliance. f3} At a public hearing, franchisee and other interested persons shall have an opportunity to present oral, written or documentary evidence to the city council. The finding of the city council thereon shall be conclusive; provided, however that such action may be reviewed by a court on a writ of review. In the event that the city council finds an. immediate and serious danger to the public through creation of a health or safety hazard, it may take action to alleviate such condition within a time specified in the notice to the franchisee and without a public hearing prior to taking such action. 11.04.090 Rates for service. Where billed in advance, franchisee will refund a prorated portion of the payment for any complete months in which service is not to be provided. Where billed in advance, no rate adjustment shall be effective until the end of the advance payment. { Any person who receives solid waste service from the franchisees shall be responsible for payment for such service. The owner of a rental or lease facility shall be liable for payment for services provided to a tenant of such dwelling if the tenant fails to make timely payment for such services. The owner of any multiple-unit rental or lease facility having two or more units shall be primarily responsible for services provided to the occupants of such facility, and shall be billed for the services. fe}t Franchisee may charge at time of service for drop-box service or for any customer who has not established credit with franchisee. 11 04.100 Container requirements and collection limitations. In addition to compliance with ORS Chapter 459 and regulations promulgated pursuant thereto and in Section 11.04.100: 1. The franchisee shall not terminate service to all or a portion of 4i-elth customers unless: 1. The street or road access is blocked and there is no alternate route and provided that the franchisee shall restore service not later than twenty-four hours after street or road access is opened; 2. As determined by the franchisee, excessive weather conditions render providing service unduly hazardous to persons providing service or to the public or such termination is caused by accidents or casualties caused by an act of God, a public enemy, or a vandal, or road access is blocked; 3. A customer has not paid for provided service after a regular billing and after a seven-day written notice from the date of mailing, which notice shall net-be sent less than fifteen days after the first regular billing; or 4. Ninety days written notice is given to the city council and to affected customers and written approval is obtained from the city council; 5. The customer does not comply with the service standards of Section 11.04.100 ofe= hapter. 11.04.150 Subcontracts. The franchisees may subcontract with others to provide a portion of the service where the franchisees do not have the necessary equipment or service capability. Mayo Edwards also attended. In addition to the County, nine of the ten cities involved were represented, King City was not. A copy of Steve's statement is attached. In summary, he expressed sadness and alarm that Metro is no closer to putting in place a transfer station system in Washington Count than it was five ears Y g Y Y ago.. He also criticized the "delaying tactics" by the Metro Council leadership. After Steve read his statement, Mayor Clark of Forest Grove, Mayor Huffman of Hillsboro, City Manager Huff of Wilsonville and John Atkins of Beaverton made comments. All were critical of .Metro and the process and emphasized the cooperation among the Washington County jurisdictions and hours that went into developing the plan. Matt Buckingham of the Times and Janet (Geisler?) of the Oregonian were in attendance. They both had questions primarily about the subsidy issue raised by the Metro subcommittee. Mayor Edwards spoke last. He expressed frustration that the media had not been involved in the process and was trying to "catch up" on two years of work in 30 minutes. He cited this as an example of the difficulty that local officials have trying to communicate complex issues to the public. WASHINGTON r� COUNTY, OREGON STATEMENT OF STEVE LARRANCE CHAIR,WASHINGTON COUNTY SOLID WASTE SYSTEM DESIGN STEERING COMNIlTTEE WEDNESDAY,MAY 8 Five years ago METRO created regional warfare in what the courts determined was an illegal attempt to site a mega-solid waste transfer station in Washington County. Since that time the local governments and private industry in Washington County, METRO staff,and several METRO Councilors have been through an exhaustive,open,multi-year decision-making process and developed a workable,effective solution to the transfer station issue. Yet today I must tell you with a great deal of sadness and alarm that METRO is no closer to putting in place a transfer station system in Washington County than it was five years ago. Why? Because the leadership of the METRO Council is determined not to adopt the Washington County Plan. Presiding Officer Tanya Collier, Council Solid Waste Committee Chair Judy Wyers, and METRO Council Staff Director Don Carlson are.using every tactic imaginable to stall passage of the Washington County Plan,or to amend it to the point that it will not work and will not be supported. The latest of a long series of unconstructive delay tactics occurred last night at the METRO Council Solid Waste Committee meeting where Chairwoman Wyers announced that she intended to propose substantive amendments to fundamental components of the Washington County Plan and further delay action on the Plan through a series of additional Committee meetings. Last October,eight months ago,the people in this room,the local governments and private solid waste industry in Washington County,presented the Washington County solution to solid waste facilities to the METRO Council. Its primary features included: •Expansion of the existing privately owned transfer station in Forest Grove; •A new privately owned transfer station/material recovery center in Wilsonville; • A third site in the Hillsboro area if shown to be necessary 10 years from now; and • A privately owned high-grade processing facility in the Highway 217 corridor in the Beaverton area. That Plan has the support of an impressive list of people,a testament to the cooperative process which was used to develop it. The Plan has: •The unanimous support of the Washington County Board of Commissioners and city councilors in ten cities (Beaverton,Forest Grove,Hillsboro,Cornelius,Tigard, Wilsonville,Sherwood,Durham,King City and Tualatin); •The support of METRO's Executive Officer Rena Cusma, METRO's Planning and Development Director Rich Carson,and METRO's Solid Waste Director Bob Martin; •The support of we believe half of the METRO Councilors; and •The support of the private solid waste industry,including 26 franchised haulers in Board of County Commissioners 155 North First Avenue, Suite 300 Hillsboro, Oregon 97124 Phone: 503/648-8681 Washington County. We deeply appreciate the support and leadership exhibited by each and every one of these people. The Plan has been subjected to what we have been told is fair to characterize as the most sophisticated technical and financial analysis ever conducted on a solid waste plan. That analysis, conducted by highly qualified independent engineers and economists hired by the METRO Council,concluded without qualification that the County's Plan is practical,cost-effective and consistent with METRO policies. The Plan also has met the test of thorough legal analysis by METRO's counsel,Dan Cooper. The delaying tactics by the METRO Council leadership pose a direct threat to the interests of the people of Washington County and every other person in this region for a number of reasons. Just one example of this damage is the affect of the delay on our region's waste recyling capabilities. Every day that Washington County waste continues to go to transfer stations which do not have any recycling capability,which is currently the case,fills up the landfill in Arlington that much faster. The Washington County Plan calls for state-of-the-art recycling capabilities at three major facilities in the County. We have tried in every way we know to cooperate,coordinate and communicate with the leadership of the METRO Council. We have invited them to join our Steering Committee. We have invited them to joint working sessions. We have testified at their meetings. We have written them letters. We have talked with them privately. Nothing has worked. We are here today in a final attempt to be heard. We have been flexible,we have compromised,we have fashioned the Plan not only to be consistent with METRO's regional solid waste system,but to be the very best part of that system. Our message to the METRO Council leadership is clear and simple: You have our Plan. That Plan is what will work in Washington County. We have done our job. Now it is time for you to do yours. There are three monthly forms to accommodate your 2nd quarter company activities. Note that the form is to be filled out for your total recycling activities within Washington County. This means one company, one month, one form, one total for all jurisdictions in Washington County within which you operate. You do not need to fill out a separate form for the County and/or each city. If you perform collection outside Washington County, then those specific numbers should be reported on the City of Portland or Clackamas County forms. You do not need to make these reports more difficult for yourself. There are a couple of companies from which I have not received information. Be aware that Metro will be looking to the County/city and DEQ for enforcement of these report forms. They should be returned to the County by the 15th of the month following each reported month. Also present: Lee Kell, Legal Counsel (for Haulers) ; Jim Coleman (City's Legal Counsel for Solid Waste) . City Staff: Loreen Edin, Administrative Services Risk Manager. CITY COUNCIL MEETING MINUTES - MARCH 26, 1991 - PAGE 1 • • Chair McReynolds reviewed a committee report on 1990 activities. (See memorandum from Gerry McReynolds to City Council dated 3/25/91 which has been filed with the Council packet material. ) Chair McReynolds noted the evolvement of the Committee since its creation several years ago. Because of some of the changes which have taken place, he suggested a reexamination of the Committee's scope and role would be in order. He advised that the Committee desires that their responsibilities, relationships and direction be clearly defined by the City Council. Another concern outlined was that the Committee developed financial reporting and a review process a few years ago and it needed better definitions and instructions to assure consistent reporting among the haulers. The audit requested would review allocation techniques and procedures along with establishing that the proper franchise fees have been paid. It was recommended that the audit be conducted by an independent firm. There was discussion on the areas of concern and future goals and role of the U & F Committee. Included in the discussion were the benefits that would be gained by an audit of the solid waste haulers' 1990 financial reports. There was discussion on the areas served by the haulers and the profit margins afforded each of the haulers in their areas. The desire to put into place a fair system to the haulers was discussed. Another issue which has been controversial includes the construction waste issue. This concerns private haulers vs. the franchise haulers cleaning up debris from construction sites. Council discussed the range of issues that were coming before the Utility and Franchise Committee. Chair McReynolds referenced his concern with regard to the City's emphasis being changed from licensing and protecting the citizenry to one of avoiding risk and liability. Mayor Edwards advised that the work and accomplishments of the U & F Committee members has shown him that the Committee is worthwhile. He placed value on the input and concerns expressed by the Committee. The Mayor said a review was needed to determine if the Committee is being asked to make policy decisions which, he felt, were outside of the Committee's responsibilities. He commended the group on their response to the issues, sometimes volatile in nature, which have been brought to them. The Mayor advised that items listed in Chair McReynolds report with regard to future direction contains items he would also agree the committee should work on over the next year. He mentioned he could think of several other issues which the Committee may want to review. Every one of the goals listed was time consuming. He noted he believed an audit as outlined by CITY COUNCIL MEETING MINUTES - MARCH 26, 1991 - PAGE 2 • • Chair McReynolds was necessary. City Administrator advised that the view of staff has been one that the U & F Committee is the administrator of the solid waste ordinance. At times, issues take on a broader perspective than originally thought. It is difficult, in some instances, to draw the line between when an interpretation of policy is being made or when, in fact, new policy is being established. New policy would be directed to the Council for their consideration. Risk Manager Edin advised that there have been times over the last year when legal interpretation advice was sought from the City's legal counsel. Discussion ensued on the evolvement of the U & F Committee and their role as the administrators of the solid waste ordinance. Councilor Johnson commented on the activity of the last year and situations experienced by the Committee. She suggested that, perhaps, a more formal process for hearing (i.e. , public hearing type process) matters concerning their realm of responsibility was necessary. This would include access to the City Attorney's office for assistance. City Administrator advised that it would need to be affirmed if the Committee was the administrative board for the Solid Waste Ordinance. Mayor Edwards agreed with Councilor Johnson in changing the formality of proceedings for the U & F Committee. He noted that Council may not have the time to deal with all issues. As with the Planning Commission, it may be time to establish an appeal process to Council if an issue is disputed at the U&F Committee level. Discussion followed. City Administrator advised that it would not be difficult to prepare a rough outline of proposed scope of U&F Committee and report back to Council. It was noted that the Committee, at its March 18, 1991 meeting, voted unanimously to recommend no solid waste increase based on the 1990 annual report review. A pass-through rate increase will be recommended at a future date to reflect increased dumping fees from METRO effective July 1, 1991.
