- UTILITY AND FRANCHISE MINUTES

Council Workshop -- a week from Monday
Workplan review
Recycling program under way
Solid waste franchise under way
Need definition for storm drain and sanitary sewers -- needs improvement
Lists of new address sent to haulers not complete -- no notice of changes due
to annexation, only getting new addresses and subdivisions -- Wayne will check .
Haulers raised problem of new buildings which don't contact them in regards to
waste disposal plans . City has specifications for screening but not signing
or how much for sign building -- ordinance states screening should be
compatible with haulur' u equipment. Code can be enforced. If no codes need
to provide some. Haulers would like to be able to work with builders -- less
expensive for both.
PNB doesn't want to include competitive services -- difference for 1086, 9
percent of total, of both would be about 0,000 - 18,800. Will classify some
services an competitive. Mobil Centrex, radio type services . Allnet, Sprint
- bulk wholesales, using other lines . Are we paid for microwave rights?
Could it be enforced . Eugene's franchise rate for PNB 5 percent. Salem
franchise rate is 3 percent.
City attorney -- if we think its fair only legal work is to rewrite
ordinance. Otherwise, legal research could be expensive.
If we 6n for PNB should do for GTE - fairness . Don't want to incur legal fees
to hold out if Salem and Eugene have yielded and Portland probably will go
uut. PNB has option to convert franchise - share of Tigard resource increased
by Metzger.
What would it coot us if OTE requests same thing? Wayne will attempt to find
out. Is GTE paying on some services?
Will raise questions of raising franchise fees at Council Workshop.

PNB pays in March for calendar year. Barrett moved that PNB request be tabled
until further information on raining rate' George seconded, motion passed .
�TE has provision for raising franchise fees if hi6^_�' fee granted to any
other City in Oregon. —
Larry brought up Lions ' collection of newspapers -- forbidden by franchise.
He requested poundage of DEQ, hasn' t received. Not receiving profitable items
for reoyoling. Last year Lions made $16,000 from recycling. Haulers not
getting credit from DEQ for compliance with Senate bill. Also, cardboard in
hauled by some commercial people from Tigard Plaza and Pietrn'u .
Larry is concerned about reporting Revenue is lost. Wayne suggested letter
to community directur, of King City will required sales campaign to stop,
(37erry requested name,, and organizations at next meeting. Use Keith or City
enforcement officer to get reporting and/or ruxunue. Committee can't really
solve problem. Tom asked for understanding when DEQ questions about numbers .
