DESIGNATIONS: R-3.5: Low-Density Residential District. The R-3.5 zoning district is designed to
accommodate detached single-family homes with or without accessory
residential units at a minimum lot size of 10,000 square feet. Duplexes are
permitted conditionally. Some civic and institutional uses are also permitted
conditionally.
C-G: general commercial district. The C-G zoning district is designed to
accommodate a full range of retail, office and civic uses with a city-wide and
even regional trade area. Except where non-conforming, residential uses are
limited to single-family residences which are located on the same site as a
permitted use. A wide range of uses, including but not limited to adult
entertainment, automotive equipment repair and storage, mini-warehouses,
utilities, heliports, medical centers, major event entertainment, and gasoline
stations, are permitted conditionally.

SECTION II. DECISION
Notice is hereby given that the City of Tigard Community Development Director's designee has
APPROVED the above request subject to a condition of approval. The findings and conclusions on
which the decision is based are noted in Section IV.
CONDITION OF APPROVAL
THE FOLLOWING CONDITION SHALL BE SATISFIED
1. The applicant shall record the lot line adjustment with Washington County, and submit a copy of
the recorded survey map to the city within 15 days of recording to be incorporated into the record.
THIS APPROVAL SHALL BE VALID FOR 18 MONTHS
FROM THE EFFECTIVE DATE OF THIS DECISION.
SECTION III. _ BACKGROUND INFORMATION
Site Information:
The subject parcels are located north of SW Pacific Highway, south of SW Park Street, and west of SW
Watkins Avenue. Parcel 1 is an 18,256-square-foot corner lot with frontage on both SW Park Street and
SW Watkins Avenue, and is located in the R-3.5 zone (Low-Density Residential). Parcel 2 is 14,574
square feet in size, has approximately 158 feet of frontage on SW Park Street,and is located in both the
General Commercial (C-G) and R-3.5 zones. Parcel 1 is currently occupied by a detached, single-family
dwelling with a paved driveway, multiple accessory structures, and associated landscaping. Parcel 2 is
currently vacant and undeveloped. The applicant requests this lot line adjustment to match up the
property line between Parcels 1 and 2 with the current zoning district boundaries. Accordingly, as a
result of this lot line adjustment, Parcel 1 will be solely located in the R-3.5 zone, and Parcel 2 will be
solely located in the C-G zone. The resulting lot sizes will be 23,782 square feet for Parcel 1, and 9,048
square feet for Parcel 2.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS
COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS:
LOT LINE ADJUSTMENT - APPROVAL CRITERIA: Tigard Development Code (TDC)
Section 18.410.040 contains the following criteria for approval of a Lot Line Adjustment request:
Section 18.410.040
A. Approval Criteria states that the Director shall approve or deny a request for a lot line
adjustment in writing based on findings that the following criteria are satisfied:
1. An additional parcel is not created by the lot line adjustment, and the existing parcel
reduced in size by the adjustments is not reduced below the minimum lot size
established by the zoning district;
No additional parcels will be created through this application. As a result of this lot line adjustment,
Parcel 1 will be solely located in the R-3.5 zone, and Parcel 2 will be solely located in the C-G zone.
The minimum lot size for the R-3.5 zone is 10,000 square feet; accordingly, Parcel 1 will exceed this

requirement because it will be 23,782 square feet in size. There is no minimum lot size for the C-G
zone; accordingly, Parcel 2 will meet this requirement because it will be 9,048 square feet in size. This
criterion is met.
2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the
site development or zoning district regulations for that district;
Staff reviewed the applicant's narrative and submitted site plan to determine that this lot line
adjustment will not result in any violations of the site development or zoning district regulations for the
for the R-3.5 and C-G zones.This criterion is met.
3. The resulting parcels are in conformity with the dimensional standards of the zoning
district,including:
a. The minimum width of the building envelope area shall meet the lot
requirement of the applicable zoning district;
As a result of this lot line adjustment,Parcel 1 will be solely located in the R-3.5 zone,and Parcel 2 will
be solely located in the C-G zone. The minimum lot width for the R-3.5 zone is 65 feet for lots with
detached units, and the minimum lot width for the C-G zone is 50 feet. Staff reviewed the applicant's
submitted site plan to confirm Parcel 1 exceeds the minimum lot width for the R-3.5 zone,and Parcel 2
exceeds the minimum lot width for the C-G zone.This criterion is met.
b. The lot area shall be as required by the applicable zoning district. In the case of
a flag lot,the access way may not be included in the lot area calculation;
As a result of this lot line adjustment,Parcel 1 will be solely located in the R-3.5 zone,and Parcel 2 will
be solely located in the C-G zone. The minimum lot size for the R-3.5 zone is 10,000 square feet;
accordingly, Parcel 1 will exceed this requirement because it will be 23,782 square feet in size. There is
no minimum lot size for the C-G zone; accordingly, Parcel 2 will meet this requirement because it will
be 9,048 square feet in size.This criterion is met.
c. Each lot created through the partition process shall front a public right-of-way
by at least 15 feet or have a legally recorded minimum 15-foot wide access
easement; and
As a result of this lot line adjustment,Parcel 1 will have approximately 170 feet of frontage on SW Park
Street and approximately 121 feet of frontage on SW Watkins Avenue, and Parcel 2 will have
approximately 98 feet of frontage on SW Park Street. This criterion is met.
d. Setbacks shall be as required by the applicable zoning district.
Parcel 1 is currently occupied by a detached, single-family dwelling and multiple accessory structures.
The main dwelling complies with the development standards for the R-3.5 zone, but the accessory
structures do not meet minimum setback requirements. Staff reviewed the applicant's submitted site
plan to conclude that this lot line adjustment will not increase the nonconformity of these existing
accessory structures; therefore, they are not subject to the current minimum setbacks. However, any
new development on Parcel 1 shall comply with all applicable development standards in TDC 18.510
Residential Zoning Districts. Parcel 2 currently does not contain any structures; accordingly,
compliance with minimum setback requirements for the C-G zone will be confirmed prior to building
permit submittal.This criterion is met.

4. With regard to flag lots:
a. When the partitioned lot is a flag lot, the developer may determine the location
of the front yard, provided that no side yard is less than 10 feet. Structures shall
generally be located so as to maximize separation from existing structures.
b. A screen shall be provided along the property line of a lot of record where the
paved drive in an access way is located within ten feet of an abutting lot in
accordance with Section 18.745.050. Screening may also be required to maintain
privacy for abutting lots and to provide usable outdoor recreation areas for
proposed development.
The applicant is not proposing to create any flag lots as a result of this lot line adjustment. These
criteria do not apply.
5. The fire district may require the installation of a fire hydrant where the length of an
accessway would have a detrimental effect on fire-fighting capabilities.
The applicant is not proposing to create a new accessway with this lot line adjustment. In addition, fire
hydrants are already in place.This criterion is met.
6. Where a common drive is to be provided to serve more than one lot, a reciprocal
easement which will ensure access and maintenance rights shall be recorded with the
approved partition map.
The applicant is not proposing to create a common drive to serve more than one lot with this lot line
adjustment.This criterion does not apply.
7. Any access way shall comply with the standards set forth in Chapter 18.705: Access,
Egress, and Circulation.
As a result of this lot line adjustment,Parcel 1 will have approximately 170 feet of frontage on SW Park
Street and approximately 121 feet of frontage on SW Watkins Avenue, and Parcel 2 will have
approximately 98 feet of frontage on SW Park Street. This criterion is met.
FINDING: Based on the analysis above, staff finds the approval criteria for Lot Line Adjustments
are either met, satisfied through conditions of approval, or do not apply. The proposal is in compliance
with the applicable requirements of this Title.

Dear Staff:
The letter is intended to serve as the applicant's statement as required for a submittal of a property line
adjustment application. The applicant is proposing to adjust the common line between Tax Lot 4702 on Map
2S-1-03DA and Tax Lot 7400 on Map 2S-1-02CB. Tax Lot 4702 is currently zoned R3.5 while Tax Lot 7400
is split zoned between R3.5 and CG. The proposed new property line will follow the zoning line so that
adjusted Tax Lot 7400 will only be zoned CG.
Tax Lot 4702 has a house on it that was built in 1940 per assessment records so it predates any zoning
requirements. The carport and garage that encroach onto neighboring properties were likely built at a later
time. The garage is in disrepair and in need of removal however the encroachment issues will not be brought
further out of conformance by approval of the application. The applicants also own adjacent Tax Lot 4701 (not
a part of this application)and will remove the carport if it becomes necessary.
Tax Lot 4700 has no structures,driveway or known utilities. It has access to SW Park Street and a sanitary
sewer line in a public easement along its south side. Stormwater disposal for both properties is by means of an
open ditch and culverts along SW Park Street
The reconfigured properties will meet the code requirements for area as there are no minimums in the CG zone
and Tax Lot 4702 will be in excess of the 10,000 square foot specification for the R3.5 zone. Adjusted Tax Lot
7400 will meet all other requirements for the CG zone. Tax Lot 4702 is also in compliance with the setbacks
and there are no lot coverage requirements.
In summary,the adjusted properties either meet the requirements for the underlying zones or are not being
brought further out of compliance by approval of the proposed property line adjustment.
