As a result of this lot line adjustment, Parcel 1 will be 10,276 square feet in size,and Parcel 2 will be 11,231 square feet in size. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to a condition of approval. The findings and conclusions on which the decision is based are noted in Section IV. LLA2016-00016 Burnett Lot Line Adjustment 1 _ CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED 1. The applicant shall record the lot line adjustment with Washington County, and submit a copy of the recorded survey map to the city within 15 days of recording to be incorporated into the record. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels are located on the north side of SW Greenburg Road, and the west side of SW 915` Avenue. Both parcels are zoned Low-Density Residential (R-4.5), as are adjacent properties. Parcel 1 is a corner lot that has direct frontage along SW Greenburg Road and SW 9151 Avenue, and Parcel 2 has 90 feet of direct frontage along SW 9155 Avenue. Parcel 1 contains a detached, single-family dwelling that projects over the property line into Parcel 2 by approximately 10 feet. Accordingly, the applicant proposes to move the property line between Parcels 1 and 2 approximately 15 feet to the north, so the subject dwelling no longer projects into Parcel 2. Furthermore, as a result of this lot line adjustment, Parcel 1 will meet the minimum setback requirements for the R-4.5 zone. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL CRITERIA: Tigard Development Code (TDC) Section 18.410.040 contains the following criteria for approval of a Lot Line Adjustment request: Section 18.410.040 A. Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No additional parcels will be created as a result of this lot line adjustment. Parcel 1 will be 10,276 square feet in size, and Parcel 2 will be 11,231 square feet in size. Accordingly, both lots exceed the minimum lot size for the R-4.5 zone: 7,500 square feet for detached units.This criterion is met. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Staff reviewed the applicant's narrative and submitted site plan to determine that this lot line adjustment will not result in any violations of the site development or zoning district regulations for the R-4.5 zone. This criterion is met. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; The average minimum lot width for the R-4.5 zone is 50 feet for lots with detached units. Staff reviewed the applicant's submitted site plan to confirm the lot widths for both parcels exceed 50 feet. Therefore, this criterion is met. LLA2016-00016 Burnett Lot Line Adjustment 2 b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; Parcel 1 will be 10,276 square feet in size, and Parcel 2 will be 11,231 square feet in size. Accordingly, both lots exceed the minimum lot size for the R-4.5 zone: 7,500 square feet for detached units. In addition, the applicant is not proposing to create any flag lots with this lot line adjustment. This criterion is met. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and As a result of this lot line adjustment, Parcel 1 will have more than 15 feet of direct frontage along both SW Greenburg Road and SW 91" Avenue, and Parcel 2 will have approximately 76 feet of direct frontage along SW 91s`Avenue. This criterion is met. d. Setbacks shall be as required by the applicable zoning district. Parcel 1 currently contains a detached, single-family dwelling that projects over the property line into Parcel 2 by approximately 10 feet. The applicant proposes to move the property line between Parcels 1 and 2 approximately 15 feet to the north. Therefore, as a result of this lot line adjustment,Parcel 1 will meet the minimum setback requirements for the R-4.5 zone: 20 feet for the front yard, 15 feet for the rear yard, 5 feet for the side yard, and 15 feet for the street side yard. Parcel 2 currently does not contain any structures; accordingly, compliance with minimum setback requirements for the R-4.5 zone will be confirmed prior to building permit submittal. This criterion is met. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.050. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. The applicant is not proposing to create any flag lots as a result of this lot line adjustment. Therefore, these criteria do not apply. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities. The applicant is not proposing to create a new accessway with this lot line adjustment. In addition, fire hydrants are already in place. This criterion is met. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. The applicant is not proposing to create a common drive to serve more than one lot with this lot line adjustment. This criterion does not apply. 7. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. As a result of this lot line adjustment,Parcel 1 will have more than 15 feet of direct frontage along both SW Greenburg Road and SW 91st Avenue, and Parcel 2 will have approximately 76 feet of direct LLA2016-00016 Burnett Lot Line Adjustment 3 frontage along SW 91st Avenue. This criterion is met. FINDING: Based on the analysis above, staff finds the approval criteria for Lot Line Adjustments are either met, satisfied through conditions of approval, or do not apply. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district. The property at 11675 SW 91st Avenue consists of two separate tax lots. No additional parcel or tract is to be created with the Property Line Adjustment. The property is zoned R-4.5, Low Density Residential. The minimum lot size for R-4.5 is 7,500 sq. ft. After the adjustment, Tract 1 will be 10,276 sq. ft. and Tract 2 will be 11,231 sq. ft. Neither lot will be below the minimum lot size. The criteria can be met. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district. The existing house is on Tract 1. There is no structure on Tract 2. Currently, the property line is 10 ft. inside the footprint of the north side of the house. After the adjustment,the northern property line of Tract 1 will be moved 15 ft. to the north, which will allow 5 ft. setback for the north side of the house to the property line. According to Table 18.510.2 Development Standards for Residential Zoning Districts,the minimum side yard setback for a dwelling is 5 ft. The criteria can be met. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district,including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; Tax lot 7000 is on the corner of SW 91st Avenue and SW Greenburg Road. The front of the dwelling on Tax lot 7000 (proposed Tract 1) faces SW 91st Avenue. The current minimum width of the lot is 68.32 ft. along the frontage. After the adjustment,the minimum width will be 80.89 ft. The minimum width of the building envelope area per Table 18.510.2 for R-4.5 lots is 50 ft. There is no building on tax lot 9000 (proposed Tract 2). b. The lot area shall be as required by the applicable zoning district.In the case of a flag lot, the accessway may not be included in the lot area calculations; The minimum area for Lots in the R-4.5 Residential Zone is 7,500 sq. ft. for a detached unit. After the adjustment Tax lot 7000 (proposed Tract 1)will be 10,276 sq. ft. and Tax lot 9000 (proposed Tract 2)will be 11,231 sq. ft. The two tax lots are not flag lots. c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and The proposed land use action is a Property Line Adjustment between two existing tax lots. No partition is needed. This does not apply. d. Setbacks shall be as required by the applicable zoning district. Per Table 18.510.2 Development Standards in Residential Zones, lots in the R-4.5 Residential Zone require minimum setbacks of 20 ft. for the front yard, 15 ft. on the corner facing the street, 5 ft. on the side yard, and 15 ft. on the rear. The adjustment of the property line will move the property line currently through the north side of the house,to allow a 5 ft. setback from the house.
