APPLICATION SUMMARY FILE NAME: DW Sivers Company CASE NO.: Minor Modification (MMD) MMD2017-00018 PROPOSAL: The applicant is proposing a minor modification to an existing development at 13815 SW Pacific Highway. Specifically,the applicant proposes to remove three (3) parking spaces,in order to accommodate a new outdoor seating area with movable tables and chairs. No changes to the building footprint, or on-site landscaping are proposed. The C-G zoning district is designed to accommodate a full range of retail, office and civic uses with a city-wide and even regional trade area. Except where nonconforming, residential uses are limited to single-family residences which are located on the same site as a permitted use. A wide range of uses, including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses, utilities, heliports, medical centers, major event entertainment, and gasoline stations, are permitted conditionally. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The project is located on the northwest side of SW Pacific Highway, north of SW Gaarde Street, and south of SW Fairhaven Street. The subject property is the Gaarde Pacific shopping center, which is made up of one (1) tax lot totaling 1.11 acres, and contains two (2) commercial buildings, 81 parking spaces,and associated landscaping. The applicant proposes to remove three (3) parking spaces,in order to accommodate a new outdoor seating area with movable tables and chairs. No changes to the building footprint, or on-site landscaping are proposed. The site is zoned General Commercial (C-G). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: Section 18.360.060.0 states that a Minor Modification shall be approved, approved with conditions or denied following the Director's review and as follows: 1. The proposed development is in compliance with all applicable requirements of this title; and FINDING: The applicant proposes to remove three (3) parking spaces, in order to accommodate a new outdoor seating area with movable tables and chairs. No changes to the building footprint, or on- site landscaping are proposed. The 1.11-acre Gaarde Pacific shopping center is a mixed-use, multi- tenant site, and is therefore subject to the required minimum vehicle parking formula outlined in IDC 18.765.030.D. Even with the proposed MMI)2017-00018 DW Sivers Company 2 removal of three (3) parking spaces, there is still adequate parking at the subject site, with 78 spaces remaining. Upon review of the applicant's plans and narrative, staff finds that all other applicable requirements are met.This criterion is met. 2. The modification is not a major modification. FINDING: Staff finds that the changes listed in TDC 18.360.050.B.1-11 are either satisfied or do not apply.Therefore,the proposed development is not a major modification.This criterion is met. CONCLI TSION: The proposal is a Minor Modification of existing site development and is in compliance with the applicable requirements of this Title. SECTION V. This gives a total of 81 parking spaces. New Proposal We are proposing to change the use of(3) parking spots (all are normal 9'W x 17'L) and converting the space (27'W x 171) of 459sqft to a sitting area for our customers to eat and drink. With the new plan and converting the 3 spots, the shopping center would still have 76 regular parking spaces and the same original 2 handicap spots. Per our calculation of parking spot ratios, we determined there needs to be a minimum of 61 spots. With the changes, the shopping center would still have an extra 17 spots 18.360.050 Major Modification(s)to Approved Plans or Existing Development B. Evaluation criteria.The director shall determine that a major modification(s)will result if one or more of the following changes are proposed.There will be: 1.
