APPLICATION SUMMARY FILE NAME: CCDA LOT LINE ADJUSTMENT CASE NO.: Lot Line Adjustment(LLA) LLA2015-00002 PROPOSAL: The applicant is proposing to adjust two (2) lot lines, which will reconfigure three (3) different lots. Lot 2 is located at 12780 SW Ash Avenue and Lot 1 and Lot 3 are adjacent lots to the southwest and northeast, respectively. Lot #1 (Tax Lot 3000) of 3.16 acres will become .67 acres, Lot #2 (Tax Lot 2900) of.18 acres will become 2.81 acres,and Lot#3 (Tax Lot 2800) of.14 acres will become 0.0 acres. The MU-CBD zoning district is designed to provide a pedestrian friendly urban village in downtown Tigard. A wide variety of commercial, civic, employment, mixed-use, multifamily and attached single-family residences are permitted. New development and redevelopment is required to conform to the standards of Chapter 18.610. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.410.040. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. LLA2015-00002 City Center Development Agency Lot Line Adjustment 1 CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED The applicant shall record the lot line adjustment with Washington County and submit a copy of the recorded survey map to the City within fifteen days of recording to be incorporated into the record. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcels are located along the southeast frontage of SW Ash Avenue between SW Burnham Street and Fanno Creek Park. The site is currently used for a dog park and the Public Works yard for the City of Tigard and contains several buildings, parking and paved accessways. There are a few perimeter trees around the yard, which is bordered by Fanno Creek Park along the west, a storage facility and an auto repair building on the southeast. The area in the western corner of Lot #1 contains all of the sensitive areas associated with Fanno Creek Park. The city is preparing the property for sale to a developer for the proposed 164-unit Burnham & Ash Apartments. Through the land use review process for the proposed development the adjusted Lot #1 will be dedicate to the public to become part of Fanno Creek Park, while adjusted Lot #2 will become the development site subject to dedication for a new street. Proposal Description: The applicant is proposing to adjust two (2) lot lines,which will reconfigure three (3) different lots. Lot 2 is located at 12780 SW Ash Avenue and Lot 1 and Lot 3 are adjacent lots to the southwest and northeast, respectively. Lot #1 (Tax Lot 3000) of 3.16 acres will become .67 acres, Lot #2 (Tax Lot 2900) of .18 acres will become 2.81 acres, and Lot #3 (Tax Lot 2800) of .14 acres will become 0.0 acres. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL CRITERIA: Section 18.410.040 contains the following criteria for approval of a Lot Line Adjustment request: Section 18.410.040 A. Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; As shown in the proposed Record of Survey by AKS Engineering, date 5/28/2015, no new lots will be created as part of this adjustment. Lot #3 will be consolidated into Lot #2 and Lot #1 will shrink to an area that contains the sensitive lands associated with Fanno Creek. There are no minimum lot area requirements for the MU-CBD zone. This criterion is met. 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; LLA2015-00002 City Center Development Agency Lot Line Adjustment 2 Based on the Planning Application Map and Existing Conditions Plan submitted, the lot line adjustment does not create any violations of the site development or zoning regulations. All of the existing buildings will be removed for the proposed apartment complex. The proposed apartments will be reviewed under separate application to ensure the site development or zoning district regulations for that district are met. This criterion is met. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and d. Setbacks shall be as required by the applicable zoning district. In the MU-CBD, there are no minimum lot width or size standards. The two remaining lots after the adjustments will front SW Ash Avenue for 154 feet (Lot #1) and 475 feet (Lot #2). The proposed adjustments will not change the relationship of the existing buildings to perimeter lot lines, which meet the setback criteria. These criteria are met. 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. No flag lots will be created from the proposed lot line adjustments. This criterion does not apply. 5. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. No changes to access ways are required or proposed with this application. This criterion does not apply. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. No changes to access ways are required or proposed with this application. This criterion does not apply. 7. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. The proposed lot line adjustments will not affect the current site access. New access ways proposed for the Burnham & Ash Apartments development will be reviewed for compliance under separate application. This criterion is met. B. Exemptions from dedications. A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. LLA2015-00002 City Center Development Agency Lot Line Adjustment 3 Floodplain, greenway, and right-of-way dedication are not required as part of this application. Dedications are proposed in the Burnham & Ash Apartments application and will be reviewed for compliance through a Downtown Design Administrative Review.This criterion is met. C. Variances to development standards. An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370, Variances and Adjustments. The applicant has not requested a variance. This criterion does not apply. FINDING: Based on the analysis above, staff fords that the Lot Line Adjustment criteria have been met. SECTION V. This adjustment is related to the development of a mixed use building. The lot line of Parcel 1 will be adjusted , reducing the area from 3.16 acres to .67 acres (the wetland area). The lot lines of Parcel 2 will be adjusted to add area from Parcel 1 and Parcel 3,with the final area of 2.81 acres. Parcel 3's area will be adjusted to zero. 18.410.040 Approval Criteria A. Approval criteria. The director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district. Response: The lot line adjustment does not create an additional parcel. The lots are located in the Mixed Use Central Business District Zone which has no minimum lot size requirements (Table 18.520.2) 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district. Response: The final size of the lots will not be in violation of the site development standards of 18.610.1. a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; Response: This will be reviewed as part of the master land use case review. b. The lot area shall be as required by the applicable zoning district.
