A request by Butler Tire & Battery for review of a new
tire retreading warehouse and office facility located
westerly of S. W. 72nd Avenue, 400 feet south of S. W.
Cherry Street and north of Circle A-W Products Co.
Site comprises approximately 5 acres and is located in an
M-4, Industrial Park zone. (Tax Map 2S1 1DC, Tax Lots 800,
1200, 3301) .

SDR 17-74 (Butler Tire & Battery)
Site Development Plan Review
For property located westerly of S. W. 72nd Avenue, 400
feet south of S. W. Cherry St. and north of the Circle
A-W Products Co. Site comprises approximately 5 acres
and is located in an M-4, Industrial Park zone. (Tax
Map 2S1 1DC, Tax Lots 800, 1200 and 3301) .
Staff Findings
1. This department, after consultation with the City' s
attorney, Mr. Fred Anderson, find the property owner
must submit to the City Planning Commission an appli-
cation for minor land partitioning pursuant Section
17.24.010, Tigard Municipal Code. Said section states:
"A tract of land or contiguous tracts under a
single ownership within the City shall not be
partitioned into two or more parcels for trans-
+ ' fer of ownership, development or for any other
purpose so as to conflict with the requirements
of this title. "
2. The applicant's submission meets the submission require-
ments of Chapter 18.58, Tigard Municipal Code, with ex-
ception of storm drainage utility plans.
3. The Planning Department has the following concerns re-
lated to the applicant' s proposal:
18.52.040(2) The applicant' s proposal does not
meet the 50 foot sideyard setback
requirement on the north side of
the proposed structure, adjacent
the boiler and compressor rooms.
18.52.070(a) & (b) Properties abutting a residential
zone shall provide and maintain an
evergreen landscape buffer; yards
abutting residential zones shall
provide lawn and trees and/or
shrubs maintained in a park-like
character. The applicant' s pro-
posal does not meet this criteria.
Meadow grass is not lawn and buffer
is not evergreen.
18.58.020(3) (5) (6) The applicant' s landscape plan does
not meet the purposes of the Site
Development Plan section of the
Tigard Municipal Code. Said pur-
poses are to conserve the City's
natural beauty by properly relating
structures and improvements to
surrounding sites and structures;
to stabilize and improve property
values and prevent blight; and to
achieve a pleasant living and work-
ing environment.
18.60.150(a) Backing and maneuvering will occur
within potential street or access
easement area, conflicting with
the intent of the Tigard Municipal
Code.
18.60.150(b) The southwesterly corner of the
building does not meet site distance
requirements described by the Tigard
Municipal Code.
18.60. 170 The paved parking and maneuvering
w areas must be constructed to City
street standards.
18.60.180 Bumper rails or curbs shall be
located around the periphery of
parking lots.
4. Additional concerns relate to the following:
o the angle of the entrance drive into the easterly
parking lot
o deficiency of required parking spaces as per 18. 60. 120.
24 are required where 16 are indicated upon the sub-
mitted site plan.
Staff Recommendation
Tabling consideration of the subject site development plan to
allow the applicant to complete the required minor land par-
titioning procedure and to revise the site development plan to
reflect conformance with code requirements as stated within
this staff report. Said revised plan should also reflect
any Planning Commission conditions placed upon approval of a
minor land partition or major land partition.
