LOCATION: 13273 SW Bull Mountain Road; Washington County Tax Assessor's Map No. 2S109AB,Tax Lot 00300. The subject site is located north of SW Bull Mountain Road and east of SW 133xd Avenue. ZONE: R-7: Medium-Density Residential District. The R-7 zoning district is designed to accommodate attached single-family homes,detached single-family homes with or without accessory residential units, at a minimum lot size of 5,000 square feet, and duplexes, at a minimum lot size of 10,000 square feet. Mobile home parks and subdivisions are also permitted outright. Some civic and institutional uses are also permitted conditionally. INFORMATION SUMMARY Council has approved and adopted the Urban Renewal Plan. On May 16, 2006, voters approved the use of Tax Increment Financing. ORS 457.095 requires that Council take action to have the plan recorded by forwarding the Plan to the Urban Renewal Agency(CCDA). OTHER ALTERNATIVES CONSIDERED Non-Action would result in the inability to utilize an Urban Renewal District in Downtown. "City Engineer" means the person designated by the City Manager to fulfill the responsibilities of City Engineer established by this code or by state statute. The City Manager may designate different persons to fulfill different responsibilities, and those responsibilities may be further delegated. SECTION 2: This ordinance shall be effective 30 days after its passage by the Council, signature by the Mayor, and posting by the City Recorder. F Craig Dirksen, Mayor ORDINANCE No. 06- C+� Page 1 Approved as to form: clt�;,1 t rney 2 Date ORDINANCE' No. 06-(--')LO Page 2 CITY OF TIGARD, OREGON TIGARD CITY COUNCIL ORDINANCE NO. 06-03 AN ORDINANCE AMENDING TIGARD MUNICIPAL CODE SECTION 7.40.170.A TO ALLOW THE USE OF MUFFLED EXHAUST BRAKES ON FIRE FIGHTING APPARATUS WHEREAS, Tualatin Valley Fire and Rescue (TVF&R)has completed a District-wide review of compression braking, also known as exhaust braking or"jake brakes"; and WHERE-AS, TVF&R apparatus using muffled compression brakes meet noise emission standards from the Environmental Protection Agency (EPA); and WHEREAS, the Municipal Code exempts sounds caused by emergency work and emergency vehicles from noises standards in Section 7.40.180.13, but specifically prohibits the use of exhaust braking except in an emergency, in Section 7.40.170,A; WHEREAS, TVF & R has requested clarification of the code to allow TVF&R emergency vehicles to continue to use muffled compression brakes in the City; and WHEREAS, the Council concludes that the noise from properly muffled compression brakes on emergency vehicles will be at acceptable noise levels, NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: SECTION 1: Tigard Municipal Code Section 7.40.170.A is amended to read as follows (bold underlined is new language): A. The use of exhaust brakes{fake brakes), except in an emergency or except when used by a person operating an emergency services vehicle equipped with a muffled compression braking system, is prohibited at all times within the City, regardless of noise level. SECTION 2: This ordinance shall be effective 30 days after its passage by the Council, signature by the Mayor, and posting by the City Recorder.
