3 ,-5- CITY ,5CITY OF TIGARD, OREGON RESOLUTION NO. 85 - O A RESOLUTION MODIFYING RESOLUTION NO. 82-45 WHEREAS, the City Council of the City of Tigard adopted Resolution No. 82-45 on May 17 , 1982, by which the City of Tigard resolved to reconvey to the State of Oregon a section of the abandoned right-of-way of a portion of Pacific Highway; WHEREAS, the State of Oregon plans to proceed to dispose of the property described in Resolution No. 82-45 by means of the statutory required procedure of a public sale; WHEREAS, a portion of condition 1 in Resolution No. 82-45 provides that title to portions of this property vest in abutting landowners ; WHEREAS, such a condition is inconsistent with the statutory required public sale of such property and thus, the City of Tigard desires to modify Resolution No. 82-45 by deleting that portion of condition 1. ; and WHEREAS, the State of Oregon plans to enter into an interim lease of the property described in Resolution No. 82-45 , leasing this property to the adjacent landowner until a public sale occurs so as to further the development of the adjacent property; and WHEREAS, the City of Tigard has no objection to this interim lease and public sale of the property described in Resolu- tion No. 82-45; Page 1 of 2 RESOLUTION NO. 85 - 0/ r.w 4 NNW NOW, THEREFORE, IT RESOLVED by the City Council of the City of Tigard, that: 1. The following language be deleted from Resolution No. 82-45 at page 2 : "and that the portions of the Property to which the State did not hold deeded title shall vest in the abutting landowners; " and 2 . The City of Tigard has no objection to an interim lease of the property described in Resolution No. 82-45 to the adjacent landowner until a public sale of this property. The relinquishment of the city' s rights to this right-of-way is purely a policy matter for the Council . If the Council does desire to commence proceedings to relinquish the right-of-way, or to explore the feasibility of such proceedings, it should adopt the attached resolution. Adoption of the attached resolution does not relinquish the right-of-way. The resolution merely indicates that the city is willing to undertake such relinquishment if the conditions listed in the resolution are fulfilled. If the Council desires any further conditions, those conditions should be inserted in the attached resolution. WHEREAS, prior to 1977 the State of Oregon, by and through its Department of Transportation, Highway Division, (hereinafter "State") relocated the Park Street-Watkins Avenue section of Pacific Highway West, State Primary Highway No. 1W, (hereinafter "Pacific Highway West") in Washington County, Oregon; and WHEREAS, that by reason of the relocation of the Park Street- Watkins Avenue section of Pacific Highway West, the following described section of the right-of-way of the former route of the highway was no longer needed by the State, to-wit: All of the land within the right-of-way boundaries of the Pacific Highway West, State Primary Highway No. 1W, as formerly routed lying outside the southeasterly right-of-way boundary of said Pacific Highway West, as now relocated from approximately opposite relocated highway engineers stations 119+00 to 134+50, and lying in Section 2, Township 2S, Range 1W, Willamette Meridian, Washington County, Oregon. B. Bishop in regard to property located southeast of Pacific Highway West in Tigard, Oregon, near the intersection of Park Street and Pacific Highway West (roughly across from Pietro ' s Pizza) . The City of Tigard owns a strip of property located between our client' s property and Pacific Highway West, as illustrated on the enclosed drawing. The City of Tigard acquired this property pursuant to an Agreement with the State of Oregon, acting by and through its Department of Transportation, dated January 6, 1977, relating to the elimination and dis- position of a portion of the right-of-way of Pacific Highway West which was no longer needed by the State due to the relocation of Pacific Highway West. Pursuant to this Agreement, the Department of Transportation adopted Abandonment and Retention Resolution No. 560, relinquishing the following described property to the City of Tigard: "All the land within the right-of-way boundaries of Pacific Highway West, State Primary Highway No. 1W, as formerly routed lying outside the southeasterly right-of-way boundary of said Pacific Highway West, as now relocated from ,STOEL,RIVES,BOLEY,FRASER AND WYSE Mr. Frank Currie March 5 , 1982 Page 2 approximately opposite relocated highway engineers station 119+00 to 134+50 , and lying in Section 2 , Township 25, Range 1W, Willamette Meridian, Washington County, Oregon. " (the "Relinquished Property" ) The portions of the above described property to which the State of Oregon held deeded title, shown in red on the attached drawing, were conveyed to the City of Tigard by a Relinquishment of Titled dated April 5 , 1977 (the "Deeded Property" ) . The documents transferring the Relinquished Property to the City of Tigard require the Relinquished Property to continue to be used for public purposes and require the City of Tigard to maintain the Relinquished Property as part of the City' s public street system. Our client and the other landowners whose properties abut the Relinquished Property desire to acquire the Relinquished Property for use in connection with the development of their properties. I understand that our client has discussed this matter with you. It is also my understanding that the City of Tigard does not wish to continue ownership of the Relinquished Property and would be willing to allow the abutting property owners to acquire the Relinquished Property. Since the documents conveying the Relinquished Property to the City of Tigard require continued public use of the Relinquished Property, I do not believe the City of Tigard can convey the Relinquished Property to the abutting landowners . In order to allow the abutting landowners to acquire the Relinquished Property, I propose that, in cooperation with the Department of Transportation, the following steps be followed: 1) The City of Tigard relinquish the Relinquished Property back to the State of Oregon; 2) The Department of Transportation determine that the Relinquished Property is no longer needed or valuable for public purpose; 3) The portions of the Relinquished Property which are not Deeded Property would, by virtue of ORS 366 . 300 (2) , automatically vest in the abutting landowners; and 4 �II STOEL,RIVES, BOLEY, FRASER AND WYSE Mr. Frank Currie March 5, 1982 Page 3 4) The Department of Transportation would dispose of Deeded Property in accordance with the normal methods for disposal of state property. Before we can proceed along the lines referred to above, we need to confirm that the City of Tigard does not wish to continue ownership and maintenance of the Relinquished Property, and is willing to cooperate in transferring the ownership of such property to the abutting landowners . Our client is in the process of confirming development plans for his property and we would like to proceed with the transfer to the abutting landowners as soon as practicable. W. Beaverton- Pacific Highway West Hillsdale Highway PORTLAND OR 97225 Our research shows that this roadway in 1856, as shown in County Road Book #A-38, was called Taylor's Bridge Road. In 1910, by petition recorded in CCJ Book 11, page 85, said road- way was established as County Road ##477. In 1917 by legislative action, the roadway became a part of the highway system. In 1940, the roadway was realigned and improved by the Highway Department. In 1977, the Oregon Transportation Commission by Abandonment and Retention Resolution #560, dated January 18, 1977, declared that a portion of the right of way of the former route was no longer needed as a part of the re- located highway; therefor, said resolution and the Relinquishment of Title dated April 5, 1977, transfers State's right, title and interest in the subject property to the City of Tigard. The relinquishment has two restrictions: (1) "only so long as used for public road purposes." (2) "Reserving and excepting an easement for the existing slopes of Pacific Highway West." I'm sure you must have a copy of the agreement between the State and City dated January 6, 1977, which has a copy of City Resolution #76-97 dated December 13, 1976 attached. I have highlighted the areas of highway right-of-way that were covered by that deed by reference to their original grants to the State of Oregon Highway Department from the original owners of the property. The entire parcel intended to be relinquished to the City of Tigard is outlined with red. Because of the reference in the relinquishment deed to the original deeds to the State of Oregon, it is our opinion that all of the intended Eroperty was not included in the _original relinquishment, although the agreement between the City of Tigard and the State ofOreggn and the resolution passed by the City of Tigard did include all of the property as outlined in red. According to the Oregon Statutes this road would be 60 feet in width. The General Land Office Plat for Township 2 South, Range 1 West, signed by John B. Preston, Surveyor General, Nov- ember 12, 1852 shows a road to be in the area of the above Territorial Road running from Portland to Corvallis and known as "Taylors Bridge Road". In 1910 a portion of Taylors Bridge Road was relocated. This relocation began on the line between Sections 2 & 3, Township 2 South, Range 1 West and proceeded northerly to the most southerly corner of Lot 52 in North Tigard Addi- tion. This relocated road known as "County Road No. 477" was established in a width of 60 feet. In the 1930's the State Highway Department purchased certain lands in the area in question to relocate the Pacific Highway West. The following deeds for this area are: R/W 413 - dated 12-23-1930 (Stedman) ; R/W 727 - dated 5-S-1931 (Cox); and 6669 - recorded 5-13-1952 (Cook). Copies of these deeds are enclosed for your file. WITNESSETH RECITALS 1. For the purpose of furthering the development of a highway sys- tem adapted in all particulars to the needs of the people of the State of Oregon, State has relocated and constructed the Park Street-Watkins Avenue Section of the Pacific Highway West, State Primary Highway No. 1W, in Washington County, in the City of Tigard, as shown colored in red on the map attached hereto, marked Exhibit "A" and by this reference made a part hereof. 2. Pursuant to ORS 373.010 and ORS 373.015, whenever the route of any state highway passes through the corporate limits of any city, State may locate, relocate, reroute, abandon, alter, or change such routing when in its opinion the interests of the motoring public will be better served. 3. Pursuant to ORS 271.330, the State or any political subdivision within the State may relinquish title to any of its property not needed by it for public use to any other governmental body or political subdivision within the State, providing such• property shall be used and continue to be used for a public purpose. 4. The construction of said project makes possible the elimination by State of a portion of the original route of the said Pacific Highway West as shown colored in red on the attached Exhibit A and hereinafter referred to as Unit A. Unit A, as hereinafter described, is needed for the service of persons living thereon or for a community served thereby. The parties hereto plan and propose that jurisdiction and control over Unit A shall pass to City, and that said Unit A shall be maintained by City as part of its city street system. 5. Unit A is described approximately as follows: All the land within the right-of-way boundaries of the Pacific Highway West, State Primary Highway No. 1W, as formerly routed lying outside the southeasterly right-of-way boundary of said Pacific Highway West, as now relocated from approximately opposite relocated highway engineers station 119+00 to 134+50, and lying in Section 2, Township 2S, Range 1W, Willamette Meridian, Washington County, Oregon. • • • NOW, THEREFORE, the premises being in general as stated in the fore- going RECITALS, it is agreed by and between the parties hereto as follows: THINGS TO BE DONE BY STATE: 1. State, by resolution, shall formally eliminate Unit A as a part of the Pacific Highway West and the state highway system, and all right, title and interest which State has in the right-of-way of the said Unit A shall there- upon pass to and vest in City. 2. State shall , under ORS 271.330, relinquish to the City of Tigard any deeded property located within the boundaries of Unit A as heretofore described. 3. State shall retain any slope easements now in effect on Unit A as heretofore described. 4. State shall retain that portion of the right-of-way of the Pacific Highway West and that real property acquired by State for highway right-of-way and other public purposes, shown outlined in green on Exhibit A. THINGS TO BE DONE BY CITY 1. City, by execution of this agreement, hereby approves the RECITALS, THINGS TO BE DONE BY STATE, and all other provisions of this agreement. 2. City agrees to accept all of State's right, title, and interest, and assume all jurisdiction and control over the said Unit A, as shown colored in red on the attached Exhibit A, and shall maintain same at its sole expense as part of its city street system. - 2 - • . 3. City shall pass an ordinance or resolution, as the case may be, authorizing the Mayor and Recorder to enter into the agreement on behalf of City, and the same shall be made a part hereof and attached hereto. IN WITNESS WHEREOF, the parties hereto have set their hands and affixed their seals as of the day and year hereinafter written. The Oregon Transportation CoRmission, by a duly adopted delegation order, authorized its Chairman or Vice Chairman to act in its behalf in approving thi agreement. Approval was, given for this agreement on 1- G _ 9 by CHA Th ,NI JACKSON , which approval is on file in the ommission records. The delegation order also authorizes the State Highway Engineer to execute the contract on behalf of the Commission.
