PUBLIC HEARING
A public hearing will be held by the City Council of Tigard,
Oregon, on Monday, the 27th day of November,1967 at the hour of
8 : 00 P.M. , in the City Mall, Main Street , Tigard, Oregon, with
respect to a petition filed on October 23, 1967 by KAY LIVINGSTON,
BESSIE LIVINGSTON, IVAN E. SNOOK and MAXINE SNOOK, requesting that
the following described portion of 94th avenue , within said City ,
be vacated:
All that portion of the cul-de-sac of 94th AVenue
lying East of a line drawn from the Southwest corner
of Lot 3, THOMAS TERRACE, to the Northwest corner
of Lot 2, MILLER;
All that portion of the cul-de-sac lying West
of a line drawn from the Southeast corner of Lot 6
to the Northeast corner of Lot 7, MILLER.

The petition of KAY LIVINGSTON and BESSIE LIVINGSTON and
IVAN E. SNOOK and MAXINE SNOOK, respectively shows:
I
That petitioners Kay Livingston and Bessie Livingston
as tenants by the entirety are the owners of the Southerly 72.9
feet of the Easterly 83 feet of Lot 9, MILLER, in the City of
Tigard, Washington County, Oregon;
II
That petitioners Ivan E . Snook and Maxine Snook as ten-
ants by the entirety are the owners of Lot 1, MILLER, in the City
of Tigard, Washington County, Oregon;
III
That the foregoing premises of petitioners respectively
abut 94th Avenue on the East and West boundaries thereof; that
94th Avenue in the abutment area includes a cul-de-sac , the Easterly
and Westerly portion of which extend beyond the normal cul-de-sac
line into the lots of the respective owners of the premises .

That a particular description of the area sought to be
vacated follows:
a. All that portion of the cul-de-sac of 94th Avenue
lying East of a line drawn from the Southwest
corner of Lot 3, THOMAS TERRACE to the Northwest
corner of Lot 2, MILLER;
b. All that portion of the cul-de-sac lying West of
a line drawn from the Southeast corner of Lot 6
to the Northeast corner of Lot 7 , MILLER.

That the purpose for which the ground is proposed to be
used is for residential occupancy purposes consistent with the
zoning ordinances of the City of Tigard and the reason for said
vacation is that the said portion to be vacated has no useful pur-
pose remaining as a part of 94th Avenue , inasmuch as 94th Avenue ex-
tends from S .W. North Dakota Street to Greenburg Road 50 feet in width,
exclusive of the area sought to be vacated throughout its extent .

That the petitioners are the owners of all abutting property
upon the said portion of said street sought to be vacated and there
is appended hereto the consent of not less than two-thirds in area
of the real property affected thereby, being the land lying on either
side of 94th Street and extending laterally 200 feet Easterly and
Westerly from 94th Street and extending a like lateral distance on
either side of 94th Street for 400 feet along its course beyond each
terminus of the part proposed to be vacated.
WHEREFORE , petitioners as the persons interested in said
portion to be vacated hereby, consent to the vacation thereof and pray
that the City Council of the City of Tigard fix a time for formal
hearing of the petition and give notice as provided by Section 271.110,
Oregon Revised Statutes , and that at the hearing all objections filed
thereto be heard and that the City Council finding that the public
interests will not be breached by the vacation of said portion of
94th Street, thereafter pass an ordinance vacating said portion of
94th Street.
