ORDINANCE No. 74-
AN ORDINANCE VACATING DEDICATED UNOPENED PORTION OF S.W. 69TH AVENUE IN THE
CITY OF TIGARD, WASHINGTON COUNTY, OREGON.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The Council finds that a resolution was adopted by the Council on
January 14, 1974 relating to the vacation of the hereinafter described
dedicated unopened portion of a public way and that a public hearing was thereby
called to be held on February 25, 1974 and that notice of said hearing was
given as required by Chapter 271.110 O.R.S. as set forth in said resolution.
Section 2: The Counci further finds that a public hearing is thereby called
to be hel as duly and regularly held at the regular Council
meeting on F/ay , 1974 at'which time and place the, Council afforded all
interested popportunity to be heard for or against the proposed
vacation of , and the Council further considered all objections thereto.

Section 5: The Council further finds that the City recording officer has filed in
her office a certificate showing that all city liens and taxes, if any,
have been paid on the lands proposed to be vacated.
Section 6: The following described portion of dedicated unopened street be, and
the same is hereby vacated and discontinued as a public way:
That segment of 60.0 foot wide S.W. 69th Avenue .,(Washington
Street-plat) lying between Lot 39 and Lot 40 of West Portland
Heights, a subdivision plat of record in Washington County,
Oregon; said segment of S.W. 69th Avenue being limited to that portion,
thereof, lying Southerly of an Easterly extension of the North boundary
line of said Lot 40 and lying Northerly of an Easterly extension of the
South boundary line of said Lot 40. Containing 0.647 acres.
Section 7: That the City Recorder be, and she is hereby authorized and directed
to have certified copy of this ordinance filed for record with the
following Washington County departments:
1. Department of Records & Elections
2. Department of Revenue & Taxation - Attn: Assessor
3. Department of Public Works - Attn: County Surveyor

Section 8: This ordinance shall be effective on and after the 31st day
after its enactment by the City Council, and approval by the
Mayor.

and S.W. Irving Street.
The Planning Commission, at its regular meeting of December 18, 1973, took action
to recommend the vacation of the above described street subject to the following
condition:
Ten feet of S.W. 69th Avenue, adjacent S.W. Hampton Street
shoald not be vacated in order to provide for the future
right-of-way needs for an improved S.W. Hampton Street.

A request by Harley Davidson of Portland to allow retail motor-
cycle and motorcycle accessory sales in a C-3, General Commercial
zone. Subject property located at 11845 S.W. Pacific Highway.
The site comprising . 46 acres and occupied by one single family
dwelling and one 5000 square foot commercial structure. (Tax
Map 151 35DD, Tax Lot 800 A-1 and 800) . Planning Commission
approved request with conditions.
(a) Public Hearing 8 : 00 P.M.
Planning Staff gave findings and showed slides of site under
consideration. Planning Commission had approved conditional
use with conditions and applicant was appealing condition
"e" which states : "That this approval be granted for a one
year period, to be reviewed at the end of that time by the
Planning Commission".

A RESOLUTION CONCERNING VACATION OF A DEDICATED PORTION OF S.W. 69TH AVENUE
IN THE CITY OF TIGARD, WASHINGTON COUNTY; OREGON.
v WHEREAS, the area described on the attached sheet headed "EXHIBIT A"
and by this reference made a part hereof, is part of a dedicated street and/or
alley in the West Portland Heights Subdivision within the corporate limits of the a =''
City of Tigard, Washington County, Oregon; and
WHEREAS, said lands do not serve a public purpose and are so situated
as to be of no usefulness now or in the future as part of the public street
system of the City; and

WHEREAS, it appears to be in the public interest that the said area be
vacated and restored to the tax rolls and grade available to development and use by
the adjoining property owners to whose lands the same, if vacated, would
attach; and
WHEREAS, pursuant to Chapter 271.080 ORS, abutting property owners have
petitioned for the initiation of vacation proceedings as authorized in Chapter
271 ORS.
NOW, THEREFORE,
BE IT RESOLVED by the City Council of Tigard,{,as follows:
(1) "That a public hearing is hereby called to be held by the
City Council of Tigard on Monday, February 25, 1974, at
Administration Office, Charles F. Tigard Grade School within
the City of Tigard, beginning at 8:00 P.M. , at which time
and place the Council shall hear any objections thereto, and any
interested person may appear and be heard for or against the
proposed vacating of said leads.
(2) "That the City Recorder be, and she is hereby, authorized
and directed to cause to have published in the Tigard Times,
a newspaper of general circulation in the city of Tigard
hereby designated for such purpose, a notice of said hearing
in the form hereto attacbed and by this reference made a part
hereof, the first publication to be made on the 24th day of
January, 1974 and *age each week thereafter for ffve
publishings in all.
"The Recorder be, and she is bereby, further directed to cause to have
posted within five (S) days after the date of first publication, a

9. 5 Street Vacation; S.W. 69th Avenue between S.W.
Hampton Street and the vacated S.W. Irving
Staff Findings
1. The Tigard Trianole Development Plan indicates
a pattern of "super-blocks" that will be created
by vacating unneeded segments of existing, dedicated
street right-of-way. These super-blocks will
permit the consolidation of land holdings into
parcels that will accomodate large office developments.
The Lamb-Weston site is an example of an area where
a section of unneeded right-of-way has already
been vacated.
2. The subject street vacation as requested by
Lincoln Properties Inc. , the adjacent property f
owner, is also supported by Lamb-Weston Inc. , who
is the other adjacent property owner.
3. The previous vacation of S.W. Irving Street has
prevented the continuation of S.W. 69th Ave. ,
south into the Farmer' s Insurance Property.
4. Previous Planning Commission approval of the
Farmer' s Insurance Group preliminary development
plan and program did not anticipate the extension
of S.W. 69th Ave. into the Farmer' s site.
5. Access into the Farmer' s Insurance site will be
adequate when S.W. 68th Avenue is improved.
S.W. 66th Avenue currently provides access to the
Farmer' s Insurance site. S.W. 68th Ave. is the
street most logically located to provide access to the
Farmer' s Insurance site.
6. The Tigard Triangle Development Plan indicates a
vacated S.W. 69th Avenue between S.W. Hampton
Street and the vacated S.W. Irving Street, thus,
the vacation request conforms to the Tiqard Triangle
Development Plan.
Staff Recommendation
The Planning Commission recommend to the City Council
the vacation of S.W. 69th Avenue between S.W. Hampton
Street and the vacated S.W. Irving. Ten feet of S.W. 69th
Avenue adjacent S.W. Hampton Street should not be vacated
in order to provide for the future right-of-way needs for
an improved S.W. Hampton Street.
B. Mickelson moved to interpret the requested
motorcycle sales store as a conditional
use. Hartman seconded and the vote was
unanimous.
10. 3 Discussion of a request by the Murray-McCormick
Environmental Group to consider "major appliance .
and furniture assembly, warehousing and retail
sales where the majority of space utilization i.s
for warehousing and assembly" as a conditional
use in an M-4, Industrial Park zone.
1. Staff Findings
A. Brooks presented the staff findings and
informed the Planning Commission that this was
a matter of discussion at this time and that
no staff recorrm5ndation was prepared.
2. Commission Discussion and Action
A. The Commissioners, after discussing the
request, agreed that a major aspect of a
furniture business is storage or warehousing
of merchandise. A basis was therefore recognized
for considering a furniture store as a condition-
al use in an M-4, Industrial Park zone in that
warehousing is presently a conditional use in
this zone.
B. Hartman moved to instruct the staff to draw
up an ordinance amendment to include a
furniture store as a conditional use in
an M-4 zone. Barkhust seconded and the motion
�F . passed by unanimous vote.
10. 4 Vacation of S.W. 69th south of Hampton
1. Staff Findings and Recommendation
A. Brooks presented the staff findings and
recommendation for approval. ;.

BE I'r RESOLVED by the City Council of Tigard, as follows :
11) "That a public hearing is hereby called to be held by

at Administration Office, Charles F. Tigard Grade School
within the City of Tigard, beginning at 8: 00 P. M. , at
which time and place the Council shall hear any objections
thereto, and any interested person may appear and be
heard for or against the proposed vacating of Said lands.
(2} "That the City Recorder be, and she is hereby, authorized
and directed to cause to have published in the Tigard
Times, a newspaper of general circulation in the City
of Tigard hereby designated for such purpose, a notice
of said hearing in the form hereto attached and by this
reference made a part hereof, the first publication to be
made on the 16th day of August, 1973 and once each week
} thereafter for four publishings in all.
"The Recorder be, and she is hereby, further directed to
cause to have posted within five 15 ! days after the
date of first publication, a copy of said notice in the
form hereto attached, at or near each end of the area (s)
proposed to be vacated, and in addition, the Recorder
shall post a copy of said notice in at least two (2 )
conspicuous places within the area (s) proposed to be
vacated, all of said postings to be accomplished within
the time herein stated.
(3) "That the particular portion of dedicated street proposed
to be vacated is described on the attached sheet headed

Pursuant to resolution of the City Council of Tigard adopted on
August 13, 1973, under authority of Chapter 271.130 Oregon Revised
Statutes, a public hearing will be held by the Council of Tigard
at 8:00 P.M. on Monday, September 10, 1973 at Administration
Office, Charles F. Tigard Grade School, Tigard, Oregon, with
respect to the proposed vacation of the following described
portion of a dedicated street (S.W. 69th Avenue) in the City of
Tigard, Washington County, Oregon:
That segment of 60.0 foot wide S.W. 69th Avenue (Washington
Street - plat) lying between Lot 39 and Lot 40 of West Portland
Heights, a subdivision plat of record in Washington County, Oregon;
said segment of S.W. 69th Avenue being limited to that portion,
thereof, lying Southerly of an Easterly extension of the North
boundary line of said Lot 40 and lying Northerly of an Easterly
extension of the South boundary line of said Lot 40. Containing

Any objections or remonstrances against said proposal to vacate
said area may be made in writing and filed with the City Recorder

(1) City Administrator stated D.E.Q, met today and adopted U.S.A. 's recommendation
that over the next 12 month period the City of Tigard be allowed to connect,
into the Tigard plant system 200 new connections; with re-evaluation at that time
for a possible additional 100 connections for the following year, Qty will have
to devise a system to allocate the allowed 200 new connections, City Administrator
further stated City is accepting building permit applications, dating them and
numbering them as they come in. Aftei City has set some type of priority system,
they will be considered,

Gentlemen:
Would you please initiate the necessary procedures to
vacate 69th Street from Hampton south to Farmers
Insurance Property.
We own Block 39, which is east of 69th, and the Wardin's
own Block 40, west of 69th. Sixty-eighth Street will be
the main thoroughfare north and south in the Golden
Triangle.
The Wardin's and we feel the vacation of 69th Street
will enhance the comprehensive development of the
triangle.
